ISLAMABAD: The reports pertaining to allotment of plots and hefty payments to journalists and media persons by Malik Riaz of Bahria Town on social media, that were subsequently denied, have evoked international debate to check the menace. In certain cases, it is argued, this has created an adverse impact on well reputed families and business houses across the world. One of the two reports was issued by Dr Awab Alvi but he disowned it by claiming that he had downloaded it from a webpage that doesn’t exist any more. A thorough probe is underway at an international as well national level to nab the people who created such a baseless list. Well placed sources told The News that one of the bogus reports in question was uploaded on the social media printed on a fake undated letterhead of Bahria Town by Dr Awab Alvi who is the son of Pakistan Tehrik-e-Insaf (PTI) secretary general Arif Alvi. The fabricated report implicated nine distinguished journalists of the country and when the targeted journalists protested about it, the PTI leaders regretted and assured that the party had nothing to do with it. Shafqat Mahmood, central secretary information of the PTI, said that the party is not responsible for someone who might have done this in his individual capacity. The sources revealed that a number of countries, especially Middle Eastern countries, are actively working against the uploading of fake documents on the social media, and the developed countries of the world are also mulling legislation to check it. Pakistan had stringent laws to check cyber crimes but the law lapsed some years ago because it was promulgated through a presidential ordinance and parliament didn’t take it up afterwards. But the legislation under the Pakistan Penal Code (PPC) and Code of Criminal Procedure of Pakistan (CrPC) is available to lay hands on such criminals. Interestingly, two such false lists were uploaded on the social media; one was on plain paper listing names of eight journalists and it was posted on a fake twitter account in the name of aitazaz.ahsan which was later suspended while the other was uploaded later on June 14 which carried names of 19 beneficiaries of Bahria Town on a fake letterhead. Bahria Town also rejected the report as fake. The earlier account is suspended and a probe is underway as to who uploaded it. The later list was uploaded by Dr. Awab Alvi who claimed that he had picked it from facebook page of ProPakistani but the page isn’t available any more. Such an action of suspending the website, page or account is generally taken after a serious complaint either from the government or anybody who produces evidence beyond any doubt that the information disseminated on it is absolutely fake. Social media entities resort to such an extreme action only after they reach a conclusion that the material on a website or page is slanderous and fake. Another list is reportedly being uploaded on some social media to implicate working journalists, editors, media house owners and senior columnists to malign them. The campaign is the product of some miscreants who want to disgrace and discredit the media, the sources pointed out. The sources warned media people that another plot was also under way against them in which fabricated audio tapes involving distinguished media personalities and owners were being prepared. They said it was quite easy to fabricate different audio tapes and create new ones. It is understood that the social media has two paradoxical faces: one is full of knowledge and serves humanity but unfortunately the other one is labelled as ‘gutter’ since it can be used to upload any matter aimed at character assassinating. The person/organisation involved in the dirty work cannot be identified easily although a number of people who were caught in the business have been severely punished in some countries but it doesn’t happen in every case, the sources said. Talking to this correspondent, a foreign journalist based in Islamabad expressed his astonishment at the importance attached to this kind of media, saying those who considered such social media reports failed to see that the people in the developed world never took such reports seriously. In Pakistan, he added, media brought a bad name to itself by discussing these reports. The international organisations dealing with communication and regulating it and organisations working for protecting the rights of citizens are hectically busy in evolving a system to catch and check those who are uploading bogus material for their vested interests on the web, the sources pointed out. Rampant corruption real problem: Malik Riaz News Desk Monday, January 19, 2009 RAWALPINDI: There is no economic problem in Pakistan but the rampant corruption, and if there is no corruption and left alone by the US and Britain, the country could achieve self-reliance within four years. Malik Riaz Hussain, head of Bahria Town, stated this while speaking as chief guest at a forum on problems faced by the Pakistani expatriates in property affairs, particularly in purchase of plots and after that. The event was organised by Daily Jang and Geo News, London, and panellists included Lord Nazir Ahmed, Zubair Gul, Mohsin Akhter and Ahmed Shahzad while Iftikhar Qaiser hosted the forum. “In this regard, we had also suggested some steps through we could have repaid the country’s debt,” Malik Riaz said. “In fact, every big figure in Pakistan is part of land mafia as no poor can grab land of another, therefore, there is a need to lay hands on big fish. All those sitting in the government are part of the mafia, otherwise a law can be passed within 24 hours,” he said. Malik Riaz said that all areas have their own desperados who do not allow setting up of schools in the respective areas so that people could not get education. He said that he did not get education from college or university and has learnt everything from experiences of his life. He said that an under-construction university affiliated with Middlesex University of Britain would start functioning in Pakistan. “After the October 8, 2005 earthquake in Pakistan, the government had no machinery to remove debris and without any request from the government, we shifted our machinery to the quake-hit areas. We have left no room for a fraud in Bahria Town project and any other scheme in which it is a partner. We are always alert about the mafia. Whenever I announce a new scheme, the pocket plots are purchased there in a single night. Then I pay several times more to acquire such plots so that every person can get a plot,” Malik Riaz said. “Under a law of the Punjab government, if anybody purchase 80 per cent land anywhere, he can get the remaining 20 per cent land vacated after payment to the owners,” he added. The Bahria Town chief said that according to his estimates, currently Pakistan needs 700,000 new houses annually whereas the government is building only 250,000 houses. He said that neither he is a political person nor has any intention to join politics. He said he has allocated 75 per cent of his assets for welfare activities while the remaining 25 per cent is meant for his family. “There is nothing to worry about and expatriate Pakistanis should make investment in their homeland without any fear. Only there is a need for purchasing property and making investment in a planned manner,” he said. Malik Riaz said that Bahria Town is the largest housing project in Asia with annual turnover of $1 billion. He said that 20,000 people are employed in the Bahria Town project and thus it is source of income for 100,000 people. He said that Henry Ford, the owner of the American car manufacturer, Ford, impressed him immensely for being a semi-educated person like himself. Quoting Henry Ford that he desired always to be remembered as a philanthropist, Malik Riaz said it is his wish that instead of a real estate tycoon he is remembered as a welfare tycoon. A large number of Pakistani expatriates in Britain attended the forum held in a big hall of the House of Lords. There was so much rush of people that around 150 people stood for two hours while another 150 people could not attend the forum because the management of the hall had stopped them outside the hall. I found the answer in a book called Secrets of the Press, in a 1999 essay ‘Dumbing up’ by British writer and broadcaster Peregrine Worsthorne, who retired from journalism as the editor of the Sunday Telegraph. He starts the essay talking about when he joined the profession, shortly after the Second World War. For the entire two years of that first job, he wasn’t allowed to write a single line, and was instead expected to content himself with subbing the writing of others, correcting grammar, fact-checking, etc. For an aspiring writer such as himself, this was frustrating in the extreme. He likens it to expecting a future virtuoso pianist to concern himself with misprints in the concert’s programme. This essay was written at the end of his career, however, and after decades of experience here is how he put the difference between then and now: “The most important qualification for being a journalist when I began 50 years ago was not an ability to write. That was even a disadvantage or a liability, since literary facility could so easily tempt a journalist into embroidering the tale which needed, above all else, to be told plainly and unvarnished.” Worsthorne writes that in that age, raking up muck was considered unworthy of a quality press, for “an adversarial stance, while being the easiest to take, might not always be the right one”. The people at large feel that now the present government stands for misrule, lawlessness, corruption and dearness. Supporting the government would mean supporting the price-hike, poor governance, corruption and chaos. Nobody put the Gun on Jang Group's head to File the Report of Online International News Network as Lead Headlines in Daily Jang and The News International too but Jang Group very conveniently rather shamelessly says, KARACHI: A senior official of The Jang Group has protested the release of the story by the Online news agency about some purported diplomatic cables released by WikiLeaks disclosing that there were enough evidences of Indian involvement in Waziristan and other tribal areas of Pakistan as well as Balochistan. The story was published by all newspapers of the group, including Daily Jang and The News International, on December 10, 2010. The news item was also carried by the group’s websites. The official said in a letter to Online on Friday: “Immediately on publication of the above story, the international media declared this news as fake and severely criticised our newspapers. The Guardian of UK published under the headline ‘Pakistani Media publish fake Wikileaks cable attacking India.’ They mentioned the name of Daily Jang and The News International and said that it was the first case of Wikileaks being exploited for propaganda purposes.” The letter said: “We have ourselves investigated and checked thoroughly and did not find any such diplomatic cable on WikiLeaks. Our groupís credibility has been thus badly damaged at the international level due to your concocted and fake news item.” It added: “Please let us know at the earliest why such a damaging fake story was concocted by your news agency and who had asked you to do so.” The official pointed out that senior editors of the group had complained that in the past too, Online news agency had released false and fake news items on many occasions. “They have become suspicious of the credibility of the stories of your agency and are showing reluctance to use the same any more,” he said. “We will be waiting for your reply and in the meantime please note that we will not pay you the subscription of the current month. MUHAMMAD SALEH ZAAFIR, SENIOR CORRESPONDENT OF JANG GROUP OF NEWSPAPERS/GEO TV & CONTEMPT OF COURT - ISLAMABAD: The 13-member full court of the Supreme Court on Tuesday accepted the unconditional apology of a newsman for filing a report pertaining to the alleged preparation of references against four senior judges of the said bench. Following is the text of the order issued by the 13-member full court of the Supreme Court after unconditional apology by journalist Muhammad Saleh Zaafir:




“Muhammad Saleh Zaafir, editor special reporting of daily Jang and The News, has entered appearance on our call in connection with the news items appearing in the Rawalpindi edition of the daily ‘Jang’ and daily ‘The News’ on 11th June, 2007, regarding some references being made against four senior hon’ble judges of this Court who, presumably also happen to be the members of this bench. The said news item appeared to be open to further serious exception because such a news item had been published, more than boldly, on the front pages of the said two newspapers on the day when the bench was expected to announce its decision on the maintainability of the petition filed in this court questioning the presidential reference against the chief justice of Pakistan. It may be added that certain insinuation have been made in the said news items pointing towards some alleged misconduct committed by the four un-named senior judges of this Court.

2. Muhammad Saleh Zaafir, who is the reporter of the said news items, when confronted with the same, frankly and honestly conceded that he had made no effort to verify the veracity of the allegations levelled in the said news items before publishing the same nor did he have any proof in support of the contents thereof. He, however, added at the very outset that he had utmost regards and respect for not only the said hon’ble judges of this Court but for the entire judiciary; that he did not have even an iota of doubt about their integrity and character and that reporting the said news items was a grave mistake on his part.

3. He tendered verbal unconditional apologies in open Court and also placed on record his statement to the above noted effect, in writing.

4. The regrets offered by Muhammad Saleh Zaafir, reporter/editor, appear to be sincere and the remorse expressed by him appears to be genuine. In this view of the matter, we do not consider it necessary to proceed with the matter any further except warning him to be careful in future.

5. On our call, Muhammad Afzal Butt, president of the Rawalpindi-Islamabad Union of Journalists, also entered appearance for assistance.

6. The reporting of the proceedings which have taken place in Court in connection with the matter in question shall be made only to the extent that the apology tendered by the said Muhammad Saleh Zaafir shall be published in full and so would be published this order passed thereon. The daily ‘Jang’ and daily ‘The News’, which have published the news items in question, shall publish the apology and this order, prominently, on their front pages. Muhammad Saleh Zaafir undertakes to do the same and has been ordered accordingly.”

Meanwhile, the following is the text of unconditional apology tendered by Muhammad Saleh Zaafir before the Supreme Court on Tuesday.

“I, Muhammad Saleh Zaafir, do hereby tender an unconditional apology to the hon’ble court in relation to the contents of the story that appeared in daily The News/daily Jang on June 11, 2007.

“I have been directed by the hon’ble court to submit any proof in relations to the contents of the said items. I would humbly submit that I have no proof whatsoever in relation to the matter discussed in the said story.

“I keep this hon’ble court in the highest esteem and respect. I can never ever think of bringing about a bad name to the hon’ble court or to any learned judge of the hon’able court. I would submit that I can never think of committing contempt of this hon’ble court.

“I undertake to be careful in future and am ashamed for the publication of the story. I would humbly seek pardon in relation to the grievous lapse. “I pray to the hon’ble court that no further action may kindly be proceeded in relation to the matter. LAHORE: Iftikhar Ahmed, the host of Geo TV show ‘Jawabdeh’, resigned on Sunday after the channel administration refused to air an interview with former Pakistan Television managing director Shahid Masood. The interview was recorded last week and was being advertised in the group’s The News and Jang newspapers. On Sunday, the Geo TV administration seized the original recording and declined to run it. Guilty by Suspicion is against the Spirit of Islamic Law because when you raise finger then it’s the responsibility of those who allege to produce witness. Benefit of doubt is always given to those who is under trial.

The burden of proof is upon the plaintiff, and the oath is upon the one who is accused (Tirmidhi)

Therefore the ruler is forbidden from imposing a penalty on anyone, unless they perpetrate a crime which Shari’ah considers to be a crime, and the perpetration of the crime has been proven before a competent judge in a judiciary court, because the evidence could not be admissible unless it is established before a competent judge and in a judiciary court.

Watch in the video below, Abbas Ather reveals without naming that it was a newspaper (Jang Group’s (Geo TV’s) newspaper The News) which had first spread a false rumour about the denotification of the Supreme Court judges on 19 January 2010. Try to search that news item via Google. And lo and behold. There is actually a news story in The News on that date. But there is a small problem here. Why? The reason is simple. The Supreme Court has ordered an inquiry to investigate those who created and disseminated the rumour; the court has asked Geo TV / Jang Group to produce their record as a part of that inquiry. ISLAMABAD: There is no plan to withdraw the notification issued on March 17, 2009 for the restoration of deposed judges, including Chief Justice Iftikhar Muhammad Chaudhry, said an important minister. He was responding to a question of this correspondent about reports that the Pakistan People’s Party (PPP)-led coalition government was planning to technically knock out the judiciary in a ‘democratic way’.

But according to sources, the tug of war between the Pakistan People’s Party and the judicial echelon is not yet over. The PPP-led coalition government is planning to deal with the judiciary in a ‘democratic way’. The defiance strategy focuses on the use of constitutional means to make the judiciary toothless and powerless, said a highly reliable source.

However, the important minister who was initially reluctant to respond saying he was not the relevant person to talk on this issue, agreed to express his opinion after told that no other official was available. He said such reports were totally false and whatever steps the government would take would be in accordance with the law and Constitution. He said a propaganda campaign was being launched against the government to mislead the people. He said there may be such a proposal from any quarters, but the government had never committed violation of the Constitution. The government has not done anything which may offend the judiciary, he said, adding every proposal is thoroughly examined by the Presidency and the Prime Minister House and there is no chance that such a proposal can find any favourable response there.

But according to sources, President Asif Ali Zardari has made the PPP to use democracy and constitutionalism as its weapons to fight back. Initially, resilient Prime Minister Syed Yousuf Raza Gilani was also given a go-ahead signal on December 19, 2009 to make his allegiance to the president public after his meeting with Zardari. On the same day, the meeting of the PPP Central Executive Committee ended with a defiant mood. Heated speeches in the meeting considered SC decision “as part of a conspiracy”, informed sources said. The source also revealed that the appointment of Dr Babar Awan as law minister is part of the strategy to fight back judiciary with an executive push. Rescinding government notification and introducing a new ordinance protecting NAB beneficiaries are the options to be used by in coming days to put pressure on the Supreme Court.

Under the same procedural defiance strategy, another highly-placed source said the government intends to withdraw the notification of March 17, 2009 through which the deposed judges of the superior judiciary were restored to the November 2, 2007 position.

The source disclosed that by withdrawing the notification of March 17, 2009, the Presidency believes that the office of the chief justice will fall vacant, so neither any bench could be constituted nor could be any stay order issued until the appointment of a new chief justice.

On March 17, 2009, the Law Ministry had issued two separate notifications and Law Secretary Justice Agha Rafiq had read out the notifications in a press conference.

The first notification stated:

“Whereas the prime minister of Pakistan was pleased to announce on 16th day of March, 2009 that the deposed judges of the Supreme Court and high courts, including Mr Justice Iftikhar Muhammad Chaudhry, the deposed chief justice of Pakistan, shall be restored to the position they were holding immediately before 3rd day of November, 2007.

“Now therefore, the president of Pakistan is pleased to restore Mr Justice Iftikhar Muhammad Chaudhry, the deposed chief justice of Pakistan to the position he was holding immediately before 3rd day of November, 2007. Mr Justice Iftikhar Muhammad Chaudhry will assume office of chief justice of Pakistan on 22nd March, 2009, after retirement of Mr Justice Abdul Hameed Dogar, Chief Justice of Pakistan on 21st March, 2009.”

The second notification announced on same day stated:-

“The prime minister of Pakistan was pleased to announce on 16th day of March, 2009 that the deposed judges of the Supreme Court and High Courts, including Mr Justice Iftikhar Muhammad Chaudhry, the deposed Chief Justice of Pakistan, shall be restored to the position they were holding immediately before 3rd day of November, 2007:

“Supreme Court of Pakistan: 1. Mr Justice Javed Iqbal; 2. Mr Justice Khalil-ur-Rehman Ramday; 3. Mr Justice Raja Fayyaz Ahmed; 4. Mr Justice Ch Ijaz Ahmad.

“Lahore High Court: 1. Mr Justice Khawaja Muhammad Sharif; 2. Mr Justice Ijaz Ahmed Chaudhry; 3. Mr Justice Iqbal Hameed-ur-Rehman.

“High Court of Sindh: 1. Mr Justice Mushir Alam; 2. Mr Justice Maqbool Baqar. “Peshawar High Court: 1. Mr Justice Ejaz Afzal Khan.

“Now, therefore, the President of Pakistan is pleased to restore the above mentioned deposed judges of the Supreme Court and High Courts to the position they were holding immediately before 3rd day of November, 2007. These judges will assume their office with immediate effect.”

The source has confided that Law Ministry will be playing a pivotal role in the new strategy. Hence, it was important to replace Afzal Sindhu with Dr Babar Awan as law minister. The NAB beneficiaries in the government ganged together in ousting veteran PPP leader Afzal Sindhu. “Muhammad Afzal Sindhu, a veteran PPP leader having the distinction of being a member of the party’s Central Executive Committee during the days of late Zulfikar Ali Bhutto, is a respected lawyer and constitutional philosopher and was unlikely to agree to being part of this dirty game plan, hence he was sent to the Ministry of Railways last month,” the sources pointed out.

Secondly, under the same strategy the government will not take any step for reopening of cases in the Swiss court as was directed by the Supreme Court in its short order declared the infamous National Reconciliation Ordinance (NRO) void ab initio,” pointed out the source.

According to the source, had the government been serious in implementation of the Supreme Court, there was no need to wait for the detail judgment.

Thirdly, he said, the government has not appointed Justice (Retd) Khalilur Rehman Ramday as ad hoc judge of the Supreme Court as recommended by Chief Justice Iftikhar Muhammad Chaudhry. Advice of the chief justice was shelved by Law Ministry.

The recent spree of aggressive statements by Mr Zardari and PPP leadership is in a wake of being not sure about how army may react if SC throws ‘NAB beneficiaries’ out in a bid to make Pakistan corruption free and ensure that corruption is rooted out of society.

They are confident that their aggressive posture will make the military to refuse abiding by the Supreme Court order in case Article 190 of the Constitution is invoked by the Supreme Court of Pakistan, the source elaborated.

It may be recalled that Article 190 has so far been invoked only twice and on both the occasions, the military sided with the executive instead of abiding by the orders of the chief justice. He recalled that when Justice Sajjad Ali Shah had invoked Article 190 as chief judge, the-then chief of army staff Gen Jehangir Karamat had forwarded the court order to the Ministry of Defence for further process and hence the military defied the court order because Mian Muhammad Nawaz Sharif held the portfolio of the minister for defence at that time.

On the second occasion, a seven-member bench of the Supreme Court headed by Chief Justice Iftikhar Muhammad Chaudhry had ordered the state machinery including the corps and formation commanders of the Army on November 3, 2007 not to abide by any unconstitutional order of Gen Pervez Musharraf. But the Army defied the court order and a new Provisional Constitution Order (PCO) was issued by Musharraf, imposing martial law on the pretext of emergency, which was also described as emergency plus.

The source said that top advisers of the rulers are currently weighing all the available options but majority of them believes that there is no provision in the constitution for the restoration of a chief justice and the executive order through which the judges were restored could be withdrawn anytime.

It is, however, pertinent to recall here that the federal law secretary, while reading out the two notifications of March 17, 2009, had said as all the deposed judges were reinstated to the position of November 2, 2007, they were not required to take fresh oath. KARACHI: A spokesman for the Jang Group of newspapers on Friday expressed deep sorrow and regret over the release of a legal notice, said to have been issued by the authorities against the Group, a copy of which has not yet been officially delivered, but it has been made public on TV channels and media within the country and worldwide. The spokesman said the notice appeared to be part of a trend to gain cheap, free publicity and claim innocence without pursuing the case in any court of law. Previously also the authorities had resorted to the same tactics by issuing notices against the Group when reports filed among others by Kamran Khan, a senior journalist of the Group, which were never followed up with action. The spokesman said it was interesting to note that the government had not reacted to hundreds of reports and stories about the corruption, loot and plunder of the rulers to prove its innocence but it had taken up a matter of huge public interest to target the Jang Group, as part of its continued policy to inflict financial losses to the Group. It would have been a matter of satisfaction if such prompt notice had been taken against reports of loot and plunder. It was observed by the spokesman that the Jang Group has again been singled out while the same public interest story was already being widely circulated in the media worldwide, on websites and internet blogs and no one took any notice. It would be seen now whether only the Jang Group is targeted or others also are served with similar notices. What the Jang Group had done was to make an honest attempt to quash these widely circulating rumours and stories and had followed the strict principles of professional ethics by not only very prominently highlighting the denials issued by the spokesman of the President’s House and personal aide of the President Farahnaz Ispahani but had also approached the lady concerned, as it should be done in all such cases, by calling her and talking to her directly so that complete facts could come out once for all. It should also be noted that the headlines of the Jang Group stories focused on proving that these rumours and web-stories were incorrect. Two particular headlines read as follows: “Presidency rejects Zardari’s marriage reports” (The News, Feb 4, 2011) and “Dr Zamani denies wedding Zardari”, Says she never met the president (The News, Feb 5, 2011). These reports did not reproduce any of the material which was circulating on dozens of web sites including many specific details. The numerous videos and speeches of Dr Zamani, available on the U-Tube and Internet containing many emotional references to President Zardari and “Son” Bilawal were also not used in any of the stories. It is unfortunate that Dr Zamani, when contacted by Group Editor Mr Shaheen Sehbai, refused to deny or confirm the truth of the story. Her evasiveness gave rise to more questions as in such personal matters a simple no could have ended the matter there and then. That Dr Zamani was evasive even on the second day was confirmed when another senior journalist of the Jang Group, Mr Azim M Mian, who knows her personally, tried to contact her and get her viewpoint. She was again evasive and after a lot of persuasion, and later intervention by some Pakistani officials, she ultimately gave her version. It was also reproduced prominently in the Jang Group. KARACHI: A story filed by a news agency about purported WikiLeaks cables disclosing Indiaís involvement in Balochistan and Waziristan, carried by The News, Daily Jang and many other Pakistani newspapers, has been widely criticised as not being accurate. The prestigious British newspaper The Guardian described the report as “the first case of WikiLeaks being exploited for propaganda purposes”. The report said that US diplomats described senior Indian generals as vain, egotistical and genocidal, and that India’s government was secretly allied with Hindu fundamentalists. It also claimed that Indian spies were covertly supporting Islamist militants in the tribal belt and Balochistan. The story was released by the Islamabad-based Online news agency and was run by The News and Daily Jang with the confidence that it was a genuine report and must have been vetted before release. However, several inquiries suggest that this was not the case. When contacted, the owner of the agency, Mohsin Baig, and some of the editorial staff were themselves unclear about the source of the story and said they would investigate the matter at their end. Mohsin Baig said he had just returned from Turkey where he had accompanied the prime minister on his official visit and was therefore in the dark about how the story was released. He said he would talk to his editorial staff and get back to us. After a while, Onlineís news editor contacted us and told us he too was unaware about the source of the story and would check and get back to us as soon as possible. Despite repeated requests, he declined to contact the employee who had downloaded the news, and asked us to check with them the next day. On further inquiries, we learnt from our sources that the story was dubious and may have been planted. A check on the Internet as well as The Guardian report showed that the story was not based on Wikileaks cables, and had in fact originated from some local websites such as The Daily Mail and Rupee News known for their close connections with certain intelligence agencies. ISLAMABAD: RIUJ (Rawalpindi Islamabad Union of Journalists) has taken strong notice of, the fact that Mr. Ansar Abbasi has written a letter to Chief Minister Punjab, in which acting as a very honest person, has returned his plot allotted to him in Media Town, Rawalpindi as a member of Press Club. He was more than welcome if his intentions were good, but unfortunately he also asked CM Shahbaz Sharif to cancel all the plots given to members of Rwp/Islamabad Press Club. In his letter he said that journalists in Pakistan belong to privileged class, while in fact 98 % of Pakistani journalists deserve sympathy of people, as they are the most depressed class of the society. The journalists in Pakistan are getting the wages of 1996. In most of newspapers they don’t even get their salary even after three months; over 400 journalists were terminated without notice across the country from various newspapers and TV Channels. He never raised voice against this, though he remember to give safe side to media owners.

ISLAMABAD: The CJ of IHC (Islamabad High Court), Muhammad Bilal Khan has strongly refuted all allegations against himself regarding having any connections with notorious criminal Nannu Gawaria. In a letter dispatched to the SJC (Supreme Judicial Council), the CJ, IHC has taken notice of certain allegations leveled against his person by secretary SJC, on 28th March 2008, as made public through newspapers and videotapes, terming the move as an endeavor to malign his career and reputation, alongwith move against Supreme Judiciary. He has alleged that, since he was a member of the Lahore High Court Bench, which had declared Mian Nawaz Sharif as disqualified, his brother Mian Shahbaz Sharif had used derogatory remarks against him (Justice Bilal Khan) in public gatherings and TV channel interviews. Mian Nawaz Sharif had even gone to the extent of expressing his desire of " thrashing me (Justice Bilal Khan) in the Arabian Sea" he contended, adding that CPO Gujranwala Zulfiqar Cheema was bent on proving his die-hard loyalties to Mian Nawaz Sharif for the sake of his police career.

In his 16-point letter, the CJ, IHC has also accused journalist Ansar Abbassi of mud slinging and stern remarks against Supreme Judiciary, citing his earlier derogatory and highly inflammatory report against former CJ, Iftikhar Muhammad Chaudhry in 2007, which perpetuated the reference against CJ (Iftikhar Muhammad Chaudhry). Again it was Ansar Abbasi, who launched media campaign against the outgoing Chief Justice of Pakistan, Abdul Hameed Dogar, he added. He further said that it was yet again none else than Ansar Abbasi, who tried to malign Justice Sardar Muhammad Raza Khan, Justice Fakir Muhammad Khokhar, Justice Shakir Ullah Jan and Justice Tassadaq Hussain Jilani, accusing them of being involved in the so-called plot scandal. This accusation was false, and no action was taken against them. It may be recalled that when the appointment of Justice of Sardar Muhammad Raza Khan as Chief Justice of Pakistan was being talked about, Ansar Abbasi published a write up aimed at raising a controversy about the judge. He said that it is in the same vein that when his predecessor was due to superannuate on 8th of March 2009 and his (Bilal Khan’s) name was being considered as his successor, Ansar Abbasi’s devil instinct once again precipitated. "There is not even an iota of truth in what has been written by Ansar Abbasi, he said, adding that "the material provided to me is deficient in many ways i.e it does not indicate as to when was this person (Faiz Rasool alias Nannu Goraya) present in Dubai, and to which night club I had accompanied them and to which hotel I was taken for the "purpose".

He said that during his last visit to Dubai, his wife and daughter-in-law accompanied him and throughout they stayed together. "It is so interesting that Zulfiqar Cheema used his imagination regarding purchase of a diamond necklace for the marriage of my daughter, although she got married in January 2007 and by the grace of God was blessed with a son in December 2007. "Zulfiqar Cheema even went to the extent of illegally detaining father of Ashfaq Bajwa, who was in such adverse circumstances, approached through Syed Ali Mohsin Naqvi, SP (CIA) to make a statement regarding my alleged links with Nannu Goraya" he said. It was on account of this foreknowledge that the Chief Justice, Lahore High Court, did not deem it appropriate to take any further steps in the matter on the press clippings. It goes without saying that in the entire fake story was cooked up by Zulfiqar Cheema, and the only legal document in the field is the statement of Ashfaq Bajwa made before a Court of law, in the face of which penal action merits to be taken against Zulfiqar Cheema and other concerned police officials.

A bare look at the video footage, worthless as it is, leaves no room for doubt that it has been extracted under extreme pressure, influence and indubitably in a state of total disorientation. He said that the video footage is of no consequence as there is no mechanism to satisfy a judicial mind that the voice recorded is that of the so-called Nanu Goraya nor it is ascertainable that the person shown to have been making the statement was, in fact, the person named Nannu Goraya. A 13-member Bench of the Apex Court had expressed as recently as in the year 2007, it scorn, displeasure and disdain for such like material. The advocate-on-Record attempting to produce such material was not only reprimanded and burdened with fine of Rs. One lac but also had his license suspended. He said that Zulfiqar Cheema was a crafty Police officials, who had also failed to disclose the name of "Sitting MPA (PPP) from Gujranwala city who had allegedly laid information before him and had also withheld the names of the so called dozens of other well informed persons including some journalists. He said that he must state with conviction and faith as a Muslim that the allegations against him were totally false and intended to damage his personal reputation and standing as a judge. ISLAMABAD: Chief Justice of Islamabad High Court (IHC) Justice M Bilal Khan Monday submitted his reply to the Supreme Judicial Council (SJC) to the allegations levelled against his alleged links with the underworld mafia. In his eight-page reply, he confirmed that the SJC secretary had sent him press clippings along with audio and video CDs of the allegations levelled against him. He said the publications were false and a crude and abhorrent attempt to malign him and scandalise the superior judiciary at a time when he was being considered for appointment as IHC chief justice. He said the backdrop of events in which the publications came into being had to be kept in view, as he was the member of the Lahore High Court (LHC) bench which had disqualified Sharif brothers from electoral politics on June 23, 2008.


Just after the decision, he said, the Sharif brothers made speeches against him at public gatherings as well as on the television channels in which they maligned him. On different occasions, he said, Nawaz Sharif said that he would throw Justice Bilal in the ocean, whereas Shahbaz Sharif hurled abuses at him (Bilal) during his public meetings in Gujranwala and also in TV interviews.

He said Zulfiqar Cheema played the role of henchman of Sharif brothers who would go any length to please his bosses and as a reward he was given the coveted assignment of Regional Police Officer (RPO) and City Police Officer of Gujranwala simultaneously although he was not qualified to hold the office of RPO under Police Order 2002.

He said he was heading a full bench of the LHC on the issue of law and order situation, which had held that many police officers including Zulfiqar Cheema had been posted in the Punjab province to the positions for which they did not qualify.

He said the allegations levelled against him by Mr Cheema that he had links with underworld mafia and was protecting them were highly malicious and a bundle of lie. Justice Bilal also termed all the news published and screened by media against him as baseless and malicious.

The third in line, Justice Bilal said, is journalist Ansar Abbasi, who has always spat venom against the superior judiciary and got away with it. It seems he is thriving professionally on this modus operandi, he said and added that it was this Ansar Abbasi, who initiated the vilification campaign against the Chief Justice of Pakistan in 2007 and his utterances in the media ultimately metamorphosed into a scandalous reference and got away with it.

He further said that the audio CD provided to him comprising three telephonic conversations of Ansar abbasi, i.e. with the Chief Justice of the Lahore High Court and one with his wife is shocking to say the least.

“I am afraid that this journalist has the cheek to violate the privacy of the Chief Justice of LHC as also of his home”, Justice Bilal said, adding that this indeed is a flagrant violation of his basic and fundamental rights as enshrined in the Constitution and also against all canons of journalistic ethics and decency. “I cannot adequately condemn this atrocious act”, he said.

He said the audio CD has been sent to the Supreme Judicial Council under orders of the Chief Justice it is therefore for his lordship now to take cognisance of this violation for appropriate action.

He further said that allegations against him are totally false and intended to damage his personal reputation and standing as a Judge. “Speaking for myself, if these allegations had an air of truth, I would loath to hang on the office that I hold”, Justice Bilal concluded.

It is pertinent to mention here that Chief Justice Iftikhar Muhammad Chaudhry took notice on two stories, which appeared in The News on February 10 and 11, wherein it was revealed that a sitting senior judge of the Lahore High Court (LHC) had links with the underworld.

It was revealed that the LHC chief justice has been formally informed by the Punjab police of extremely serious allegations made in his recorded statement against the judge by a notorious wanted don, Faiz Rasool alias Nanno Goraya, who was killed in a police encounter on Jan 17, 2009.

His death was celebrated by the people of Gujranwala, who showered flowers on the police for eliminating a hardened criminal.

According to the news report Goraya carried head money of Rs2 million and was arrested a few days ago when the Shahbaz Sharif government sent special police teams to the Gulf and later to Malaysia to nab him in collaboration with Interpol. He was arrested in Malaysia and brought back to Pakistan and then recorded his statements in which he implicated the LHC judge.
