ISLAMABAD: Chief Justice Iftikhar Mohammad Chaudhry said on Saturday the oath of the armed forces called for true allegiance to Pakistan by upholding the Constitution and by keeping away from political activities. “I am persuaded to say this (because) during my talks with one or two very high-ranking officers, I discovered that they did not know the implications of the oath taken by the troops of Pakistan,” the chief justice observed in an address to a delegation of officers of the Command and Staff College, Quetta, at the Supreme Court building here. Last week, the chief justice had suggested to bureaucrats not to follow illegal orders by their superiors and instead abide by their conscience and the law. Noting at the outset of his speech the prime duty of the armed forces to defend the country against any external aggression or threat of war, the chief justice said that “the prime duty of defending the supremacy of the Constitution lies upon the Supreme Court”. Chaudhry Iftikhar named new CJ [Daily Dawn 2005] By Our Staff Reporter ISLAMABAD, May 7: President Pervez Musharraf on Saturday appointed Justice Iftikhar Mohammad Chaudhry, the senior most judge of the Supreme Court, as the next chief justice. He will assume the office on June 30 after retirement of the incumbent Chief Justice, Justice Nazim Hussain Siddiqui, on June 29. “The notification has ended speculations of appointment of a junior judge as chief justice in violation of the seniority principle settled under the 1996 Judges case,” commented a senior Supreme Court lawyer on condition of anonymity. Justice Chaudhry will reach the superannuation age of 65 years in 2012, which will make him one of the longest serving chief justices in the judicial history of Pakistan. He will serve as chief justice for over seven years. Earlier Justice A. R. Cornelius and Justice Mohammad Haleem served as chief justice for eight years from 1960 to 68 and 1981 to 89, respectively. Justice Chaudhry was elevated as a judge of the apex court on February 4, 2000. He has performed as acting chief justice from January 17 to 29, 2005. He holds the degree of LLB and started practice as an advocate in 1974. Later he was enrolled as an advocate of high court in 1976 and as an advocate of Supreme Court in 1985. In 1989, Justice Chaudhry was appointed as advocate-general of Balochistan and elevated to the post of additional judge in the Balochistan High Court in 1990. He also served as banking judge, judge of Special Court for Speedy Trials and Customs Appellate Courts as well as company judge. He served as the chief justice of the Balochistan High Court from April 22, 1999 to February 4, 2000. He was elected the president of the High Court Bar Association, Quetta, and twice a member of the Bar Council. He was appointed as the chairman of the Balochistan Local Council Election Authority in 1992 and for a second term in 1998. Justice Chaudhry also worked as the chairman of the Provincial Review Board for Balochistan and was appointed twice as the chairman of the Pakistan Red Crescent Society, Balochistan. Presently he is functioning as the chairman of the Enrolment Committee of the Pakistan Bar Council and Supreme Court Buildings Committee. ISLAMABAD, Feb 2: The government elevated five judges to the Supreme Court on Wednesday. According to a notification, the president has appointed Justice Rashid Aziz, Chief Justice, Lahore High Court; Justice Nazim Hussain Siddiqui, Chief Justice Sindh High Court; Justice Iftikhar Mohammad Chaudhry, Chief Justice, Balochistan High Court; Qazi Farooq, former chief justice of Peshawar High Court; and Justice Rana Bhagwan Das, judge, Sindh High Court, judges of the Supreme Court. After the elevation of Justice Rashid Aziz Khan to the SC, Justice Mohammad Allah Nawaz has been appointed Chief Justice of Lahore High Court. Justice Deedar Hussain Shah has been appointed Chief Justice of Sindh High Court and Justice Javed Iqbal Chief Justice of Balochistan High Court. After these appointments, the number of SC judges has risen to 12, leaving five posts vacant. With the appointment of these judges, the strength of the Supreme Court judges, i.e. 17, stands completed. LAHORE, June 27: The Lahore High Court summarily dismissed three writ petitions challenging the assumption of the President's office by Chief Executive Pervez Musharraf. The petitions were filed by Advocates MD Tahir, Amir Sohail and Hanif Tahir. The first-mentioned two argued at some length while the last-mentioned told Justice Khalilur Rahman Ramday, who heard the petitions, that he had reservations about him on account of his pro-government sympathies but would, instead of seeking transfer, leave the matter to his conscience. Advocate MD Tahir said frequent military interventions, prompted by politicians and invariably condoned and validated by the judiciary, have greatly damaged Pakistan in all spheres of life. Advocate Amir Sohail submitted that the Supreme Court recognized Gen Pervez Musharraf as chief executive for three years and his elevation to the office of President was repugnant to the SC judgment in Zafar Ali Shah's case. Under the judgment and the provisional constitution order validated by it the country is to be governed as nearly as possible in accordance with the provisions of the 1973 Constitution. Mr Rafiq Tarar could not have been removed except by impeachment. Justice Ramday observed that the 1973 Constitution was in existence by virtue of the PCO as amended from time to time and dismissed the three petitions. ISLAMABAD, Oct 30: The Supreme Court on Wednesday said it took oath under the PCO to preserve the judicial system, and due to its judgment in which it validated the military takeover the army was going back to barracks by restoring democracy. The apex court, responding to the statement of the Supreme Court Bar Association that arguing a case before the present judiciary was a futile exercise “as it had ceased to be independent,” observed that it reserved its right to take action against the president of SCBA, Hamid Khan, for his “disparaging remarks” about the independence of the judiciary. The SCBA had asked the SC bench on Monday to return its review petition as the bar was of the view that the judiciary, after taking oath under the PCO and by upholding various orders and acts of the present military regime, had ceased to be independent and no substantial question of constitutional importance should be argued before this court in its present composition.” The SC bench called the president of the SCBA, “Hamid Khan, contemner,” and said the SCBA statement was “motivated by malice, extraneous considerations and for political reasons.” In its five-page order, authored by Chief Justice Riaz Ahmad, the SC held that the contents of the application constituted gross contempt of court as it used disparaging remarks about the judiciary through the language which could not have been expected from the pen of the SCBA president. The SC asserted that democracy was being revived in the country and the regime would go back to barracks because of the SC judgment in Zafar Ali Shah case and the oath taken by judges of the SC (under PCO). “It is because of the judgment in Zafar Ali Shah case and oath taken by the judges of the Supreme Court that a time schedule was given and the regime had to hold elections and to go back to barracks after restoration of democratic institutions.”

The court said that in compliance with its judgments, elections were held in the country on Oct 10, 2002, and the process of transfer (of power) was in progress. The SC said that taking oath under the PCO by judges of the superior judiciary was welcomed by the senior lawyers like Khalid Anwar and SM Zafar. It said that those judges who had refused to take oath under the PCO did so according to their conscience and “heavy responsibility lay upon the judges who took oath (under PCO) for dispensation of justice.” The SC stated that its judgment, validating the military takeover, was universally acclaimed and had been described as a landmark judgment.

The court said it could proceed to take action against Hamid Khan, president of SCBA, but it was always appropriate to exercise restraint. “However, we reserve the right to take the proper action at an appropriate stage.” The SC said: “Unfortunately, some members of the Bar, motivated by malice, extraneous considerations and for political reasons or ill-will, make irresponsible statements to tarnish the image of the judiciary which is not at all in the supreme national interest.” The SC said it “strongly deprecate and condemn this attitude on the part of Hamid Khan and considering the contents of this application scandalous, malicious and irrelevant, we order that paragraph (I) and (II) therefore be struck off.” The SC said it had highest respect for those members of the bar, who have shown respect to the judiciary. By making such attempts the members of the bar were abusing the sacred elected office, it said. The court further observed that by taking oath under the PCO the judiciary had “saved the independence of (the) judiciary as well as the system of administration by preserving the Bar as well.” “Failing which the bar would have been replaced by all together a new system unknown to a civilised society.” It said that judges took oath under the PCO “in the highest national interest, and therefore we have deliberately not chosen to proceed against Hamid Khan in view of the interest of the institution, “but we reiterate that we reserved our right to proceed against Hamid Khan, contemner.”

The court observed that Hamid Khan knew that all the points which had been raised in the review petition had already been dealt with in the judgment, and the court would not allow re-hearing of the matter. The court said that knowing full well the consequences of the review petition, the counsel deliberately declined to argue the case “motivated by malice, ill-will and extraneous considerations.” The court said that review petition was fixed for hearing on Oct 28 when a request for adjournment was moved on behalf of Hamid Khan, expressing his inability to appear before the court on the said date due his unavoidable personal obligation and prior commitments. The bench assembled in the court to consider the aforesaid request for adjournment when, surprisingly, the court noticed the presence of Hamid Khan in the courtroom who came at the rostrum and submitted an application under the caption “Statement at the Bar”. The court said that it was high time that counsel like Hamid Khan and the members of the bar realised their responsibility towards the courts and the society. “If this state of affairs continues then God be with us and nothing more could be said about it. As a consequence of the above, this review petition has no merits and the same stands dismissed accordingly”, the court concluded. ISLAMABAD, March 1: The Chief Justice of Pakistan, Irshad Hasan Khan, on Wednesday observed that when the politicians are in power, they try to become dictators but when they are out of power, they become champions of the rule of law. Presiding over a 12-member bench seized of the seven petitions challenging the military takeover, the chief justice directed the attorney general to provide details of the expenditure on holding elections, including the expenses made by the candidates on their election campaigns. The Supreme Court announced that it would decide the issue of maintainability and merits of the case simultaneously. The chief justice said the court had entertained the petitions. The bench started regular hearing of the petitions on Wednesday. The court first took up the petition of Syed Zafar Ali Shah, suspended MNA of PML from Islamabad. The representative petition of PML would be taken next and Khalid Anwer would argue the case on behalf of the party.

Other petitions before the court are of Syed Imtiaz Hussain Bukhari, Challenging the PCO; Fazal Ellahi Siddiqui, challenging the PCO; Shahid Orakzai, seeking restoration of Senate, office of speakers and provincial assemblies; Al-Jehad Trust, seeking restoration of Constitution to the extent of judiciary; and Syed Iqbal Haider of MWM, seeking validation of PCO. The bench consisted of Justice Irshad Hasan Khan, Justice Mohammad Bashir Jehangiri, Justice Sheikh Ijaz Nisar, Justice Abdur Rehman Khan, Justice Sheikh Riaz Ahmad, Justice Chaudhry Mohammad Arif, Justice Munir A. The chief justice made it clear at the outset that the counsels should try to be relevant and unnecessary repetition of arguments should be avoided. He said the whole work of the court was suspended due to the present case.

Chaudhry Farooq, the counsel of Mr Shah, said that on the last hearing the petitioner had apprehended that the judges of the court would be asked to take fresh oath under the PCO and his apprehensions proved to be true. He said the PCO (1) of 1999 and subsequent orders were unconstitutional, having no force of law. The chief justice asked the parties to avoid mud-slinging, and added that: "we will perform our function without intimidation." He observed that the bar and the bench were integral part of the chariot of justice. He said his effort was to save the system and referred to the decisions of the Chief Justices Committee. The counsel said: "Pakistan was a gift of our forefathers, but unfortunately the rule of law had been interrupted at regular intervals. In its total life, Pakistan had suffered military rule for 30 long years".

He said the government in its reply to the petitions had said that the elections of Feb 3, 1997, were farce. The elections in which PML obtained heavy mandate were monitored by the observers across the globe, he said, and added the armed forces were employed to supervize the elections. On the court's query, Barrister Khalid Anwar stated that 36 per cent of voters used their right of franchise in the 1997 elections. Chaudhry Farooq said if the government of Khawaja Nazimuddin would not have been dismissed, the fate of Pakistan would have been different. He said Pakistan was created with the force of vote and not through any military operation. "Both citizens and soldiers are subject to Constitution alike."

Referring to Article 6 of the Constitution, he said abrogating the Constitution was treachery with the country. When he stated that the respondents had not replied to the Politicians in power try to be dictators: CJ challenge he raised in the petition, the chief justice observed that the counsel was trying to be hyper technical. The CJ made it clear to the counsel that notice of the case to the chief of the army staff was there. The counsel said he was firm believer that the Kafir (infidel) could not be a friend of Muslim and Hindus being Kafir could not be trusted. When the counsel referred to a judgment from the Indian jurisdiction, the court asked him not to cite Indian judgments in the present case. When the counsel started reading an old judgment from Pakistani jurisdiction, the chief justice asked the counsel to first read the speech of the chief executive in which he had spelt out the reasons which forced him to come into power. DUBAI, April 16: Former president and army chief Gen (retd) Pervez Musharraf has expressed his desire to sort out his differences with PML-N chief Mian Nawaz Sharif. “I would not mind if it happens for the good future of the country,” he said in reply to a question in an interview with DawnNews from Dubai. He said he had not phoned Mr Sharif to enquire about his health because his heart and mind did not allow him to do so in view of some statements by PML-N leaders. When asked about warrants issued against him by an anti-terrorism court of Rawalpindi, Gen (retd) Musharraf declined to comment on “these technical, legal questions”. He said he would definitely return to Pakistan and did not fear going to jail, but “I am waiting for the proper time”. In the afternoon, Mahmood was invited to CIA headquarters at Langley, Virginia, where he told George Tenet, the CIA director, that in his view Mullah Omar, the Taliban chief, was a religious man with humanitarian instincts and not a man of violence! This was a bit difficult for the CIA officials to digest and rightly so as the Taliban’s track record, especially in the realm of human rights, was no secret. General Mahmood was told politely but firmly that Mullah Omar and the Taliban would have to face US Military might if Osama Bin Laden along with other Al-Qaeda leaders were not handed over without delay. General Mahmood on September 13, 2001, was handed a formal list of the US demands by Mr. Armitage and was asked to convey these to Musharraf and was also duly informed, for the sake of emphasis, that these were “not negotiable.” Colin Powell, Richard Armitage, and the assisstant secretary of state, Christina Rocca, had drafted the list in the shape of a “non-paper”. It categorically asked Pakistan:

Stop Al-Qaeda operatives coming from Afghanistan to Pakistan, intercept arms shipments through Pakistan, and end ALL logistical support for Osama Bin Laden.

Give blanket overflight and landing rights to US aircraft.

Give the US access to Pakistani Naval and Air Bases and to the border areas betweeen Pakistan and Afghanistan.

Turn over all the intelligence and immigration information.


Condemn the September 11 attacks and curb all domestic expressions of support for terrorism.

Cut off all shipments of fuel to the Talibans, and stop Pakistani volunteers from going into Afghanistan to join the Taliban. Note that, should the evidence strongly implicate Osama Bin Laden and the Al-Qaeda Network in Afghanistan, and should the Taliban continue to harbour him and his accomplices, Pakistan will break diplomatic relations with the Taliban regime, end support for the Taliban, and assist the US in the aforementioned ways to destroy Osama and his network.

Mahmood then faxed the document to Musharraf. While the latter was going through it and in the process of weighing the pros and cons of each demand, his aide de camp that Colin Powell was on the line. Musharraf liked and respected Powell, and the conversation was not going to be a problem. He told him that he understood and appreciated the US position, but he would respond to the US demands after having discussed these with his associates. WASHINGTON : Richard Armitage, Daily Times can confirm, did not use the words attributed to him by President Pervez Musharraf in a CBS 60 Minutes interview, namely that unless Pakistan did American bidding, it will be bombed into the “stone age”. However, neither the President of Pakistan, nor Richard Armitage, who has denied using such language, nor President Bush who said he was “taken aback” when he learnt what had been said, is being untruthful. What actually happened was that after his meeting with Richard Armitage, Lt Gen Mahmood Ahmed – who now wears a long, white beard and has reportedly gone Tableeghi – called Gen Musharraf from the Pakistan embassy in Washington. The conversation took place in Urdu and when the president asked him what the bottom line of the American message was, Gen Mahmood replied in Urdu that the Americans were intent on the removal of the Taliban regime and would not let Pakistan stand in their way and if Pakistan did not fall in line and cooperate, “wo hamari eent se eent baja dey gain” or words to that effect. That being so, President Musharraf’s recollection of the conversation with Gen Mahmood, who was then the director general of the ISI, is accurate, only he translated into English what he had been told in Urdu. It is time for Gen Mahmood to go on record and reproduce exactly the words in which he conveyed the Armitage message to Gen Musharraf on that September day five years ago. khalid hasan. ISLAMABAD: Former ISI chief General Mehmood has simply vanished from the media which is trying hard to get his comments on the Musharraf-Armitage controversy over the wording of the post-9/11 threat hurled at Islamabad by Washington to win its unconditional support for the so-called war on terror. Mehmood, who has already retired from the Army, is settled in Lahore but despite repeated attempts since Saturday last he is not available to offer his comments on the issue on which his statement really matters a lot. Every time the former ISI chief was approached at his Lahore residence telephone number, the home servant-cum-operator, who identified himself as Banaras Khan, gave the ready response, ‘General Saab is out of the city, he will Inshallah call you upon his return.’ On Saturday afternoon when initially contacted, Banaras said Mehmood would be back by the evening. In reply to a question about a petition filed by former president Rafiq Tarar for withdrawal of Gen Musharraf’s titles of president and other posts, he said Mr Tarar was an “irrelevant person”. He disclosed that when he was in power he had good relations with Mr Tarar and had asked him to continue serving as president. Gen (retd) Musharraf said he had helped Mr Tarar and visited his home when he was president. “Mr Tarar, who was actually a man of Mian Nawaz Sharif and his father, had played a key role in purchasing the loyalties of judges when Justice Sajad Ali Shah was the chief justice of Pakistan.” In reply to a question about Chief Justice Iftikhar Mohammad Chaudhry, he said that if he (Justice Iftikhar) could not hear cases against him, he should refer them to other judges. Though intelligence cooperation between Pakistan and the US multiplied extensively after 9/11 and was aimed at the Taliban and al-Qaeda, many in Pakistan fear the network for these foreign agencies within Pakistan was also being used for other tasks, some probably falling into the definition of interference in our internal affairs.

Top authorities in Pakistan are said to be in knowledge of this phenomenal spread in the American spy agencies’ network as the country's intelligence agencies have already reported this matter and even identified a number of those on the payroll of the US agencies.

Besides others, a large number of retired Army officers, including ex-brigadiers, are presently working here as American spies. An official of an intelligence agency, however, explained that spy agencies of different countries had their worldwide networks and they handled spy matters according to their resources and needs because importance of spying had increased tremendously after 9/11.

Because of the alleged presence of al-Qaeda-Taliban in Pakistan, the interest of the foreign intelligence agencies here has gone up. The official added that the US had the largest intelligence network in the world and Pakistan was also benefiting from this because through this network the CIA and FBI shared intelligence with Pakistan and gave important information to nab terrorists.

Pakistan allowed concessions to the US as part of intelligence cooperation in the controversial war on terror but some official sources are of the view that these concessions and their parameters were not being adhered to within the agreed limits. Foreign Office spokesman Muhammad Sadiq, when contacted, said he had no information of this sort. He said intelligence cooperation between Islamabad and Washington was a fact but doubted that the local agents could be hired. He, however, said if there was any interference in our matters by any foreign spying agencies, it was illegal and not allowed. Sadiq said the ISPR would be in a better position to respond to such questions. Director General ISPR and military spokesman Major General Athar Abbas, when asked about the feared massive expansion of local CIA and FBI agents in Pakistan after 9/11, said, "I don't think so." He added that the government would never allow the CIA or FBI to expand their network in Pakistan. "I deny this," the military spokesman said. A defence source, however, recently told this correspondent it was a routine operation of all agencies around the world to recruit agents for espionage in every country. He said CIA and FBI did not need to come to Pakistan and start recruiting their local agents here because they could do the same while sitting in Washington. "These things are neither cut and dried nor done in black and white but this always happens and cannot be denied," the source said

Caretaker Interior Minister Lt Gen (retd) Hamid Nawaz, when approached said the US influence was not only in Pakistan but also in almost every other country. He acknowledged that there was a feeling that the network of US intelligence agents had spread here but he had no proof with him to substantiate this. He, however, admitted that the US influence was there in all areas. The retired general, who has also been secretary defence for some years and left the job much after 9/11, said there was a standard rule that no foreign intelligence agent could subvert against the state. Elizabeth Colton, the Press Attache of the US embassy in Islamabad, told this correspondent, in response to a set of questions sent to her, that the Embassy could not discuss intelligence issues with the media. She said the Embassy had no comment on the questions sent to her which included one asking whether the Embassy or its legal section had any role in recruiting Pakistanis for CIA and FBI.

The Embassy was also asked whether they shared the concerns of some Pakistani authorities that the US intelligence agencies, which were given some concessions in the tribal belt of Pakistan, were crossing their limits and hurting the strategic interests of Pakistan. US National Intelligence Director Mike McConnel was quoted to have admitted recently that the US administration had already spent $50 billion during the current year on spying. A considerable chunk of this budget for spying is believed to have been spent on the US war on terror. Part of this money would have also travelled to Pakistan to pay off the CIA/FBI local agents, who are said to be paid well. Parts of the US media have been reporting on this subject and the most significant report was in The Washington Post in 2002 when the influential newspaper claimed that the United States had organised its own espionage network in Pakistan due to lack of cooperation from the ISI in locating the al-Qaeda and Taliban fugitives.

"The FBI decided to set up a Spider Group, a band of former Pakistani Army officers and others, after it concluded that lack of cooperation from the ISI made it impossible to hunt down Taliban and al-Qaeda fugitives in the tribal areas of the country.” Quoting a federal law-enforcement official in Washington, the newspaper reported that the US move marked an attempt by the FBI to develop "free flow of information" to US agents who previously had worked under some restriction with Pakistan's official Inter-Services Intelligence agency. The Spider Group, the report said, was also asked to recruit locals in Pakistan's tribal areas, where hundreds of wanted "terrorists" are allegedly holed up under the patronage of tribal chiefs. Members of the Spider Group include a mix of Muslim and Christian retired Army and intelligence officers and have been trained and equipped by the FBI.

Background interviews reveal that today the CIA's intelligence local network is far more extensive than that of the FBI. The sources said that during the initial years of War on Terror, the Americans were not satisfied with the intelligence gathering of local agencies in the tribal areas of Pakistan, so they launched their own agencies that had now developed a vast network in the country.

A source quoted an incident in which the CIA officials once distributed awards amongst Pakistani intelligence people in the headquarters of the agency in Langley, Virginia. "This is perhaps unprecedented," the source said.

A spymaster of one of the country's intelligence agency reported to the Interior Ministry that a provincial head of a private security agency, besides others, was spying for the CIA. The security agency was contacted and the said official was removed. It was also reported that a large number of private security agencies personnel were doing espionage work.

A retired lieutenant general confided to this correspondent on condition of not being named that during his career he had gone to the US twice for military related training, where he was openly offered to work for the US. "I was praised and offered that why don't I join them," he said, adding that once an official encouraged him to inform the US about the problems of Pakistan's defence without even talking to his seniors.

He said the same intelligence officials asked him to settle his children in the US for better life and education. "I was openly told that I should not be worried about their expenses," the retired general said.

Meanwhile, a local journalist Azaz Syed told this correspondent that quite a few years back, he approached the legal section of the US embassy in Islamabad, after reading an advertisement in an international publication for recruitment of FBI agents for South Asia. For the purpose of doing an investigative story, he offered his services for FBI. He said he offered his services to spy on Taliban in exchange for information from the US embassy but the diplomat interviewing him was not interested in Taliban but wanted info about civil bureaucracy. He was not ready to give any information either.

"I was told that I would get assignments relating to civil bureaucracy and in return would be paid well," Syed said, adding that later he did a story for an Urdu newspaper with which he was associated at that point of time.

The US Unmanned Aerial Vehicles (UAVs) – the spy military plane – are yet another source of concern for many here. The UAVs were allowed to do espionage in tribal areas of Pakistan for "specific jobs" only but since the UAVs were not caught by radars, these spy planes crossed their limits a number of times.

Initially, the Pakistan Air Force objected to such US surveillance but the government decided otherwise because of US insistence that it was inevitable to track down the so-called al-Qaeda targets.

The sources revealed that the murdered top tribal leader resisting the US war on terror, Nek Muhammad, became the target of a UAV despite the peace deal he had signed with the then corps commander Lt Gen Safdar Hussain.

Getting uncomfortable with the UAV activities, some Pakistani officials have expressed their concerns at the highest level. The Pakistan Army is trying to develop its own UAV but so far these planes are not up to the required international standards. Pakistan has also been trying to buy these UAVs but some international forces are creating impediments in such deals. Once Pakistan contacted South Africa to purchase these small aircraft but the price demanded was $10 million, which was far higher than the price of the equipment. The UAV intelligence capacity and its advantage of not being traced by radars, some believe, could pose serious threats to Pakistan's strategic interests. Pervez Musharraf said he had appointed Senator Mushahid Hussain as secretary general of the PML-Q after consulting Chaudhry Shujaat Hussain. He said the PML-Q had virtually fallen apart and most of its leaders would not contest the next elections from its platform. Many of them had contacted him and some were considering contesting elections as independent candidates, he said. The former president admitted that setting up a new party without the help of government and intelligence agencies was a difficult job. He said he had written letters to the former nazims of all districts, inviting them to join his party and had received a good response. When asked if his handpicked army chief Ashfaq Parvez Kayani was in touch with him, he replied in the negative. KANDAHAR, Dec 31: The eight-day hijacking of an Indian airliner with 160 people on board came to a sudden end on New Year’s Eve after India bowed to demands to release three Kashmiri freedom Fighters. After five days of intense negotiations, the five hijackers gave up peacefully just after Indian Foreign Minister Jaswant Singh arrived in Kandahar with the three Mujahideen whose release had been demanded by the hijackers. Wearing masks and armed with pistols, the five hijackers descended from the Airbus A300, got into a van and were driven away from the airport. Shortly afterwards the passengers, trapped and blindfolded for long stretches inside the plane since Dec 24, began to emerge. The 160 passengers and crew were immediately driven in buses to two waiting Indian aircraft and flown to India. Those released included the widow of the only fatality during the hijacking – a newlywed Indian who was stabbed to death, apparently for peeking at the hijackers through his blindfold when the plane was seized on Christmas Eve en route from Kathmandu to New Delhi. The plane eventually landed in Kandahar, the Taliban headquarters, on Saturday after crisscrossing South Asia and the Gulf. “As a result of the negotiations with the Taliban and the hijackers, there has been an agreement for the release of all the hostages in exchange for three militants,” Indian National Security Advisor Brajesh Mishra told reporters in New Delhi. He identified the three Mujahideen as Maulana Masood Azhar, Mushtaq Zargar and Ahmad Umar Syed. One of the key issues in the negotiations had been the fate of the hijackers. But Singh scotched rumours they would be given political asylum by the Taliban in Afghanistan, saying they had just 10 hours to leave the country. It was not immediately clear what had happened to the three Kashmiris freed from Indian jails when they arrived in Afghanistan. Azhar, a charismatic scholar arrested in held Kashmir in 1994, was a senior leader of the Harkat-ul-Ansar, one of several hardline Muslim groups fighting Indian occupation forces in Kashmir. India has accused the Harkat of staging the hijacking. He released a letter written in June 1996 by former interior minister Gen (retd) Naseerullah Babar, to the Indian High Commissioner in Islamabad seeking Masood’s release on humanitarian grounds. External Affairs Minister Jaswant Singh today released transcripts of the conversations between Pakistani Army chief Gen Parvez Musharraf, who was in China, and Chief of General Staff Lt Gen Mohammed Aziz in Pakistan on May 26 and 29. "These two tapes and the transcripts have been authenticated through voice authentication and printing," the minister said. The conversations ranged on a wide variety of issues relating to the conflict -- from the downing of the Mi-17 helicopter on May 28 to the visit of Foreign Minister Sartaj Aziz to New Delhi tomorrow.

Gen Musharraf was told that the helicopter had fallen in Indian territory after being shot down.

Gen Musharraf: Has this Mi-17 not fallen in our area?

Lt Gen Aziz: No, sir. This has fallen in their area. We have not claimed it. We have got it claimed through the mujahideen. (May 29).

During the conversations, Gen Musharraf was apprised of every aspect of the developments by Lt Gen Aziz.

Following are excerpts from the conversations:

Gen Musharraf: What is the news on that side?

Lt Gen Aziz: There is no change in the ground situation. They have started rocketing and strafing. That has been upgraded a little. It had happened yesterday also and today. Today high-altitude bombing has been done... Our stand should be that all these bombs are falling on our side.

Gen Musharraf: That briefing to Mian Sahib (Nawaz Sharief) that we did, was the forum the same as where we had done previously? There at Jamshed's place.

Lt Gen Aziz: No. In Mian Sahib's office... Today for the last two hours the BBC has been continuously reporting on the air strikes by India. Keep using this -- let them keep dropping bombs. As far as internationalisation is concerned, this is the fastest this has happened. You may have seen in the press about UN Secretary General Kofi Annan's appeal that both countries should sit and talk.

Gen Musharraf: This is very good.

Lt Gen Aziz: Yes, this is very good.

The above conversation on May 26 also took note of the protests made by Indian officials to the Pakistani authorities about the support -- logistical and otherwise -- that Islamabad provided to the infiltrators holed up in Kargil and other areas, demanding its immediate withdrawal.

Gen Musharraf: Idea on LoC.

Lt Gen Aziz: Hint is that given that the LoC has many areas where the interpretation of either side is not what the other side believes. So comprehensive deliberation is required. So that can be worked out by DGMOs.

Gen Musharraf: If they [the Indians] are assured that we are here from a long period, we have been sitting here for long, like in the beginning, the matter is the same -- no post was attacked and no post was captured. The situation is that we are along our defensive Line of Control. If it is not in his [Foreign Minister Sartaj Aziz's] knowledge, then discuss it altogether. Emphasise that for years, we are here only. Yes, this point should be raised. We are sitting on the same LoC for a long period.

Lt Gen Aziz: This is their weakness. They are not agreed on the demarcation under UN's verification, whereas we are agreed. We want to exploit it.

Gen Musharraf: This is in Simla Agreement that we cannot go for UN intervention.

Lt Gen Aziz: Our neighbour does not accept their presence or UNMOGIP arrangement for survey of the area. So we can start from the top, from 9842 [NJ 9842]. On this line, we can give them logic but in short, the recommendation for Sartaj Aziz Saheb is that he should make no commitment in the first meeting on the military situation. And he should not even accept a ceasefire, because if there is a ceasefire, then vehicles will be moving [on Drass-Kargil highway]. In this regard they have to use their own argument that whatever is interfering with you, that we don't know, but there is no justification about tension on the LoC. No justification. We want to give them this type of brief so that he does not get into any specifics." Thus Kargil operation was launched with an ulterior motive to divide Pakistan’s political and military leaderships ! It is an unfortunate fact of history that Nawaz Sharif was mot aided by a good defence analyst team ! Those who were with him and supposedly considered defence experts were either in secret league with Nawaz’s handpicked military man or too naieve to understand the military intricacies of Kargil ! Kargil in the final analysis stands out as the meticulously planned conspiracy catalyst employed to trigger a chain of events that led to the primacy of the military junta on 12 October 1999 ! So far the Americans have succeeded ! The Pakistani Nuclear programme is in safe hands ! Pakistan , the beautiful woman in words of General Habibullah has sold herself to , not the highest bidder , but the only bidder at a relatively low price ! The military junta has divided the society ! Bought the pillars of state ! Balkanised the political parties ! Marginalised the society introducing unjust ethnic domination in the army , reduced the Sindhis into a political minority , pitched Punjab against Sindh by Machaievellian agreement to Thal Canal and is all set to strike a deal with India which would ensure that Pakistan’s military junta is given a permanent share in the political hierarchy simply because it is USA’s best and most reliable agent of change ! Kargil stands as perhaps the final military effort on Pakistans part to settle the Kashmir dispute by military means. Analysis has mostly centred around political aspects of the operation while the military aspects have been largely left to the imagination of the public.Lately it has been claimed that Kargil was launched to bail out Mujahideen as a last resort ! This is an insult to the memory of the Pakistani armed forces "Volunteers" who died in that Himalayan wasteland without a funeral and in circumstances of unimaginable misery !

Kargil operation cannot be understood unless the personalities and motives of the principal characters are examined ! Every action in history is the final culmination of a personality's self perception,ambition and subconscious as well as conscious urges.

In this context the Kargil operation was born out of two key factors ! One was the personality of general Pervez Musharraf and the second was the unceremonial manner in which Nawaz Sharif ousted General Jahangir Karamat Musharraf's predecessor army chief of Pakistan Army.

Musharraf as those who have served with him know which includes this scribe also has always been an intensely ambitious man ! One hallmark of his personality is that he wants to stand out as a great military commander ! Propelled by an enormous ego wherever he served he endeavoured to do something extraordinary ! However fate did not allow him the glory in battle which his other coursemates like shabbir sharif achieved ! In 1965 Musharraf was a subaltern in an artillery unit which saw little action apart from supporting operatiions by indirect fire ! The 16 SP unlike 3 SP which fired on Indian tanks with direct gunsights at Chawinda stayed in conventional artillery role ! In 1971 Musharrafs commando company was not involved in action ! Nevertheless Musharraf compensated for this lack of combat laurels by achieving laurels in army courses and in various command assignments ! His final opportunity came when he ascended to the post of army chief in a situation when the army was in a subservient position vis a vis the civilian head of state , something which was regarded by the military herarchy as worse than blasphemy ! The forced retirement of General Karamat by prime minister Nawaz Sharif was regarded as a personal defeat by the Pakistani military brass and by Musharraf who felt that he would be a far weaker army chief under a strong prime minister who had asserted civilian control over the military machine ! These two factors were the fathers of the Kargil operation ! Ambition accompanied by a perception that the Pakistani public must be convinced that the soldiers were better than politicians.

Kargil at the military level was the brainchild of three men i.e General Musharraf the army chief ,Aziz the then army Chief of general Staff and Mahmud the then corps commander 10 Corps ! Musharraf and Mahmud were motivated by intense ambition to achieve military glory and Aziz was motivated by his Kashmiri ancestry plus military ambition.The person they selected to execute the operation was again one distinguished by out of proportion ambition i.e Major General Javed Hassan , author of a book in 1990s that claimed that India was on its way to disintegration and in which mughal king Humayun was resurrected from the grave to fight at Second Battle of Panipat ! In November December 1998 just one month after Musharraf's elevation to the post of army chief volunteers were asked for at the army level for an operation in Kashmir ! Many thousand volunteered including both officers and men from various units ! At no stage did any Mujahideen enter Kargil ! This is a piece of fiction and has no veracity ! These were attached to NLI units in the 80 Brigade sector for training.The principal idea of the plan was to infiltrate four battalions of NLI (Northern light Infantry) stationed in 80 Brigade Sector into Kargil Heights overlooking and dominating the Srinagar Ladakh road the lone Indian link with the Siachen and Leh Sectors ! The idea being to cut the lifeline of Indian supplies to Leh and Siachen Sectors ! Indian held heights in Kargil were to be occupied in February 1999 while Indian infantry had abandoned these heights at the approach of winter snow as an annual routine since 1948.In occupying the heights no fighting was involved ! The real issue was that of supplying Pakistani troops holding these heights which was far more difficult from the Pakistani side than from the Indian side !

Plans were kept secret and even the Commander 10 Corps Engineers of was not allowed to enter the Operations Room in 10 Corps Pindi. The distance involved in reaching the heights varied from 15 to 35 kilometres from Pakistan side over mountains as high as 13 to 19,000 feet .To do this each battalion was divided into two parts , one acting as porters taking supplies forward and one half occupying the heights . The heights were occupied as per the plan but the four units while doing so were severly exhausted ! In March-April the Indians discovered the Pakistani presence and reacted severely ! Severe fighting continued till July once the Indians finally re-captured the heights after Pakistani troops had been left to the mercy of Indian artillery and overwhelming troop concentrations as a result of the Blair House Accord !

A brief military examination of the plan reveals following weaknesses.(1) Failure to assess strategic repercussions of the operation at geopolitic and national strategic level .(2) Logistic failure in incorrect appreciation of supplying the troops . (3) Failure to understand that by occupying the heights the Indians were driven into a corner and had no choice but to retaliate , not for glory as was the Pakistani military's case but for pure military survival . (4) At a more subtle level the use of the Chora-Batalik Sector as a future spring board for Pakistani operations against India was sealed since Indians heavily fortified this sector for any future war. The Pakistani planners failed to assess that war as an instrument of policy is no longer in vogue at the international level and their temporary military success would only bring greater international censure and a negative war mongering image without any corresponding military gain at the strategic level. This scribe interviewed a former commander of FCNA and 10 Corps about logistics and General Imtiaz Warraich replied as following :--

" We initiated this operation but failed to support it with comprehensive operational planning and above all buildup for essential logistic support without which no operation can succeed"......'" the principal reason for our heavy casualties and lack of progress was unimaginative and callous logistic operations to support the units".

At one point the sepoys who had volunteered to fight and had come from many other infantry units to the NLI units refused to act as porters carrying supplies over 15 kilometres and were so exasperated that they defied Javed Hassan's personal orders in unit durbars to carry supplies and when Javed Hassn threw his cap on the ground threatened to march over it unless they were not employed as porters ! One such volunteer told this scribe that we had volunteered to fight ,not to act as porters ! The same fact was also mentioned in ISI chief Ziauddin Butt's secret report to Nawaz Sharif prepared by an Engineer officer on Zia's staff in ISI ! The failure to assess the "Enemy" factor was another strategic planning failure at the highest level .I asked General Warraich this question and he stated " Capture of Kargil Heights would totally stop all Indian movement to Leh and Ladakh Sectors unlike Pakistan in Siachen and Indians had no option but to do and die " ! Lust for glory and honour in battle are perfectly reasonable aspirations as long as they are accompanied by commensurate military talent in the generals who are at the helm of affairs ! This was sadly lacking in the Musharraf team who planned the operation. Their egos were many times larger than their real military talent ! By promoting an intensely ambitious man to the rank of army chief Nawaz did a favour which could only be repaid by betrayal ! The plan was based not on sound military reasoning but on burning ambition and an unrealistic desire for glory by men far away from the heat of battle ! No one above major level died , yet in a report to the military secretarys branch Javed Hassan recommended retiring 75 % of officers involved in the operation below colonel level !

The prime minister was not fully briefed because of ulterior motives ! Had the operation succeeded it would have been projected as a proof of Musharraf's Napoleonic brilliance and if it failed as it did Nawaz Sharif would have been made the scapegoat ! The operations planners were distinguished neither by loftiness of thought,nor audacity in the conduct of battle athe operational or strategic level.Thus boldness at tactiacl level was sacrificed because of operational and tactical timidity at the highest level. No one appreciated that the army men who were employed , and it is a fiction that there was a single Mujahid in Kargil , had flesha nd blood ! These men mourned by a few hundred families were sons husbands fathers and brothers !

The Kargil operation at the military level is a watershed ! Idealism that propelled many hundred to die in those Himalayan wastes is buried for good ! Now there is a new breed which dominates the army ! The ones who aim at going on lush UN secondments or to KESC,WAPDA or as well paid consulatants ! What can one conclude ! It was the human heart that failed in Kargil and this heart which failed was housed in the ribcage of men sitting in the GHQ and not on the rocky pinnacles of Kargil ! Once the supply lines were closed under Indian threat of a counter attack , these brave men all Pakistan Army regulars were abandoned to die , pounded by artillery fire , bayoneted by overwhelming numbers , weakened by starvation ! Who can hear their cries ! Our ears are covered with heaps of lies ! Truth died at Kargil ! What remains is a body guard of lies! KHAAR, Nov 2: A second batch of about one thousand Tehrik-i-Nifaz-i-Shariat-i-Muhammadi activists crossed into Afghanistan to take part in Jihad. The first group of armed men had entered Afghanistan on Thursday. Riding pick-up trucks, the armed group crossed the Ghaki Pass border to enter the Kunar province around 12 noon. TNSM chief Maulana Sufi Muhammad who is in Afghanistan persuading the Taliban leadership to let his volunteers take part in fighting, has not returned. PESHAWAR, Nov 21: Tehrik Nifaz Shariat-i-Mohammadi (TNSM) chief, Maulana Sufi Mohammed, was imprisoned for three years under section 40 of the Frontier Crimes Regulations (FCR), governing the Federally Administered Tribal Areas (Fata) at Kurram Agency, according to official sources. The secretary of home and tribal affairs, Javed Iqbal, told Dawn that section 40 FCR had been applied to the TNSM chief by the court of political agent of Kurram Agency. “THIS IS NOT A CONVICTION,” the secretary said, adding that the PA court had the authority to release him any time. Maulana Sufi Mohammed and some 30 of his armed supporters were arrested by the political authorities of Kurram Agency in Fata, on Friday last on the charges of entering Pakistan without valid documents and possessing unlicensed weapons. The secretary said the PA court had the authority to release him if he the TNSM chief furnished an affidavit assuring good conduct in future. The TNSM chief and his supporters were sent to Dera Ismail Khan jail under tight security. Legal experts said under the law the detainees did not have the right to move higher courts. However, they could be released at any time or their imprisonment could be extended for another three years if the detainees failed to improve their behaviour. In October 2001, Sufi Mohammad after taking over parts of Swat, Dir and Korakoram Highway, led his 5000 strong army of Tehrik Nifaz Shariat-I-Mohammadi to attack the US forces operating in Afghanistan, with weapons ranging from world war 1 antiques to mortars used by modern day armies. The fact that most of these illiterate and misguided soldiers lost their lives to unfriendly daisy cutters, and Sufi, who had himself never seen either an American or an aeroplane, deserted the battle field, ran for his life, and ended up in a Pakistani jail, with a cosmetic three year sentence, perhaps for not possessing valid travel documents.

In December 2000, Maulana Akram Awan marching with his private army of ten thousand misguided zealots, camped at Chakwal, and threatened to capture Islamabad, the capital of Islamic Republic of Pakistan, if the laws considered Islamic in the medieval mind of Maulana were not promulgated throughout the country. The government was so unnerved that it sent a delegation consisting of the Home Secretary, Inspector General Police and the minister for religious affairs to please, pamper and compensate the Maulana and convince him to return with his army to where ever he came from. Having never met an official beyond the rank of SHO, the Moulana was so moved at the top officials of the nuclear state obsequiously falling to his feet, that he withdrew without a battle, and declared to come back next year to implement his promised mission.

For ten long years the JUI Madrassahs of Balochistan retained the dubious distinction of operating as the world’s largest nursery for producing teenage soldiers who had only two missions in life. To secure an entry into paradise by their rhythmic pendulum like reproduction of memorised portions from the Holy Book, and to participate in a global jihad with ignorance and Klashnikovs as their only two assets. In the last ten years any thing between 10 to 20 thousand of these innocent children were killed as fodder in the proxy war that ultimately reduced Afghanistan to rubble, and Pakistan to an embarrassing but much needed voltafaccia. Those responsible for this mass genocide however still wear royal robes and go around freely to restart if possible, from where they last left.

Till a few days back travelling between Lahore and Peshawar by road, one could see dozens of sign boards offering short cuts to paradise to those who sought recruitment in one of the many private armies operating under names such as Jaish-e- Mohammad, Lashkar-e-Tayuba or Harkat ul Majahideen. The proliferating religious fervour of these private armies has resulted in creation of downstream sectarian militant organisations whose strong sense of loyalty to their own brand of ideology requires killing of every one else who does not subscribe to their point of view. The ignorant Mullah has often joined this chorus of madness by condoning this barbarism from his unchallenged pulpit, and even suggesting that such acts could in fact guarantee the reservation of suitable seats in paradise. Karachi alone bore the sorrow and pain of hundreds of its outstanding citizens mercilessly killed by these sectarian fanatics. The brother of the interior minister is shot to death two days after the minister articulates his much belated intention of curbing the religious extremists. The private armies thus freely rule and till recently even collected “bhatta” (compulsory donations) in the land of the pure, making a mockery of the writ of the state. This phenomenon often generically referred to as “Talibanisation” of society remained unchecked till recently when its excessive export drew an angry response from the world at large as well as the already fed up neighbours.

Pakistan’s primary think tanks remain pathologically addicted to a frozen world view based on a dogmatic and bigoted understanding of religion, emphasis on rituals instead of spirit, hatred instead of tolerance, ideological slogans instead of service to people, state agencies instead of participative institutions, abhorrence to science and technology, deep disinclination to reason and rationality, obsession with female behaviour and dress, and the megalomaniac self image as the flag bearer and champion of the cause of Ummah, (not one of the Ummah countries offered even lip service of support at the time of India Pakistan stand off.) It is around this irrelevancy that the state has coined its signature for the past fifty years. While the large majority of Pakistanis are as moderate, tenacious, vibrant and enterprising as people of any other country, their rightful place amongst the developed and civilised nations of the world has been a hostage to the tribal traditions, private armies and religious fanatics who forcibly dictate the social order of the country. Only a week back the Orakzai tribes got together to declare photography as an offence punishable by demolition of the offenders’ house and a fine of one million rupees.

The events of nine-eleven in many ways provide a miraculous opportunity and impetus for Pakistan to re-evaluate its direction and make a conscious decision to make a departure from the past. It can choose to follow the path that has enabled other nations to pursue progress, prosperity and enlightenment. Alternately it can remain glued to its ancient and obsolete mindset, and gradually acquire the status of an irrelevant and failed state. Many would argue that it has already reached that point. A more factual assessment would be that while Pakistan does have the necessary capacity and desire to enter the 21st century, it is restrained by its own medieval mindset that is frozen in an imaginary past and not open to the reality and ideas of the modern times.

Any nation must first address issues that are vital to itself and its own citizens. For Pakistan these are issues of creating a just and civil governance mechanism, education, industry, addressing poverty, and providing host of basic amenities and services to its burgeoning population. For too long the voluntarily adopted culture of obscurantism has come in direct conflict with the scientific and rational methods that could be applied towards solving these issues. The bigoted clergy, the Lashkars, the Sipahs , the Jaishes the agencies and the increasingly bureaucratic and incompetent state machinery are either completely reluctant to change for better or desire a change in the reverse direction only.

The first step is to realise that there can possibly be no sanity, peace or progress in Pakistan, as long as it retains a multitude of fully loaded private armies, each in pursuit of its own brand of intolerance and bigotry. It is time for Pakistan to realise that the private armies representing the feudal and tribal thinking of the medieval times are simply not compatible with how the progressive modern nations pursue their interests and conduct their business in the 21st century. There can be no serious investment or development interest by any outsider (for that matter even insiders) in a writ-less state ruled by private armies eternally at war within and without. The first step towards peace and progress must therefore begin by firmly disbanding and disarming all militant religious, political and tribal organisations in Pakistan. This needs to be done as a national challenge and not like the lame, half hearted, incompetently managed and half way aborted earlier de-weaponisation campaign. It is also time to extend the rule law to areas and tribes that hitherto made their own laws. The days of private armies and the wild west must come to an end if a new beginning is to be contemplated. While this may also be a high profile international demand, it is essentially for its own good that Pakistan needs to clean up its militant backyard. It is only through creating a law abiding, pluralistic and tolerant society that Pakistan can hope for peace, progress and dignity in the years to come. Musharraf rewrote election rules to disqualify former Prime Ministers Mohammed Nawaz Sharif and Benazir Bhutto, and threatened to toss them in jail if they returned from abroad, which badly undermined both Nawaz Sharif's Pakistan Muslim League and Bhutto's Pakistan People's Party (PPP). Musharraf has plainly given the religious groups more free rein in the campaign than he has allowed the two big parties that were his main rivals. In Jhang city, in Punjab province, Maulana Azam Tariq, leader of an outlawed extremist group called Sipah-e-Sahaba, which has been linked to numerous sectarian killings, is being allowed to run as an independent�despite election laws that disqualify any candidate who has criminal charges pending, or even those who did not earn a college degree. "It makes no sense that Benazir can't run in the election," says one Islamabad-based diplomat, "and this nasty guy can."

Gen. Zia chose Gen. Musharraf (then a Brigadier) in 1987 to command a newly-raised Special Services Group (SSG) base at Khapalu in the Siachen area. To please Gen. Zia, Gen. Musharraf with his SSG commandos launched an attack on an Indian post at Bilfond La in September, 1987,and was beaten back. Despite this, he continued to enjoy the confidence of Zia.

Gen. Musharraf has since then spent seven years in two tenures with the SSG and prides himself on being an SSG commando and projects himself as the greatest expert of the Pakistan Army in mountain warfare. When he recently received Gen. Anthony Zinni, the Commanding Officer of the US Central Command, he was dressed as an SSG Commando. In May,1988, the Shias, who are in a majority in Gilgit, rose in revolt against the Sunni-dominated administration. Zia put an SSG group commanded by Gen. Musharraf in charge of suppressing the revolt. Gen. Musharraf transported a large number of Wahabi Pakhtoon tribesmen from the NWFP and Afghanistan, commanded by bin Laden, to Gilgit to teach the Shias a lesson. These tribesmen under bin Laden massacred hundreds of Shias. In its issue of May,1990, "Herald", the monthly journal of the "Dawn" group of publications of Karachi, wrote as follows: " In May,1988, low-intensity political rivalry and sectarian tension ignited into full-scale carnage as thousands of armed tribesmen from outside Gilgit district invaded Gilgit along the Karakoram Highway. Nobody stopped them. They destroyed crops and houses, lynched and burnt people to death in the villages around Gilgit town. The number of dead and injured was put in the hundreds. But numbers alone tell nothing of the savagery of the invading hordes and the chilling impact it has left on these peaceful valleys." Gen. Musharraf started a policy of bringing in Punjabis and Pakhtoons from outside and settling them down in Gilgit and Baltistan in order to reduce the Kashmiri Shias to a minority in their traditional land and this is continuing till today. The "Friday Times" of October 15-21, 1992, quoted Mr. Muhammad Yahya Shah, a local Shia leader, as saying: " We were ruled by the Whites during the British days. We are now being ruled by the Browns from the plains. The rapid settling-in of Punjabis and Pakhtoons from outside, particularly the trading classes, has created a sense of acute insecurity among the local Shias." Zia became the first victim of the carnage unleashed by Gen. Musharraf on the Shias of Gilgit. Though the Pakistani authorities have not released the report of the committee, which enquired into the crash of Zia's plane in August,1988, it is widely believed in Pakistan that a Shia airman from Gilgit, wanting to take revenge for the May,1988, carnage, was responsible for the crash. In 1988, there was a violent uprising of the Shias in Gilgit, which was ruthlessly suppressed by Musharraf, who was given the task of dealing with the revolt by Zia-ul-Haq. Musharraf had a large number of Sunni Pashtun tribesmen from the Federally-Administered Tribal Areas (FATA) led by Osama bin Laden brought into Gilgit. They carried out a massacre of the Shias in the NA as well as the adjoining NWFP areas. It is believed by many in Pakistan that the crash of the aircraft in which Zia was travelling from Bahawalpur in August 1988 resulting in his death was caused by a Shia airman from Gilgit sympathetic to the TJP in retaliation for this massacre. To keep the Shias of Gilgit under control, Musharraf encouraged the the SSP, which had come into existence in the Punjab in the early 1980s at the instance of the Inter-Services Intelligence (ISI), to extend its activities amongst the Sunni population of Gilgit and to politically organise them against the the TJP. Since then, there have frequently been clashes between the TJP and the SSP followers in Gilgit, the latest outbreak of such violent incidents having taken place in June, 2001, before Musharraf's visit to India for the summit talks with Mr.A.B.Vajpayee, the Indian Prime Minister. Army officer in Islamabad assaulted Dawn reporter Faraz Hashmi after their cars bumped on the road. The police refused to register a case on Hashmi's request and the attack, which left him injured, came just days after he put an uncomfortable question to President Pervez Musharraf in a press conference, which visibly infuriated the president.

On 25 May 2007 the DAWN NEWS CHANNEL's test transmission was commenced and guess what the opening ceremony was addressed by Generalissimo Generalissimus Il Presidente Mr Parvez Musharraf. Whereas the so-called Beacon of the Press Freedom i.e. Pakistan Herald Publication Limited or to be precise Daily Dawn [DATED 25 MAY 2007] says:
