MQM, Nawaz Sharif and Perpetual Confusion

May 12, 2013 - Updated 01  Altaf greets ‘Punjabi representative party’ on its big win: LONDON: Congratulating Pakistan Muslim League-N on its big win, Muttahida Qaumi Movement (MQM) Chief Altaf Hussain called the Nawaz Shairf-led party which has so far bagged maximum number of seats in the center as ‘Punjabis representative party’. “Muslilm League-N has emerged victorious in elections 2013 and Nawaz Sharif as a representative of leader of the Punjabis,” Altaf Hussain said in his derogatory statement following PML-N’s winning big in the Punjab in today’s general elections. He did not stop there, saying Nawaz Sharif appears to have stood by his philosophy and slogan he chanted twenty years back ‘Jaag Punjabi Jaag, Teri Pag Noon Lag Gaya Dagh’. “Today he got the fruit of this slogan,” he added. Altaf Hussain said he extends hearty congratulations to the people of Punjab and hoped ‘as the leader of the biggest province of the country Nawaz Sharif will also treat the non-Punjabi people of the remaining three provinces with equality, justice and honesty’ with a view to promote brotherhood among people. Nawaz Sharif on MQM and MQM on Nawaz Sharif

Nawaz Sharif on MQM and MQM on Nawaz Sharif by SalimJanMazari

2009 PML-N rejects MQM criticism -- ISLAMABAD The Pakistan Muslim League-N has rejected the criticism by Muttahida Qaumi Movement`s chief Altaf Hussain against Nawaz Sharif, saying it is an attempt to deflect people`s attention from investigations into the happenings of May 12, 2007, in Karachi. In a rejoinder issued on Monday, PML-N`s Secretary Information Ahsan Iqbal said that the army had launched an unauthorised crackdown against the MQM in 1992, without taking the government into confidence. “General Asif Nawaz gave the go-ahead for the military operation without any political consultation.” Mr Iqbal said the then prime minister Nawaz Sharif had no role in the military operation because he was out of the country. He said Gen Asif Nawaz had not been given mandate to launch the operation. He asked the MQM leadership to explain why it allied itself with the PML-N government in 1997 if it believed that Mr Sharif was responsible for the crackdown. Refering to the re-launching of the operation in 1994, Mr Iqbal urged MQM to ask the then interior minister Naseerullah Babar of the Pakistan People`s Party about it. He said the MQM should tell the nation why it had allied itself with the PPP government if it considered the operation in 1994 was unjustified. He said despite consistently criticising the army in the past, Mr Hussain and his party collaborated with Gen Pervez Musharraf for the sake of power. Commenting on Altaf Hussains request to the Army for destroying the record against MQM, he said why had MQM not done so when his party (the MQM) was a partner in power during the Musharraf regime. Mr Iqbal said the focus of PML-N`s politics was the nation`s demand for Gen (retd) Musharraf`s trial and scrapping the 17th Amendment. He criticised the PPP for deviating from the Charter of Democracy after Ms Bhutto`s assassination and continuing the policies pursued by the Musharraf regime. 2007: MQM murdered Hakim Said, claims Nawaz LONDON: Former prime minister Nawaz Sharif on Friday claimed that as the prime minister he knew that the Muttahida Qaumi Movement (MQM) had murdered Hakim Muhammad Said in Karachi on October 17, 1998. Talking to newspersons at the PML-N office here, he also alleged that Federal Minister Babur Ghauri was now secretly playing the role of a "messenger" between President Gen Pervez Musharraf and Altaf Hussain. He also claimed that Prime Minister Shaukat Aziz would soon ditch President Musharraf and join the opposition parties.Nawaz alleged that Musharraf and Altaf were busy hatching a conspiracy against Pakistan and their collaboration might harm the country. He said that he had made it clear to the MQM leaders, who were part of the coalition government then, either to surrender those who had murdered Hakim Said or quit the Sindh government. "After the refusal of the MQM to surrender the killers, I preferred to sacrifice the provincial government of Liaqat Jatoi instead of making compromises with those who had killed an honourable man like Hakim Said," he said. Nawaz said the MQM leaders were playing a dangerous game by collaborating with Gen Musharraf. "Being the twice elected prime minister of Pakistan, I have some understanding of politics, and my political intuition tells me that Altaf and Musharraf are working to harm the country's interests," he said. Nawaz said, on May 10, while addressing a press conference, he had warned that if the MQM was not stopped from holding a rally in Karachi on the arrival of the chief justice, many innocent people might be killed. He regretted that his timely warning was not heeded to. Nawaz disclosed that even certain elements had tried to warn Gen Musharraf about the likely bloodshed in Karachi if the MQM was not stopped from holding the rally. But, he claimed that instead of giving a serious thought to that logical advice from the intelligence quarters, Musharraf got furious and told them to leave the room. Nawaz said that these words gave a clear idea that Musharraf and Altaf had planned the massacre in Karachi. Nawaz also backed the movement of Imran Khan against Altaf and said his own hard-hitting stance on the MQM was known to everybody. He said that he was against the MQM since it murdered Hakim Said. MQM vs PML-N - 2

MQM vs PML-N - 2 by SalimJanMazari

2009 MQM shifts blame for 1992 operation from military to Nawaz . LAHORE: The much trumpeted 1992 operation clean-up in Sindh had actually been launched against the backdrop of the infamous ‘Major Kaleem kidnapping case’, when a serving Army major was abducted and tortured, allegedly by a group of activists belonging to the Muttahida Qaumi Movement (which was then known as the Muhajir Qaumi Movement). While the MQM leadership has recently blamed former prime minister Nawaz Sharif for the 1992 operation and asked him to apologise for the atrocities committed during his tenure, it remains a fact that the MQM high command had held at that time the military leadership responsible for the action, saying it actually wanted to avenge the honour of Major Kaleemuddin. As a matter of fact, Major Kaleemuddin of the Field Investigation Unit (FIU) of the Army had been tasked to restore peace in the trouble-stricken Landhi area of Karachi. He was abducted on June 20, 1991, along with a few subordinates, while in civvies ñ the night when the MQM-Haqiqi led by Afaq Ahmed made an abortive attempt to take over Landhi offices of the Altaf-led MQM, called Muhajir Khel. This led to a bloody gun battle between the two MQM factions, killing many from both sides. However, the Haqiqi group was forced to flee after the Altaf group unleashed all its fire power in the gun battle. A few hours after the abortive attempt by the Haqiqi group, Major Kaleemuddin was abducted from the Landhi area by armed activists of the MQM, who allegedly took him to a torture cell and subjected him to ‘mistreatment’. The Major Kaleemuddin kidnapping case is still described by many in the establishment as the bedrock of the subsequent military operations carried out against the MQM under the Sharif and the Bhutto governments. Altaf Hussain and several other MQM leaders and workers were subsequently accused of being involved in the kidnapping episode and named in the FIR registered on June 24, 1991. Altaf left Pakistan in December 1992. But there are different versions of what exactly happened to Major Kaleemuddin. Some of the MQM leaders had claimed after the incident that the abductors were under the impression that MQM-Haqiqi leaders ñ Afaq Ahmed and Amir Khan - had returned to the port city at the behest of the agencies and that the major was present in Landhi to supervise the establishment-sponsored operation against them. During the court trial, many of the accused had claimed that since the major was in plain clothes, he was mistaken by them for a Haqiqi activist and subsequently roughed up. But as soon he had revealed his identity, the major was allowed to go. However, according to the prosecution, Major Kaleemuddin, along with three other Army officers, was patrolling the Landhi area in an Army jeep when 20 armed youths took them hostage after seizing their weapons. The Army men were taken to a place called Muhajir Khel in Landhi where they were allegedly tortured and kept for seven hours and rescued when the police reached the place. The accused charged with kidnapping the Army officers and torturing them included Altaf Hussain, Saleem Shahzad, Dr Imran Farooq, Safdar Baqri, Nadeem Ayubi, Ayub Shah, Aftab Ahmed, Ismail alias Sitara, Ashraf Zaidi, Sajid Azad, Ashfaq Chief, Javed Kazmi, Haji Jalal Asghar Chacha, Rehan Zaidi and Mohammad Yousuf. Whatever the truth might be, the then-Army high command’s keen interest in the prosecution of the accused gave an impression as if the traditional martial pride of the Khakis - that nobody gets away with bashing up an Army officer ñ was at work. Gen Asif Nawaz had been the Corps Commander Karachi at that time who got promoted as the Army Chief in August 1991, right before the start of the military operation. A special court for suppression of terrorist activities (STA), led by Justice Rafiq Awan, began hearing of the Kaleemuddin kidnapping case in March 1993 and delivered judgment on June 9, 1994. The court had convicted Ashfaq Chief, Javed Kazmi and Haji Jalal and sentenced them to 30 years of rigorous imprisonment, besides imposing a fine of Rs 20,000 each under the Pakistan Penal Code, the Hudood Ordinance. All other accused, including Altaf Hussain, were declared absconders and sentenced to 27 years jail and a fine of Rs 30,000 each in absentia. Almost three years later, following the 1997 general elections and the subsequent decision by Altaf Hussain to join hands with Prime Minister Nawaz Sharif, all the convicted MQM leaders and activists challenged afresh their conviction and sentences before the Sindh High Court. Their appeal was heard by a division bench, which found the case as one ‘of almost no legal evidence’. Relying on the provisions of the Suppression of Terrorist Activities Act, 1976, the bench upheld on trial in absentia as well as the right of the absentee accused to file an appeal. Dealing with evidence, the bench observed that the eyewitnesses’ account did not inspire confidence and the evidence of the complainant was, in particular, full of contradictions. The bench, comprising Justice Nizam Hussain Siddiqui and Justice Abdul Hameed, noted that it is difficult to believe, a group of 15 or 20 boys could disarm four trained soldiers. Therefore, all the accused were acquitted and three convicts serving their term were ordered to be released immediately. But it is interesting to point out that after AQ Halepota, one of the counsels for the MQM leaders, concluded his arguments before the court, the then-advocate-general Sindh Shaukat Zuberi submitted that numerous omissions and contradictions had been made during the trial of Major Kaleemuddin’s kidnapping and torture case and that he would not support the convictions of the accused by the STA court. The verdict came hardly a week after the then-prime minister Nawaz Sharif had travelled to London to meet Altaf Hussain. To recall, the MQM and the PML-N had been coalition partners at that time, before finally falling apart following the assassination of Hakim Mohammad Saeed in Karachi. Major Kaleemuddin had subsequently challenged the acquittal of the MQM leaders and activists by the Sindh High Court. But the petition was dismissed as withdrawn by the apex court on August 13, 2007, mainly due to non-prosecution, as neither the petitioner nor his counsel had turned up. MQM vs PML-N - 3 by SalimJanMazari

2007 Text of London APC declaration : On May 12, 2007, at Karachi, an engineered massacre of opposition workers was orchestrated, unarmed political workers were at the mercy of gun-toting Muttahida Qaumi Movement (MQM) workers while the police and rangers watched. The Sindh High Court was laid siege and judges had to run to save themselves. The district courts were surrounded by MQM activists and lawyers including women were beaten. While the federal and provincial regimes watched 48 innocent people lost their lives and over 200 were injured; yet General Musharraf says there is no need for an inquiry.

13) The APC holds General Musharraf, the Sindh governor and the provincial government, and the MQM responsible for the carnage carried out in Karachi on May 12, 2007, and demands an independent judicial enquiry by a judge of the Supreme Court to ascertain and identify the persons involved.

14) The APC condemns recent acts of terrorism in UK. It further resolves to write a joint memorandum to the UK government for initiating necessary legal proceedings against MQM chief Altaf Hussain for his alleged role in incidents of terrorism in Pakistan.

LONDON: All the heads of political parties, which took part in the all parties conference in London, would jointly write a letter to the UK government to take legal action against the MQM chief Altaf Hussain for his alleged involvement in terrorism in Pakistan. The APC also resolved that no party would enter into any political alliance with the MQM in future at Islamabad or in Sindh to form the government. Calling the MQM a terrorist party, they said that the MQM should be “barred” from the political system of the country. The APC participants also condemned all kinds of terrorism on the UK soil and also demanded of the British government to take legal action against its citizen (Altaf) who, they said, was involved in violence and terrorism in Pakistan. Earlier, Imran Khan, Qazi Hussain Ahmed, Maulana Fazlur Rehman, Mehmood Khan Achakzai, Asfandyar Wali and others leaders made hard-hitting speeches against the MQM. MQM Leader Altaf Hussain with Mubasher Lucman - 2 (Point Blank Express News 2009)

MQM Leader Altaf Hussain with Mubasher Lucman... by SalimJanMazari

LONDON: The all parties conference (APC) here on Sunday decided to resist “through all means”, including resignations from the assemblies, the re-election of Gen Pervez Musharraf from the current parliament. However, the Pakistan People’s Party delegation led by Makhdoom Amin Fahim said that their party would decide about the resignations when the time for it approached. The APC, attended by 37 opposition parties, also decided that in future no political party in Pakistan would enter into any political alliance with the Muttahida Qaumi Movement (MQM) to form government, as it was “a terrorist party that believes in violence”. The APC pledged to ensure return of Nawaz Sharif, Benazir Bhutto and other exiled leaders, except Altaf Hussain, to Pakistan and resist any attempt on the part of the regime to prevent or arrest the leaders on their return. It also demanded that Gen Musharraf should resign and pave way for free and fair elections under a neutral government. It also demanded restoration of chief justice of Pakistan. The APC held Gen Pervez Musharraf, Sindh Governor Dr Ishratul Ebad, Chief Minister Arbab Ghulam Rahim, and the MQM responsible for the killings in Karachi on May 12 and resolved to move the Supreme Court of Pakistan against the massacre. The APC also demanded release of Javed Hashmi, Akhtar Mengal, Afaq Khan, Amir Khan of Mohajir Qaumi Movement and others. Opposition leader in the National Assembly Maulana Fazlur Rehman announced amid deafening slogans and desk thumping that the MMA would resign from the National Assembly and provincial assemblies of the NWFP and Balochistan to block the re-election of Musharraf from the current parliament. Nawaz Sharif Formula, New Provinces & Ethnic Hatred.

LAHORE: The PML-N has approved in principle the formation of new provinces on administrative basis, however any division based on ethnic and racial basis would not be accepted. PML-N sources told Geo News reporter Irfan Nazeer that the special committee formed by PML-N President Nawaz Sharif held three meetings in the last five days. The recommendations of the committee will be sent to Islamabad for Nawaz Sharif’s approval next week. The committee has also advised that any formation based on ethnic and racial basis would cause trouble between the provinces and that is why a package should be presented for the formation of new provinces. The opposition has called for a meeting in the National Assembly on 11th August to present the resolution of the division of Punjab, whereas the President and Prime Minister have also hinted to the formation of a Seraiki province by 14th August. Shahbaz attends US I-Day celebrations Published: July 02, 2010 Shahbaz attends US I-Day celebrations (THE NATION) LAHORE - Punjab Chief Minister Muhammad Shahbaz Sharif Thursday attended a function in connection with the 234th Independence Day of the United States at the residence of American Consul General Carmella Conroy and cut a cake. Speaker Punjab Assembly Rana Muhammad Iqbal, provincial ministers, MNAs and MPAs, and a large number of people representing different walks of life were also present on the occasion, says a press release. Addressing the function, Shahbaz said the Independence Day was of great significance for any country as it promoted awareness about the history and achievements. Congratulating the American nation on the day on behalf of government and the people of Punjab, he said Americans could rightly feel proud of the fact that their country stood as the sole super power of the world and a global leader in every sense. He said Pakistan was facing a heavy loss of human lives and damage to property in the war against terrorism, adding that poverty, ignorance and deprivations bread terrorism. Shahbaz said Punjab offered excellent opportunities for economic cooperation and investment, and the provincial government looked forward to building stronger links with the United States in various sectors. The host, Carmella Conroy, also spoke on the occasion.

Pakistan Social Contract had taken a hike when Sharif Brothers raised a very detrimental slogan "Jag Punjabi Jag" against the "Federation of Pakistan"

His Excellency should know (from reports filed by the US Consulate’s Political Officer at Lahore, surely) of the Punjab Government’s open revolt against the Federation, led by the Establishment’s then blue-eyed son, Nawaz Sharif, the Chief Minister of Punjab no less. As part of which mutiny Punjab government funds were used to foment rebellion against the “Sindhi Prime Minister” by printing and distributing flyers and buttons and bumper stickers and banners exhorting the Punjabis to wake-up. ‘Jag Punjabi Jag’ was the chilling slogan. MQM in 1999 on Punjab.

KARACHI: The Muttahida Qaumi Movement’s parliamentary party leader, Dr Farooq Sattar, has claimed that various officials of Lahore Development Authority (LDA) are being deputed in Karachi Metropolitan Corporation (KMC) “under a planned conspiracy to make Karachi a colony of the Punjab.” In a statement issued on Thursday, he said that “the MQM will never allow Karachi to become a colony of Punjab despite all odds and hurdles.” He claimed that just after the imposition of Governor’s rule in Sindh, various officials of Punjab were being deputed to different organisations like KDA and KMC, “which is not hidden from anyone.” “This indicates that the only aim of the government is to impose Punjab’s policy as it wants to capture Karachi instead of restoring peace in the city,” he added. Recalling the Hakim Said murder case, Altaf Hussain said that Nawaz Sharif, former IGP Rana Maqbool, and DIG Farooq Amin implicated Muttahida activists in the case. He said that despite all-out efforts made by the family of Amirullah, justice was not done and Amirullah and other Muttahida activists were awarded death sentence in that case. He further said that innocent Fasih Jugnoo and an innocent travel agent Mubashir were Extra-judicially murdered while in police custody in connection with the Hakim Said murder case investigation. The Muttahida chief asked the party leaders and lawyers to prepare cases in respect of all atrocities carried out against the party workers and supporters and leave no stone unturned in this connection. Altaf Hussain also urged the European countries and members of Commonwealth to keep in view the misdeeds of the Sharif government while monitoring the prevailing political situation of Pakistan. Meanwhile, the Muttahida MNAs, while commenting on the disclosure of transferring most secret information to enemies by Nawaz Sharif, have said that the people of the country have now come to believe as to who was the real and greatest traitor of Pakistan, who betrayed the defense of the country.

They said that today the people of the country and the whole world at large have now come to know the real face of Nawaz Sharif who claimed himself as patriot. The deposed prime minister, by disclosing the most secret and classified defense information to the enemies, had endangered the entire defense system of the country, they added. The IG of Sindh, Asad Ashraf Malik, who took charge of his office on Wednesday, confirmed the arrest and said that Rana Maqbool himself surrendered before the police on Thursday. The IG police also confirmed that the DSP and SHO Airport, Mehboob Khan and Zafar Cheema, respectively, were also arrested on Thursday. He said the police had been conducting raids to arrest Rana Maqbool since Tuesday. On Thursday around 6pm, Mr Malik said, Rana Maqbool himself made a telephonic contact with him and said that he could produce himself only before him.  Mr Malik said that he invited him to a place other than his office and arranged Mr Rana's meeting with his (Rana's) wife before he handed him over to the "concerned authorities". Mr Malik said that he made it clear to Mr Rana that he was required to clarify his position vis-a-vis his presence at the airport on the eve of army chief's arrival there on Tuesday. However, mystery shrouds the events that preceded the arrest of Rana Maqbool as there had been reports which said that Rana Maqbool, who was supervising the action being undertaken by the police of Karachi and Sukkur divisions at Karachi and Nawabshah airports to arrest army chief Gen Pervaiz Musharraf on his arrival from Colombo. He was taken to an unknown place by the army soon after he was arrested.

There were also reports that he was later handed over to the rangers.

DIG Karachi Akbar Arain, who was at the airport with IG Rana Maqbool, has already been detained besides DIG Crime Faruq Amin Qureshi, DIG Sukkur Akhtar Memon and SP Nawabshah Gondal. FIA OFFICE: The office of a senior official of Federal Investigation Agency, Chaudhry Sharif, was raided and record wastaken into custody by the troops. The ISPR expressed ignorance about the raid, but FIA sources said that the record was seized and Chaudhry Sharif, assistant director, had gone into hiding.

Meanwhile, around two dozen workers of Pakistan Muslim League (N) were arrested by police at Regal Chowk when they attempted to stage a demonstration against the dismissal of Nawaz Sharif government. The PML workers, out-numbered by the personnel of police and other agencies, were picked up by police soon after they reached the busy shopping centre in Saddar. The sacked Karachi Metropolitan Corporation administrator Mushahidullah was among those arrested by the police. A handout issued by the SSP South said that the local police arrested 22 workers, including five women, and a case has been registered against them at Preedy police station for violating Section 144 CrPC. "As the lanes were narrow and congested, the officials decided that the operation to arrest the accused would be carried out with the help of female cops. Thus two teams of police, one comprising female cops and headed by an inspector, and the second one comprising male policemen participated in the operation." The SSP said the first team comprising Shamim, Saira and an inspector, in veils, reached the spot and warned the terrorists to surrender. The terrorists fired at them but the second police team returned the fire. The exchange of fire resulted in the instant death of Kamran alias Tanky, he added. The SSP claimed that Kamran was a notorious criminal and was wanted in more than 33 cases, including 15 cases of killings. He said police hunt for the other accomplice of the dead terrorist was on.

Meanwhile, the Mohajir Qaumi Movement has strongly protested over the killing of Mohammad Kamran and alleged the rulers of giving the "imported police" license to kill. The government, in order to establish its rule forcefully, has employed illicit tactics, the statement alleged. Mystery of the coded message Daily DAWN, Karachi

KARACHI, Nov 7: The agencies investigating the case of Hakim Said have either found no convincing or tangible evidence so far to be able to assume that the Karachi-based MPA who received a coded message soon after the murder of Hakim Said had a direct or indirect link with the plan, or, for reasons known to them alone, they have decided not to work in that direction. Inquiries have shown that the man who had received, within half an hour of the murder, a coded pager message which, according to experts, was self-explanatory, has not been targeted at any stage of the inquiry so far. This, according to observers, gives rise to doubts about the credibility of the investigations made by various agencies so far.

The pager did not belong to MPA Zulfikar Haider, who was named by the prime minister in his press briefing and later in the FIR as the key figure in the Hakim Said case, inquiries showed. Consequently, the name of the MPA (who received the pager message) was not mentioned in the FIR registered against MPA Zulfikar Haider and six others, including Aamirullah, who is in the police custody.

The coded message was deciphered by experts following the recovery of some papers from the 12-seater Mazda used in the killing of Hakim Said which was later found abandoned at Eleandor Road. Well-placed sources, who declined to identify the MPA and the party he belongs to, only said that "the MPA who received the coded message was not Zulfikar Haider". It is being asked why the law enforcement agencies and investigation teams did not work in that direction when the agencies knew about the coded message. These sources said the papers recovered from the abandoned vehicle included one bearing the number of a pager, which is in possession of an MPA hailing from Karachi. That was the only coded message received on that pager that day, the sources said. http://www.karachipage.com/nawaz_f.htm

KARACHI, Nov 4: The government produced Shaikh Mohammad Aamirullah, accused in the murder of Hakim Mohammad Said, before the High Court of Sindh as directed on a habeas corpus petition filed by his mother. The mother and son met for the first time in the office of the additional registrar with the permission of the bench which heard the petition. The accused, according to the advocate general M. Iqbal Raad, has not so far given his confessional statement which is required to be given before a magistrate under Section 164 CrPC. He has only confessed to having had a part in the murder before the police and notables, the bench comprising Chief Justice Kamal Mansur Alam and Justice M. Roshan Essani was informed.

The hearing of the habeas corpus petition was taken up on top of the lists of cases fixed for the day and lasted for about 30 minutes. Sardar M. Ishaque and Qazi Khalid Ali, an MPA, appeared for the petitioner, Akhtari Begum, wife of Shaikh Mohammad Attaullah, resident of A-66/1, A-Area 'B' Road, Liaquatabad, Karachi Central, who had challenged the arrest and detention of Aamirullah.

The petition cited the home secretary, the inspector general of police, and SHO (Anti-burglary), Liaquatabad as respondents. Qazi Khalid, a former minister in the coalition government in Sindh, submitted before a packed courtroom that there were contradictory versions of Aamir's "confessional statement" given by the prime minister and the advocate general. He said the prime minister had been on record as having told a countrywide audience that Aamirullah had confessed to murdering Hakim Said, but the AG, Mr Raad, maintained that no confessional statement had been recorded and that the accused had only confessed to involvement before the police and notables.

Qazi Khalid requested the court to summon the prime minister to ascertain which of the two was telling the truth. He then observed that the prime minister has misled the nation on the television network by claiming that Aamirullah had confessed to the whole thing, thus maligning the MQM in the eyes of the public throughout the country through print and electronic media. He said making statements before the police was one thing and confessing before a magistrate on oath another.

The court, making its observation, said the defence could raise this point before the trial court, and that the present proceedings concerned the habeas corpus petition. The bench ordered the medical superintendent of Civil Hospital Karachi to examine the detenu from Thursday and submit his report within 10 days. The court also directed the police to allow the mother, her counsel Sardar Ishaque to visit the CIA Centre where the detenu had been lodged since his arrest on Oct 22.

Qazi Khalid submitted that the detenu had been tortured so much that he was unable to walk. He pointed out that Aamir was supposed to have been produced on television the other day but at the last moment the programme was cancelled. He also said if the prime minister's reference to Aamir's so-called confessional statement were true and if his statements had been recorded under sections 164 and 364 CrPC, the accused should have been remanded to judicial custody under the mandatory provisions of Criminal Procedure Code. He further said Aamirullah had not been arrested in Hakim Said's murder so far and under the law if he was being made an approver, even then he should be made an accused first and approver later. Therefore, the counsel argued, his detention was without lawful authority and to give the cover of legality to his arrest he had been falsely implicated in other cases in which remands had been given by the magistrates.

In his para-wise comments on the petition, the advocate general submitted that the detenu was arrested on the night of Oct 21 under section 54 CrPC by the SHO of Liaquatabad police station and, during the course of interrogation, he had named 12 crimes in which he had been involved. He said Aamir was an absconder in those cases and had been nominated in two cases of Liaquatabad police station. The AG said the detenu had admitted his involvement in the murder of Hakim Said and had himself led the police to seize unlicensed weapons - a kalashnikov and 103 live rounds- from his house in 'A' area Sindhi Hotel, Liaquatabad. He was arrested in the case No 339/95 under section 13-E, Arms Ordinance and case No 643/95 under section 302, 324 Qisas and Diyat Ordinance, 34 PPC of Liaquatabad police.

The AG maintained that Aamir had been legally arrested and was under lawful custody of the police by virtue of the remand granted up to Nov 2 by the judicial magistrate. He also denied allegations of maltreatment and torture. The AG's statement also included details of 16 cases against Aamirullah and in two of them his name has been mentioned in the FIR. He was arrested by Gulbahar police in a murder case and challaned in absentia in 13 other cases. FASIH CASE: On a petition filed against the death in custody of Fasih Ahmed 'Jugno' filed by his mother, Mumtaz Begum, the government has filed comments in which it has been stated that a judicial inquiry has been ordered to be conducted by the district magistrate of the Central district. But, he said, the petitioners were not coming forward to record their evidence and were filing petitions.

The government's statement said in order to determine the specific cause of Fasih's death, the petitioners should join the right forum and if there were any grievances after the inquiry report had been submitted, they could file petitions. The petition filed by Syed Qasim Raza against the arrest and detention of his son, Dr Asim Raza, a medical officer at Abbasi Shaheed Hospital, has been withdrawn because the detenu has been released and admitted to a hospital for treatment of his injuries sustained in police custody. The government, has, however, denied having arrested him. In another petition, filed by Hajira Begum, challenging the arrest of her sons, Arshad Safaraz and Mansur, the government has admitted that they were arrested. In another petition filed by Shahnaz Begum, comments have been filed denying the arrest of Syed Mujib, Mohammad Adnan, Mohammad Salman and Mohammad Kamran. In yet another petition filed by Mohammad Jamil, the government has admitted the arrest of his son, Babar Jamali, on specific charges on Oct 27. The court has fixed the next date of hearing on Nov 18. REFERENCE: Aamirullah made no confessional statement: Advocate General Daily DAWN, Karachi http://www.karachipage.com/nawaz_f.htm

To add insult to injury, the government promotes and awards police officers who are involved in the brutal operations of picking up people and killing them on the streets in fake police encounters, party spokesman stated.
