A K Hangal, Bal Thackeray & Syed Talat Hussain.

Jingoism: Jingoism is extreme patriotism in the form of aggressive foreign policy.[1] In practice, it is a country's advocation of the use of threats or actual force against other countries in order to safeguard what it perceives as its national interests. Colloquially, it refers to excessive bias in judging one's own country as superior to others – an extreme type of nationalism. The term originated in Britain, expressing a pugnacious attitude towards Russia in the 1870s. "Jingoism" did not enter the American vernacular until near the end of the 19th century. This nationalistic belligerence was intensified by the sinking of the battleship USS Maine in Havana harbour that led to the Spanish-American War of 1898. Wikipedia http://en.wikipedia.org/wiki/Jingoism

Fascism: is a radical authoritarian nationalist political ideology. Fascists seek elevation of their nation based on commitment to an organic national community where its individuals are united together as one people in national identity. They are united by suprapersonal connections of ancestry and culture through a totalitarian state that seeks the mass mobilization of a nation through discipline, indoctrination, physical training, and eugenics. Fascism seeks to eradicate perceived foreign influences that are deemed to be causing degeneration of the nation or of not fitting into the national culture. Fascism was founded during World War I by Italian national syndicalists who combined left-wing and right-wing political views. Fascists have commonly opposed having a firm association with any section of the left-right spectrum, considering it inadequate to describe their beliefs, though fascism's goal to promote the rule of people deemed innately superior while seeking to purge society of people deemed innately inferior is identified as a prominent far-right theme. Artists, Intellectuals, Scholars, Authors are universal, they have no boundaries, they are watched, read, quoted, and consulted respectively without any passport and immigration but Talat Hussain (a property of Hameed Haroon and Amber Saigol and Dawn News) think otherwise recently when Giant Pakistani Artist Mehdi Hasan passed away people of India expressed deep sorrow and grief without bothering about Partition, his nationality, colour, religion, passport, or any other divide and duly honoured Great Mehdi Hasan with Respect and Good words, Talat Hussain, Hameed Haroon and Amber Saigol's Alleged Honour was sleeping somewhere when Indians were praising Mehdi Hasan but suddenly "The Sick Patriotism" comes alive in Talat Hussain, Hameed Haroon, Amber Saigol and Dawn News when Pakistanis reciprocated the same honour to a recently departed Indian Artist Rajesh Khanna. Talat Hussain and Dawn News vomited venom in an already venomous atmosphere without bothering about the fact that Mehdi Hasan was born on that side of Border which is now India (in Rajasthan) and Rajesh Khanna had his roots in Burewala, Punjab, Pakistan A K Hangal born in Sialkot (Punjab) and now both sides are two different countries courtesy alleged Founding Fathers and Alleged Freedom Fighters of now Both sides. By the way A K Hangal lived early part of his life in Sialkot, Peshawar, and Karachi. Now Talat Hussain and no good Hameed Haroon and Dawn News should start Tabbarra on Sialkot, Peshawar, and Karachi. Tribute to Rajesh Khanna (1942 to 2012) Part - 1 http://amughal.blogspot.com/2012/08/tribute-to-rajesh-khanna-1942-to-2012.html Tribute to Rajesh Khanna (1942 to 2012) Part - 2 http://amughal.blogspot.com/2012/08/tribute-to-rajesh-khanna-1942-to-2012_15.html Tribute to Ghazal Maestro Mehdi Hasan by Alauddin Khanzada & Asif Noorani. http://chagataikhan.blogspot.com/2010/12/tribute-to-ghazal-maestro-mehdi-hasan.html Tribute to Ghazal Maestro Mehdi Hasan by Alauddin Khanzada & Asif Noorani http://amughal.blogspot.com/2010/12/tribute-to-ghazal-maestro-mehdi-hasan.html

Down Memory Lane With A K Hangal

http://www.youtube.com/watch?v=a9nNwjdGbsg

A K Hangal with Comrade Sobho Gianchandani Honouring Sajjad Zaheer: NEW DELHI: India’s distinguished movie actor and communist ideologue A.K. Hangal died in a Mumbai hospital on Sunday following a brief illness, Press Trust of India said. It said his son Vijay Hangal, a retired still cameraman in Bollywood, appealed for help after failing to meet Hangal’s medical expenses. Several Bollywood celebrities like the Bachchans, producer-director Vipul Shah, and actors Mithun Chakraborty, Aamir Khan and Salman Khan came forward to help him. The 95-year-old character actor and veteran of the fabled progressive cultural troupe, the Indian Peoples’ Theatre Association (IPTA), passed away at 9am at the Asha Parekh Hospital in suburban Santacruz in Mumbai, where he was admitted on Aug 16 after fracturing his thigh bone. Best known for his one-liner from blockbuster Sholay — Itna sannaata kyun hai bhai (why so much silence is there), Hangal entered Bombay cinema when he was in his 40s and went on to act in over 200 films. He endeared himself to the audience by playing the role of the lovable old man in films like Sholay, Shaukeen and Namak Haram, “This is really a sad thing…now I am left all alone. I have no words to describe his loss,” Vijay Hangal told PTI. “He was a strong man…he has been a great support to me,” he said. Avtaar Veenit Kishan Hangal was born in a Kashmiri Pandit family in Sialkot and came to the city of dreams — then known as Bombay — at the age of 21. PT said he made an impressive mark as the old man who gets up and joins the troupe in the song Ghanan Ghanan, where he sang one line Kale Megha Kale Megha Pani To Barsao in Aamir Khan-starrer Lagaan. The actor was honoured with the Padma Bhushan for his contribution to Hindi cinema in 2006, was in the news last year for living a life in penury. Recently, he returned to face the studio lights after several years for TV series Madhubala, PTI said. AK Hangal dies at 97, bigwigs skip funeral : Not a single big name from the film industry turned up for the cremation of veteran character actor A K Hangal on Sunday. The 97-year-old, a veteran of over 225 films, passed away early in the morning at Asha Parekh hospital in Vile Parle following a brief illness aggravated by a fracture of his thigh bone. Only character actors like Rakesh Bedi and Raza Murad and friends like Ila Arun were present for the last rites. But that didn't really matter to a man who had dedicated his life to theatre, cinema and social issues. Some theatre enthusiasts posted comments on social networking sites. One of these said that another acting academy had shut down. Hangal was one of the most endearing old men of the film industry with roles in Sholay, Namak Haram and Shaukeen. His one-liner from Sholay, 'Itna sannata kyon hain bhai', achieved cult status.

Sholay's Rahim Chacha had to depend on Bollywood for aid to fight illness. But the actor, who swore by leftist philosophy, believed that the state needs to accept the responsibilities of senior citizens. His son Vijay said, "My father was highly spirited and fought till the end. He survived even after life support was taken off." He added, "He even shot a small scene for the TV serial Madhubala despite his poor health. The moment the camera was switched on, his energy came back.'' Fashion designer Riyaz Gangji, who would visit the actor almost every day, said, "When I asked him if he wanted life support back, he said no.'' Hangal had walked the ramp for the designer last year. Murad said, "The actors would've come if a political party summoned them. But they didn't have an hour to spare to pay their last respects to the man who gave 50 years to the industry and worked with all top stars.'' Hangal started his film career rather late. The actor, who participated in the freedom movement, started off as a tailor. He got associated with actors like Balraj Sahni, Sardar Jafri and Kaifi Azmi, who persuaded him to act. He entered the film industry at the age of 50 with Basu Bhattacharya's Teesri Kasam.

Though new to the industry, he was not afraid to express his anger over Raj Kapoor walking onto the set late. Hangal was very vocal about his political views. He had faced a ban on his film career after the Shiv Sena objected to his attending a function organized by the Pakistan consulate in Mumbai in the 1990s. A Communist Party of India member, Hangal continued to renew his membership every year. Hangal acted in over 225 films in his film career spanning over four decades. He played the roles of a father, uncle or housekeeper to many a big star, including Jaya Bachchan, Sanjeev Kumar, Rajesh Khanna and Amitabh Bachchan. He had cut down on acting for 10 years, but did small roles in Aamir Khan's Lagaan and Shah Rukh Khan's Paheli. The actor's financial condition became an issue with his health falling and his son Vijay having to stop work to look after his father. After reports about Hangal's poor financial condition, the information and broadcasting ministry announced a plan for health insurance of retired actors which has not yet materialized. Vijay said, "The industry's aid did help us pull through all his medical needs. Though film industry bigwigs were not there, his friends from IPTA and character actors attended the cremation. We are planning a condolence meeting at Prithvi Theatre at 4pm on Monday.'' AK Hangal: Bal Thackeray once called him a traitor  Hangal was drawn to Indian People's Theatre Association (IPTA) in India. He started working with Balraj Sahni and Kaifi Azmi in IPTA. In his late 40s, Hangal was offered the part of Raj Kapoor's brother in 1966 film "Teesri Kasam" by director Basu Bhattacharya but his scenes were removed from the film. There was no looking back for him after that. He starred in over 200 films. His mostly played roles of father, uncle, grandfather or that of a meek and harassed old man, an image he could never get rid off. The veteran actor suffered a political backlash in 1993 when he applied for visa to visit his birthplace in Pakistan. He was invited and attended the Pakistan day celebrations by the consulate in Mumbai thereby incurring the wrath of the Shiv Sena. Shiv Sena Supremo Bal Thackeray took offence and called him a traitor. A call to boycott his films was made, his effigies were burnt and his scenes were deleted from films. He bounced back after two years with character roles in Amitabh Bachchan's home production "Tere Mere Sapne" and Aamir Khan's "Lagaan". He last shot for Shah Rukh Khan starrer "Paheli" in 2005.

He was awarded Padma Bhushan for his contribution to Hindi cinema in 2006.

The actor was in news last year for living a life in penury. His son Vijay, a retired still cameraman in Bollywood, appealed for help after failing to meet Hangal's medical expenses. Several Bollywood celebrities like the Bachchans, producer-director Vipul Shah, and actors Mithun Chakraborty, Aamir Khan and Salman Khan came forward to help him. He returned to face the studio lights again recently after a gap of seven years for TV show 'Madhubala'. Having reached the sets on wheelchair, Hangal was not sure if he would be able to handle it physically. But he came in his elements once the cameras started rolling. He has a 74-year-old son Vijay with late wife Manorama. Rental Journalists of Pakistan.

Take no side, tell all sides: As Reuters journalists, we never identify with any side in an issue, a conflict or a dispute. Our text and visual stories need to reflect all sides, not just one. This leads to better journalism because it requires us to stop at each stage of newsgathering and ask ourselves "What do I know?" and "What do I need to know?" In reporting a takeover bid, for example, it should be obvious that the target company must be given an opportunity to state their position. Similarly in a political dispute or military conflict, there are always at least two sides to consider and we risk being perceived as biased if we fail to give adequate space to the various parties. This objectivity does not always come down to giving equal space to all sides. The perpetrator of an atrocity or the leader of a fringe political group arguably warrants less space than the victims or mainstream political parties. We must, however, always strive to be scrupulously fair and balanced. Allegations should not be portrayed as fact; charges should not be conveyed as a sign of guilt. We have a duty of fairness to give the subjects of such stories the opportunity to put their side. We must also be on guard against bias in our choice of words. Words like "claimed" or "according to" can suggest we doubt what is being said. Words like "fears" or "hopes" might suggest we are taking sides. Verbs like rebut or refute (which means to disprove) or like fail (as in failed to comment) can imply an editorial judgment and are best avoided. Thinking about language can only improve our writing and our journalism. REFERENCE: Reuters Handbook of Journalism http://handbook.reuters.com/extensions/docs/pdf/handbookofjournalism.pdf

Ali Aftab Saeed: Journalist, columnist, director/producer, actor, documentary maker; Ali Aftab Saeed is one multi-talented individual. His experience in main stream media production and journalism goes back 7 years. Apart from all these, Saeed also has a knack for writing witty lyrical compositions. This, paired with his passion for singing was what gave birth to the much acclaimed band Beyghairat Brigade. How often do we read the news and consider it to be fact? Using examples from daily news; Ali Aftab divides headlines into 3 typical categories and explains the importance of thinking before believing.

8/Jan/2012: In a detailed front page story of The News on Sunday, Ansar Abbasi asks, ‘How did Musharraf become a billionaire?’ http://www.thenews.com.pk/article-30227-How-did-Musharraf-become-a-billionaire?- While questions about the source of Gen Musharraf’s personal fortune are legitimate, they typically focus on public information – how was he able to afford his London home? What is his current source of income? But Ansar Abbasi points to new information about Musharraf’s personal wealth, and it is not only the information, but how Ansar Abbasi was able to access it that raises troubling questions. In his article, Ansar Abbasi spends no less than nine paragraphs listing details of Gen Musharraf’s personal accounts with banks and trading accounts in UAE. Not only does Ansar Abbasi list the amounts each account contains, but the account numbers themselves. All of this information is attributed, as usual, to “a source”.

Musharraf has announced that he will return to Pakistan http://dawn.com/2012/01/08/musharraf-plans-trip-to-saudi-to-rally-support-sources/ this month to participate in the next parliamentary elections. The question must be asked who would have access to such private financial information as overseas bank accounts, including their account numbers and amounts? And why would those with access to this information be interested in revealing it to Ansar Abbasi? Is it merely a coincidence that Ansar Abbasi’s “source” has revealed this information at this time? Or is Abbasi’s article intended as blackmail to prevent a politician from participating in elections?

This blog has no way of knowing whether the information provided by Ansar Abbasi is true or false. If it is true, we also have no way of knowing where the money came from – whether from looting the national treasury as seems to be implied by the article, or from legitimate sources such as book sales and speaking fees. It is in the public interest to know that politicians are not building personal wealth through corruption, but it is also in the public interest to know how such private information becomes public. Ansar Abbasi does not need to reveal the name of his anonymous source, but it may be in the public interest to know whether his source is an employee of the bank – which is the bank’s concern, or an employee of some other organization – which may be a concern to democracy. The Jang Group has become so obsessed with quickly seeing the back of the government and is probably salivating so much over the prospects of threatened long marches that sometimes it gets muddled up in its excitement... This is the heading from yesterday's daily Jang about Prime Minister Yousuf Raza Gilani trying to reassure people - dreading a government-Supreme Court showdown in court today (October 13) - that nothing bad would happen. The headline reads: "13 March Ko Kuchh Nahin Hoga..." [Nothing will happen on March 13...]. “Burden of Proof”

“The burden of proof is upon the plaintiff and the taking of oath is upon the defendant.” (Al-Bayhaqi)”

Guilty by Suspicion is against the Spirit of Islamic Law because when you raise finger then it’s the responsibility of those who allege to produce witness. Benefit of doubt is always given to those who is under trial.

الْبَيِّنَةُ عَلَى الْمُدَّعِى وَالْيَمِينُ عَلَى الْمُدَّعَى عَلَيْهِ

The burden of proof is upon the plaintiff, and the oath is upon the one who is accused (Tirmidhi)

Therefore the ruler is forbidden from imposing a penalty on anyone, unless they perpetrate a crime which Shari’ah considers to be a crime, and the perpetration of the crime has been proven before a competent judge in a judiciary court, because the evidence could not be admissible unless it is established before a competent judge and in a judiciary court.

Jang Group is master of Spreading Rumors.

ISLAMABAD: Terming the headline —’CJs express concern over judges security; threats from admin’ — of a news report, regarding the security related meeting, that appeared in The News on Sunday as misleading, the Supreme Court office, in its press release issued here, has clarified the same as under: “It is clarified that the above-mentioned caption is misleading in so far as it gives the impression that the judges of the Superior Courts have direct clear threats from administrative officials, which is not the true reflection of the issue discussed in the above mentioned meeting nor the press release issued in this regard refers to any such threats. In fact, the meeting discussed the security related situation in view of the purported information ‘emanating from administrative authorities’ in relation to the alleged plot to target the Hon’ble Chief Justice of Lahore High Court as mentioned in the report of the Special Branch of the Government of Punjab. “Unfortunately, your above-mentioned captions portray the totally different message as if the Hon’ble judges of Superior Courts are being threatened by the administrative officials, which is not the case. It is expected that an appropriate clarification may please be published prominently, preferably at the same spot on the front pages of the two newspapers in order to set the record straight.” REFERENCE: SC clarification Monday, September 20, 2010 Shawwal 10, 1431 A.H. http://www.thenews.com.pk/20-09-2010/Top-Story/712.htm

Watch in the video below, Abbas Ather reveals without naming that it was a newspaper (Jang Group’s (Geo TV’s) newspaper The News) which had first spread a false rumour about the denotification of the Supreme Court judges on 19 January 2010. Try to search that news item via Google. And lo and behold. There is actually a news story in The News on that date. But there is a small problem here. The story has been removed from The News website; most probably very recently. No plan to withdraw judges' restoration notification - 19 Jan 2010 ... Why? The reason is simple. The Supreme Court has ordered an inquiry to investigate those who created and disseminated the rumour; the court has asked Geo TV / Jang Group to produce their record as a part of that inquiry. By removing a culpable piece of evidence, Geo TV / Jang Group are trying to play smart. Ain’t they? However, we have been able to retrieve the removed story (which was reported by none other than the Ansar Abbasi / Muhammad Saleh Zaafir duo) from another website [Pakistan Tribune] http://www.paktribune.com/news/index.shtml?223604 (which thankfully copy-pasted this report from The News):

ISLAMABAD: Prime Minister Yusuf Raza Gilani refused to cancel the notification for the restoration of deposed judges more than once in last 9 months. The prime minister mentioned this option on the floor of the National Assembly some months back but many of his cabinet ministers advised him not to speak on this issue again because they thought any discussion on this option in the National Assembly might destroy the whole system, luckily sanity prevailed and then prime minister adopted the policy of reconciliation with judiciary. This reconciliation policy later never worked because government was reluctant to implement the SC verdict in the NRO case. Some close aides of President Asif Ali Zardari discussed the possibility of de-notifying restored judges not only with the prime minister many times but they also discussed this option with some top lawyers of the country and that was how this “consultation “became a hot story in the capital first time 9 months ago. This option was again discussed by some close aides of President Zardari on October 12 and after knowing about this development many well informed journalists of Islamabad tried to verify this story from different government sources but nobody was ready to say anything on the record.

However, off the record the government ministers are and have been involved in hectic whispering campaign to malign the judiciary and to give the impression as if it is divided. One federal minister even tried to sell the story to some journalists privately last week that more than 6 judges of the Supreme Court might differ with Chief Justice Iftikhar Muhammad Chaudhry in the verdict of 18th Amendment case. This minister claimed that some judges were in the “contact “of the government. When he was asked why government was trying to establish secret contacts with judges like the government of Pervez Musharraf did in 2007, the minister just smiled and said, “Only time will tell you that we are different from Musharraf and we will give you ‘shocking surprises”.

Another minister confirmed, “Yes, some people advised us to consider withdrawing the executive order as a last option only if Supreme Court decides to take action against the prime minister under contempt of court. He, however, claimed that there was no threat from judiciary in the evening of October 14 and said, “We don’t know why some journalists claimed that government have decided to sack some judges”. This story was first reported in The News on January 19 2010 by Aslam Khan. Again Mohammad Malick mentioned it as a “plan to take extreme measure of withdrawing executive order reinstating judges” on September 25 2010 in the same newspaper but nobody from the government issued any clarification or denied the claim made by a senior journalist who often meets the president and the prime minister.

Latif Khosa while talking to “The News “claimed on Saturday evening, “Nobody in the government thought even for a second to de-notify the restored judges” but despite his claims some PPP ministers and close aides of President Zardari are still talking against judiciary privately. Their private conversations with media are enough for understanding the “real thinking” and possible designs of their leaders about judiciary. After the latest jolt, the government is now trying to feed the media persons with all kinds of stories. One lawyer very close to President Zardari now blames some judges for leaking information to media because according to him the same judges were contacted by the PPP stalwarts. The fact, however, remained that none of the judges was there for sale and not even one single soul in the superior judiciary was ready to become part of a conspiracy against Justice Iftikhar Muhammad Chaudhry. Caught napping, the PPP sources now fear that some of the judges, contacted by the government, might have informed the chief justice about the “attempts “made for changing their loyalty and therefore, Justice Iftikhar Muhammad Chaudhry said clearly on Thursday in the court, “Media is not telling any lie I know that this story is correct”. Reliable sources are claiming that judges were aware about the government plan to withdraw the judges’ notification even before this story appeared in media and that was why they moved very swiftly. Another reason for moving swiftly was that the judges had past experience in their view when Musharraf imposed emergency and deposed judges despite categorical assurances by the aides of the former dictator that no such action was planned.

Upset with the situation, now the top aides of the Presidency have started giving new twists to the whole episode to malign the judiciary. According to many legal experts, the prime minister can give a relief to the whole nation by assuring the court in writing that government will not withdraw the notification for the restoration of deposed judges. It is evident that all those who were suggesting Prime Minister Gilani to de-notify the restored judges are now advising him not to send a signed statement to the Supreme Court on Monday. One “legal eagle” of the government said, “The prime minister issued clarification on Thursday night; it was enough now you cannot treat the prime minister of the country like a section officer”. Federal Law Minister Senator Babar Awan insisted in a conversation with The News on Saturday evening that the story about the cancellation of judge’s notification was “disinformation” but he confirmed his routine contacts with some judges as a law minister. He claimed, “Nothing against the chief justice was discussed with any other judge because I am not Sharifudin Pirzada, PM Gilani is not like Shaukat Aziz and President Zardari is not like Pervez Musharraf”. Meanwhile, senior journalists of capital decided that whether it is govt enquiry committee or judiciary, they would never disclose their sources in accordance with the established basic norm. They agreed that if they were called, they would say that they reported what they were being told by the government. REFERENCE: Why did the judiciary move so swiftly? No plan to withdraw judges’ restoration notification The News Tuesday January 19, 2010 (1035 PST)

ISLAMABAD: There is no plan to withdraw the notification issued on March 17, 2009 for the restoration of deposed judges, including Chief Justice Iftikhar Muhammad Chaudhry, said an important minister. He was responding to a question of this correspondent about reports that the Pakistan People’s Party (PPP)-led coalition government was planning to technically knock out the judiciary in a ‘democratic way’.

But according to sources, the tug of war between the Pakistan People’s Party and the judicial echelon is not yet over. The PPP-led coalition government is planning to deal with the judiciary in a ‘democratic way’. The defiance strategy focuses on the use of constitutional means to make the judiciary toothless and powerless, said a highly reliable source.

However, the important minister who was initially reluctant to respond saying he was not the relevant person to talk on this issue, agreed to express his opinion after told that no other official was available. He said such reports were totally false and whatever steps the government would take would be in accordance with the law and Constitution. He said a propaganda campaign was being launched against the government to mislead the people. He said there may be such a proposal from any quarters, but the government had never committed violation of the Constitution. The government has not done anything which may offend the judiciary, he said, adding every proposal is thoroughly examined by the Presidency and the Prime Minister House and there is no chance that such a proposal can find any favourable response there.

But according to sources, President Asif Ali Zardari has made the PPP to use democracy and constitutionalism as its weapons to fight back. Initially, resilient Prime Minister Syed Yousuf Raza Gilani was also given a go-ahead signal on December 19, 2009 to make his allegiance to the president public after his meeting with Zardari. On the same day, the meeting of the PPP Central Executive Committee ended with a defiant mood. Heated speeches in the meeting considered SC decision “as part of a conspiracy”, informed sources said. The source also revealed that the appointment of Dr Babar Awan as law minister is part of the strategy to fight back judiciary with an executive push. Rescinding government notification and introducing a new ordinance protecting NAB beneficiaries are the options to be used by in coming days to put pressure on the Supreme Court.

Under the same procedural defiance strategy, another highly-placed source said the government intends to withdraw the notification of March 17, 2009 through which the deposed judges of the superior judiciary were restored to the November 2, 2007 position.

The source disclosed that by withdrawing the notification of March 17, 2009, the Presidency believes that the office of the chief justice will fall vacant, so neither any bench could be constituted nor could be any stay order issued until the appointment of a new chief justice.

On March 17, 2009, the Law Ministry had issued two separate notifications and Law Secretary Justice Agha Rafiq had read out the notifications in a press conference.

The first notification stated:

“Whereas the prime minister of Pakistan was pleased to announce on 16th day of March, 2009 that the deposed judges of the Supreme Court and high courts, including Mr Justice Iftikhar Muhammad Chaudhry, the deposed chief justice of Pakistan, shall be restored to the position they were holding immediately before 3rd day of November, 2007.

“Now therefore, the president of Pakistan is pleased to restore Mr Justice Iftikhar Muhammad Chaudhry, the deposed chief justice of Pakistan to the position he was holding immediately before 3rd day of November, 2007. Mr Justice Iftikhar Muhammad Chaudhry will assume office of chief justice of Pakistan on 22nd March, 2009, after retirement of Mr Justice Abdul Hameed Dogar, Chief Justice of Pakistan on 21st March, 2009.”

The second notification announced on same day stated:-

“The prime minister of Pakistan was pleased to announce on 16th day of March, 2009 that the deposed judges of the Supreme Court and High Courts, including Mr Justice Iftikhar Muhammad Chaudhry, the deposed Chief Justice of Pakistan, shall be restored to the position they were holding immediately before 3rd day of November, 2007:

“Supreme Court of Pakistan: 1. Mr Justice Javed Iqbal; 2. Mr Justice Khalil-ur-Rehman Ramday; 3. Mr Justice Raja Fayyaz Ahmed; 4. Mr Justice Ch Ijaz Ahmad.

“Lahore High Court: 1. Mr Justice Khawaja Muhammad Sharif; 2. Mr Justice Ijaz Ahmed Chaudhry; 3. Mr Justice Iqbal Hameed-ur-Rehman.

“High Court of Sindh: 1. Mr Justice Mushir Alam; 2. Mr Justice Maqbool Baqar. “Peshawar High Court: 1. Mr Justice Ejaz Afzal Khan.

“Now, therefore, the President of Pakistan is pleased to restore the above mentioned deposed judges of the Supreme Court and High Courts to the position they were holding immediately before 3rd day of November, 2007. These judges will assume their office with immediate effect.”

The source has confided that Law Ministry will be playing a pivotal role in the new strategy. Hence, it was important to replace Afzal Sindhu with Dr Babar Awan as law minister. The NAB beneficiaries in the government ganged together in ousting veteran PPP leader Afzal Sindhu. “Muhammad Afzal Sindhu, a veteran PPP leader having the distinction of being a member of the party’s Central Executive Committee during the days of late Zulfikar Ali Bhutto, is a respected lawyer and constitutional philosopher and was unlikely to agree to being part of this dirty game plan, hence he was sent to the Ministry of Railways last month,” the sources pointed out.

Secondly, under the same strategy the government will not take any step for reopening of cases in the Swiss court as was directed by the Supreme Court in its short order declared the infamous National Reconciliation Ordinance (NRO) void ab initio,” pointed out the source.

According to the source, had the government been serious in implementation of the Supreme Court, there was no need to wait for the detail judgment.

Thirdly, he said, the government has not appointed Justice (Retd) Khalilur Rehman Ramday as ad hoc judge of the Supreme Court as recommended by Chief Justice Iftikhar Muhammad Chaudhry. Advice of the chief justice was shelved by Law Ministry.

The recent spree of aggressive statements by Mr Zardari and PPP leadership is in a wake of being not sure about how army may react if SC throws ‘NAB beneficiaries’ out in a bid to make Pakistan corruption free and ensure that corruption is rooted out of society.

They are confident that their aggressive posture will make the military to refuse abiding by the Supreme Court order in case Article 190 of the Constitution is invoked by the Supreme Court of Pakistan, the source elaborated.

It may be recalled that Article 190 has so far been invoked only twice and on both the occasions, the military sided with the executive instead of abiding by the orders of the chief justice. He recalled that when Justice Sajjad Ali Shah had invoked Article 190 as chief judge, the-then chief of army staff Gen Jehangir Karamat had forwarded the court order to the Ministry of Defence for further process and hence the military defied the court order because Mian Muhammad Nawaz Sharif held the portfolio of the minister for defence at that time.

On the second occasion, a seven-member bench of the Supreme Court headed by Chief Justice Iftikhar Muhammad Chaudhry had ordered the state machinery including the corps and formation commanders of the Army on November 3, 2007 not to abide by any unconstitutional order of Gen Pervez Musharraf. But the Army defied the court order and a new Provisional Constitution Order (PCO) was issued by Musharraf, imposing martial law on the pretext of emergency, which was also described as emergency plus.

The source said that top advisers of the rulers are currently weighing all the available options but majority of them believes that there is no provision in the constitution for the restoration of a chief justice and the executive order through which the judges were restored could be withdrawn anytime.

It is, however, pertinent to recall here that the federal law secretary, while reading out the two notifications of March 17, 2009, had said as all the deposed judges were reinstated to the position of November 2, 2007, they were not required to take fresh oath. MUHAMMAD SALEH ZAAFIR, SENIOR CORRESPONDENT OF JANG GROUP OF NEWSPAPERS/GEO TV & CONTEMPT OF COURT - ISLAMABAD: The 13-member full court of the Supreme Court on Tuesday accepted the unconditional apology of a newsman for filing a report pertaining to the alleged preparation of references against four senior judges of the said bench. Following is the text of the order issued by the 13-member full court of the Supreme Court after unconditional apology by journalist Muhammad Saleh Zaafir:

“Muhammad Saleh Zaafir, editor special reporting of daily Jang and The News, has entered appearance on our call in connection with the news items appearing in the Rawalpindi edition of the daily ‘Jang’ and daily ‘The News’ on 11th June, 2007, regarding some references being made against four senior hon’ble judges of this Court who, presumably also happen to be the members of this bench. The said news item appeared to be open to further serious exception because such a news item had been published, more than boldly, on the front pages of the said two newspapers on the day when the bench was expected to announce its decision on the maintainability of the petition filed in this court questioning the presidential reference against the chief justice of Pakistan. It may be added that certain insinuation have been made in the said news items pointing towards some alleged misconduct committed by the four un-named senior judges of this Court.

2. Muhammad Saleh Zaafir, who is the reporter of the said news items, when confronted with the same, frankly and honestly conceded that he had made no effort to verify the veracity of the allegations levelled in the said news items before publishing the same nor did he have any proof in support of the contents thereof. He, however, added at the very outset that he had utmost regards and respect for not only the said hon’ble judges of this Court but for the entire judiciary; that he did not have even an iota of doubt about their integrity and character and that reporting the said news items was a grave mistake on his part.

3. He tendered verbal unconditional apologies in open Court and also placed on record his statement to the above noted effect, in writing.

4. The regrets offered by Muhammad Saleh Zaafir, reporter/editor, appear to be sincere and the remorse expressed by him appears to be genuine. In this view of the matter, we do not consider it necessary to proceed with the matter any further except warning him to be careful in future.

5. On our call, Muhammad Afzal Butt, president of the Rawalpindi-Islamabad Union of Journalists, also entered appearance for assistance.

6. The reporting of the proceedings which have taken place in Court in connection with the matter in question shall be made only to the extent that the apology tendered by the said Muhammad Saleh Zaafir shall be published in full and so would be published this order passed thereon. The daily ‘Jang’ and daily ‘The News’, which have published the news items in question, shall publish the apology and this order, prominently, on their front pages. Muhammad Saleh Zaafir undertakes to do the same and has been ordered accordingly.”

Meanwhile, the following is the text of unconditional apology tendered by Muhammad Saleh Zaafir before the Supreme Court on Tuesday.

“I, Muhammad Saleh Zaafir, do hereby tender an unconditional apology to the hon’ble court in relation to the contents of the story that appeared in daily The News/daily Jang on June 11, 2007.

“I have been directed by the hon’ble court to submit any proof in relations to the contents of the said items. I would humbly submit that I have no proof whatsoever in relation to the matter discussed in the said story.

“I keep this hon’ble court in the highest esteem and respect. I can never ever think of bringing about a bad name to the hon’ble court or to any learned judge of the hon’able court. I would submit that I can never think of committing contempt of this hon’ble court.

“I undertake to be careful in future and am ashamed for the publication of the story. I would humbly seek pardon in relation to the grievous lapse. “I pray to the hon’ble court that no further action may kindly be proceeded in relation to the matter. I would entreat that my unconditional apology may graciously be accepted.” REFERENCES: SC warns newsman, accepts apology Wednesday, June 13, 2007  http://www.thenews.com.pk/TodaysPrintDetail.aspx?ID=8458&Cat=13&dt=6/13/2007  Reporter apologises to SC for ‘baseless report’ Wednesday, June 13, 2007 http://www.dailytimes.com.pk/default.asp?page=20076\13\story_13-6-2007_pg7_3

The tailpiece

Correspondents of The News International/Jang Group/GEO TV often fight with each other

ISLAMABAD: Top constitutional expert and former chief justice of the Sindh High Court (SHC) Fakhruddin G Ibrahim has said that he met President Asif Ali Zardari before the hearing of the NRO case on the request of Chairman Senate Farooq H Naek who wanted to seek legal guidance on NRO and his meeting was never secret, known to everyone and he never gave any assurance to President Zardari on any possible court verdict. Justice Fakhruddin, generally known as Fakhro Bhai, has written a letter to the president and the prime minister to set the record straight after reports that President Zardari had told his PPP parliamentarians that a former judge had trapped him not to defend the NRO in the Supreme Court. Zardari did not name the judge but it was widely speculated that it was Justice Fakhruddin G Ibrahim. In his letter he said senior journalist Hamid Mir was also witness to the whole developments in this regard. Hamid Mir while talking to The News also confirmed that no secret meeting ever took place between President Zardari and Fakhro Bhai and when the latter met the former it was an open secret and was even discussed in Hamid Mir’s Geo News programme Capital Talk. Hamid Mir also verified whatever was stated in the letter of Fakhro Bhai was absolutely correct. The letter makes it repeatedly clear that he never desired to meet President Zardari and only went to the Presidency on the request of his old colleague Farooq H Naek and during the said meeting the prime minister had also arrived. The issue of Swiss cases never came under discussion. He termed the allegation leveled against him defamatory and an attempt to malign him.

Mr Ibrahim sent the following details of the letter to The News:

“I write to you with reference to two columns dated 28.9.10 and 30.9.10 in The News titled “Backdoor channels played key role” and “Zardari admits he was trapped, vows to fight on” authored by Rauf Klasra. In the said articles, Mr. Klasra cites an “inside source” and levels the following defamatory allegations against me”:

1. “At the time of hearing of the NRO case in the SC, a Karachi based former judge who enjoyed good reputation and was considered to be a credible person had visited the Presidency and secretly met Asif Ali Zardari. In this meeting, the former judge had told Mr Zardari that he should not worry about the Swiss cases, as they were closed transaction.”

2. “The former judge advised Mr Zardari to believe in him and should not defend the NRO in the court and he assured him that the judges would not open the cases against him.”

3. “Mr Zardari later discussed this judge’s advice with his top legal aides and Babar Awan was the only minister who had strongly opposed the idea. But Awan’s advice was ignored as Zardari tended to believe in the so-called assurance given by the former judge, who had also taken some drafts with him to convince Zardari how it was in his own benefit not to defend the controversial law promulgated by a military dictator.”

4. “Zardari was said to have commented after reading the explosive contents of the NRO judgment that a former judge had clearly used his credibility to trap him.”

5. “According to this former judge, the Swiss cases were already a “closed transaction” and the court would not touch it at all. Based on this broad understanding given by the former judge in the presence of the legal team of the top constitutional personality, it was decided not to contest the NRO in the court.”

6. “The PPP government was feeling betrayed at the hand of a Karachi based retired judge who had met one of the top constitutional personalities of the government in Islamabad.”

“It is obvious to all that the “Karachi based former judge” repeatedly cited in the above articles is a reference to me, as my meeting with President Zardari and also my candid advice in this matter is a matter of public record and the same was even acknowledged in Hamid Mir’s Capital Talk as far back as 2009. Therefore, there was never any secrecy with regard to my meeting with President Zardari on this issue.”

“For the sake of good record, please note that I met President Zardari prior to the hearing of the NRO case at the request of an old friend and former colleague, Farooq Naek, the Chairman Senate. My advice to Farooq Naek and also to the president on the NRO was clear: The NRO was indefensible and the federation should not defend an immoral law made by a former dictator. The suggestion that I appear in the NRO case on behalf of the federation was politely declined.”

Importantly, at no time have I offered any advice in relation to the Swiss cases nor has the same ever been sought. The Swiss cases did not even come up for discussion in my meeting at the Presidency. Therefore, the despicable allegation, “I assured the president that the judges would not open the cases against him” and other equally defamatory assertions that my opinion was meant as a “trap” callously made in the aforesaid articles are highly deplorable. Kindly, note that it is not in my character to proffer any assurance as to the outcome of a court proceeding. I have not done this in my near 60-year law career, and I have no reason to start now.”

“Contrary to the defamatory allegations published in the above articles, I did not meet the president “secretly” or to “convince” him. I met the president, because I was requested to do so. I never sought any meeting on my own accord. When asked, I stated my honest legal opinion on the NRO. Even otherwise, I have never made any secret of my views on the vires of the NRO or my meeting with President Zardari. At the meeting in the presidency, where many others including the prime minister and the law minister also joined in, it was the Advocate General Sindh who openly stated that the NRO should be defended. At such stage, I left the meeting at the presidency and was not contacted by any person thereafter.” “In conclusion, I regret that a newspaper of your standing and record sought fit to make the aforesaid scandalous allegations without even the courtesy of a phone call to consider the version of the person Mr Klasra so callously sought to defame.” Yours sincerely Fakhruddin G Ebrahim. ISLAMABAD: With reference to the report, “Karachi judge denies President’s defamatory allegations”, published in ‘The News’ on October 2, I may be allowed to ask the honourable retired judge Fakhruddin G Ibrahim that why does he consider himself the only respected former judge of Karachi who could be invited to meet the president and advise on NRO or even offer a deal. Has Karachi no other distinguished person who could have been my ‘unnamed judge’? This correspondent had only reported that President Asif Zardari had told his partymen at the Presidency in the PPP parliamentary party meeting that a former judge from Karachi had met him and advised him not to contest NRO case in SC and that the SC would not touch his Swiss cases, as it was a “closed transaction”. Mr Zardari had further claimed that he had believed the words of this former judge but he was shocked to know the court had ordered reopening of all cases against him. Mr Zardari had commented before his party men that now he was feeling betrayed because this judge had trapped him by advising him not to contest the NRO. He confessed that he had made a mistake to believe in the words of this judge.

I have a right to ask Mr Ibrahim as to where have I misquoted President Zardari and when and where did I name him in the entire story. I could not have misquoted Mr Zardari in the presence of his big media team comprising top professionals like Farhatullah Babar, Faouzia Wahab, Farrah Ishphani, Jamil Soomro, Qamar Zaman Kaira and others. I could not have misquoted the president while dozens of PPP ministers and more than 100 PPP MNAs were present in the same meeting. After the story appeared in the press Senator Dr Safdar Abbasi who had actually triggered this debate on NRO in the Presidency was the first one in the morning to call me. Dr Abbasi said, “Mr Klasra, your story is 99.9 percent correct. This is what I had said in the meeting and this was the response of the president.” After Raja Pervez Ashraf, this is second case in which a person has volunteered to confirm something without being named or asked to. I simply followed the ethics of journalism by not quoting any judge’s name in my story as I will repeat not because I was afraid of someone. I did so simply because Mr Zardari did not name the unknown judge, who according to him had trapped and deceived him. Had he quoted anyone name, I might have used his name even in the start of my story and also took his version. Malik Riaz & Prostitution in Pakistani Media.

Prostitution is the act or practice of providing sexual services to another person in return for payment. The person who receives payment for sexual services is called a prostitute and the person who receives such services is known by a multitude of terms, including "john". Prostitution is one of the branches of the sex industry. The legal status of prostitution varies from country to country, from being a punishable crime to a regulated profession. Estimates place the annual revenue generated from the global prostitution industry to be over $100 billion. Prostitution is sometimes referred to as "the world's oldest profession". Prostitution occurs in a variety of forms. Brothels are establishments specifically dedicated to prostitution. In escort prostitution, the act may take place at the customer's residence or hotel room (referred to as out-call), or at the escort's residence or in a hotel room rented for the occasion by the escort (called in-call). Another form is street prostitution. Sex tourism refers to travelling, typically from developed to under-developed nations, to engage in sexual activity with prostitutes. Sex trafficking, one type of human trafficking is defined as using coercion or force to transport an unwilling person into prostitution or other sexual exploitation. “I will say live on air that i am pressurised into doing the show by him (Malik Riaz ) and Mian Amir (owner of Dunya News channel), Mubashir Luccman tells real estate tycoon Malik Riaz after he makes come back following an argument with cohost Meher Bokhari who called him childish over camera time during a planted interview with Bahria Town owner on Wednesday night. Both Lucman and Bolhari urged Malik Riaz to clear their names from taking money Mr Lucman also wanted to talk about Hamid Mir’s allegations, but Riaz won’t allow him. During the interview Lucman received phone call from Abdul Qadir Gilani, a son of Prime Minister Yousuf Raza Gilani. Both the anchors had strict instructions coming in for them that Riaz is not to be interrupted. Both the anchors raised the questions which they were asked by the property tycoon. Riaz also instructed the anchors to ask him questions about Chief Justice Iftikhar Muhamamd Chaudhry. The whole episode on Dunya News depicted a horrible picture of the TV channel owned by Mian Amir Mehmmod. A question arises following the interview whether the owner and both the anchors are using the TV channel against the country’ top court, facilitating a property tycoon to say what he wanted to against the chief justice of Pakistan. ISLAMABAD, Dec 7: Setting aside the official and security protocol, President Asif Ali Zardari paid a visit to the house of property tycoon Malik Riaz Hussain on Monday night. According to police sources, the president arrived at the house in Sector G-6/3 at around midnight with a fleet of private vehicles. He was escorted by workers of the Pakistan People’s Party. The unscheduled visit caused confusion among security and law-enforcement agencies and different wings of Islamabad police stated communicating with each other to ensure security of the president’s private convoy. Later, a contingent of police commandos was deployed in the street for security of the president who remained there for about an hour before returning to the presidency. The purpose of the visit could not be ascertained. Malik Riaz is considered to be a person wielding a lot of influence in the corridors of power. President’s spokesman Farhatullah Babar expressed ignorance about the visit. Do keep in mind while going through the History below that Mr. Kamran Khan on Monday, November 29, 2010, devoted the entire programme to an extended promotional interview of Malik Riaz, the controversial billionaire owner of Bahria Town construction, said also to have recently invested heavily in ARY. The only explanation I could come up with for this remarkable detour was that either Khan now had a home in Bahria Town or that Riaz has now invested in Geo as well. IT is with a sense of great inadequacy, immense embarrassment that I admit I have never seen, met or talked to Malik Riaz, the property tycoon currently in the news. If this admission makes you think I am a worthless former editor, a rubbish columnist, then don’t feel awkward about expressing your thoughts. You’ll only be mirroring my deepest, most honest assessment of myself, almost writing a chapter of my autobiography for me. Malik Riaz’s power was, and I suspect will remain, so enormous that he was only ever mentioned in the media when he didn’t disapprove of the news item. Exceptions were there but they were just that: exceptions. So now that he is being talked about openly in the media, is his power on the wane? Don’t jump to conclusions. At least six — or was it seven or eight? —journalists who have met the mesmerising man have said he wanted them to talk about him. Well not exactly about him. He actually wanted them to talk about his allegation that his conglomerate had been paying huge sums of money to the chief justice’s son, mainly because of the young man’s lineage. There are suggestions (and nothing more) that this was done to seek judicial favours. It is ironical that none of the journalists were impressed sufficiently with the ‘evidence’ Malik Riaz purportedly exhibited before them to make it the subject of a story. In fact, the journalist who eventually ‘broke’ the story from the US didn’t even say if he had met the gentleman. He didn’t send the story for use by the outlets in the media empire that employs him as one of the apex editors, preferring instead to release it in the form of a web-TV interview from Washington. He denies his own group spurned/spiked his story. Several journalists belonging to this group are now on the list of those who’ll depose before the Supreme Court in a matter which (though there’s no evidence yet) may bring discomfort to the chief justice even though his own role is untarnished. Post Script: 2012: ISLAMABAD, June 9: ARSALAN SPEAKS OUT: In his statement, Dr Arsalan refuted in strongest terms any relationship, intimacy or acquaintance whatsoever with Malik Riaz, his daughter or son-in-law whose names were also not known to him and that he had never met them in relation to any business deal or for any purpose in or outside Pakistan. He said baseless, frivolous and unfounded allegations had been spread in the electronic and print media in the absence of any cogent and logical evidence acceptable under the law of evidence. Dr Arsalan cited a news item appeared on June 8 in an English Daily to prove that the stand taken against him by Malik Riaz had been denied by latter himself. Therefore, Malik Riaz was liable to be dealt with strictly for dragging Dr Arsalan in the court and maligning the august institution of judiciary, the statement said. Dr Arsalan argued that the statements of TV anchors brought to court record were nothing but “hearsay” as they were allegedly based on the statement of Malik Riaz and thus were inadmissible unless the property tycoon himself appeared before the court and produce admissible evidence. The claims of anchors like Kamran Khan and Hamid Mir and Group Editor of The News Shaheen Sehbai that some material had been shown to them by Malik Riaz suffered from serious contradictions, the statement said, adding that whatever Kamran Khan deposed before the court was an absolute contradiction to what he had said in his talk show on June 5. Similarly, Hamid Mir in his statement exonerated him (Dr Arsalan) by saying that the material shown to him was not worthy of acceptance. Thus these statements should be discarded straight away being inadmissible having absolutely no evidentiary value, Dr Arsalan said, adding that these statements were based on surmises and conjectures. Dr Arsalan also took pride for being the son of Chief Justice Iftikhar Chaudhry whose integrity, he said, was beyond doubt. “Being a son of such a towering personality I have always been careful in my private and public life. I am a 32-year-old man; I earn my bread and butter through my own business and I submit my income tax returns regularly, which can be verified by any citizen of this country,” he said. The statement argued that the initial burden was upon Malik Riaz to establish the allegations along with explanations to the effect that what the motive was or object behind all the exercise which he wanted to achieve. It said if Malik Riaz had made investments for favouring him (Dr Arsalan) to achieve illegal ulterior motives, he owed an explanation to the court. Explaining his bona fide, Dr Arsalan said that in 2009 he had travelled on his own expense to London, along with his family, and hired a flat — a practice he repeated in 2010 and 2011 for which Rs4.5 million had been deposited through cheque No 1287353 of Standard Chartered Bank Lahore on Aug 15, 2011, by his cousin Muhammad Aamir Rana into Zaid Rehman’s account in Meezan Bank Gulberg branch in Lahore. Zaid Rehman was known to Dr Arsalan through Ahmed Khalil, a cousin of Zaid Rehman and employee of Bahria Town. Dr Arsalan said he did not know from whose credit card the rent of the flat which was around 3,200 pounds per week had been paid. Perhaps, he said, he had stayed for four weeks so that the total rent amounted to 10,000 pounds and when he reached London he had to sign an occupancy agreement by submitting the copy of his passport, therefore the formalities as per rules were completed, however the rent had already been paid. June 2012: Karachi: Tolerance seemed to be have ended in the Pakistan’s society as we have always heard about politicians, lawyers, doctors and other people belonging to different walks of life fighting each other, but now there is another fight gearing up in the media between Najam Sethi (Geo News), Talat Hussain (Dawn News) and Mubashir Lucman (Dunya News). The quarrel between Najam and Talat started when Talat Hussain in his program, News Night with Talat, accused that the word ‘Chirya’, used by Sethi for his source, was none other than Pakistani business tycoon Malik Riaz, main character of Arsalan Iftikhar scandal. Talat further said that Malik Riaz himself has unveiled that he is the ‘chirya’ of Najam Sethi and after gathering information from him Sethi present it in his night show. Responding to Talat’s word, Najam Sethi in his program, Aapas ki Baat Najam Sethi K Sath, said that he (Talat) was speaking a lie about his association with Malik Riaz and he would sent a legal notice to the anchor for his irresponsible allegation. “He (Talat Hussain) is a CIA agent as according to wiki-leaks document, two Pakistanis including Talat Hussain were working for Stratford, a spy agency working for CIA,” Sethi said. Furthermore, furious Najam Sethi didn’t stop after lashing out at Talat Hussain and started talking about Mubashir Lucman. Sethi said that earlier Lucman propagated a lie about him that he was a US national, which was totally a senseless allegation. “I have not acquired US citizenship. I am a Pakistani and I would be a Pakistani,” the Geo News analyst claimed. He further said that Lucman also alleged that his daughter was working for late Richard Halbrooke, US special envoy to Pakistan and Afghanistan. The analyst further said that he had sent a legal notice to Mubashir Lucman on which the High Court directed Lucman to avoid putting false allegations on him. Note: Watch last 20 mins for Talat’s allegation against Sethi while last 15 minutes for Sethi’s allegation and reply. ISLAMABAD, June 13: Property tycoon Malik Riaz put a fourth question to the chief justice on a private television channel on Wednesday. Mr Riaz said: “During the period when the CJ was deposed, was it not a part of the deal that no messenger will be entertained by the team [which was running the campaign for reinstatement of the CJ].” The angry property dealer had put three questions to Chief Justice Iftikhar Chaudhry the previous day: “ (i) He [chief justice] should explain how many times he met me in the dead of the night and whether or not Arsalan Iftikhar was present there? (ii) Was the chief justice not present at several meetings that took place at the residence of my business partner Ahmed Khalil where the prime minister and a sitting judge of the Supreme Court were also present? and (iii) I ask the chief justice to hold the Quran and clarify how long he has known about the role of Dr Arsalan and why he failed to take notice until now?” When the anchors asked him how he had been blackmailed by the Justice Chaudhry’s son, he said: “Arsalan had approached my business partner Ahmed Khalil and later he was in contact with my son-in-law. “My son-in-law used to pay him the amounts he demanded to settle the cases but it was never done and I was frustrated and had to come up with all these evidences.” Mr Riaz said it was a shock for him that although Aitzaz Ahsan, the lawyer, had talked to the CJ about alleged involvement of his son in a financial scam, he continued to hear cases involving the Bahria Town. Malik Riaz disclosed that one “Hakeem Wahab used to visit my residence and often told me that my cases would be settled by the CJ”. Hakeem Wahab, according to Riaz, was a spiritual healer [Pir] of the CJ’s family and had accompanied the CJ to the United States for an award ceremony. The tycoon claimed that Arsalan Ikftikhar had been given a suite at the Balochistan House the other night, adding that Interior Minister Rehman Malik had provided him the rooms on directives of Supreme Court Registrar Dr Faqir Hussain. Malik Riaz further said that PML-N leader Chaudhry Nisar Ali Khan “purchased some 135,000 shares of Attock Refinery at a cost of Rs10 per share. He never allows establishment of educational institutions in his constituency”. “Nisar and Khawaja Asif are worried by development carried out by me in their constituencies. It has become an eyesore for them,” added Malik Riaz. REFERENCE: Riaz hurls ‘fourth question’ at CJ From the Newspaper Imran Ali Teepu http://dawn.com/2012/06/14/riaz-hurls-fourth-question-at-cj/

2009 - CJ receives Holbrooke, calls on Zardari By Matiullah Jan ISLAMABAD, June 5 Chief Justice Iftikhar Mohammad Chaudhry met visiting US envoy Richard Holbrooke in the Supreme Court building on Friday. "The meeting was held at the request of the visiting US envoy Mr Holbrooke who came to meet the chief justice in his chambers,” said Dr Faqir Hussain, Registrar of the Supreme Court. He said that officials of the Foreign Office were present at the meeting. “Matters relating to judicial reforms as per national judicial policy and the whole judicial structure of Pakistan were discussed,” Dr Hussain said. The meeting comes at a time when Pakistani judiciary is seized with litigations that directly involved interests of the United States. A particular case of concern to the US is that of the missing persons in which intelligence agencies have been accused of either abducting people on suspicion of terrorism or handing them over to the United States. The case of Dr Aafia Siddiqui, who was reportedly abducted from Pakistan and is now in US detention, is also pending in courts. The Supreme Court spokesman denied that the issue of missing persons came up in the meeting. When contacted, the firebrand leader of lawyers` movement and president of the Supreme Court Bar Association, Ali Ahmed Kurd, declined to comment on the meeting. PML-N spokesman Siddiquul Farooq who has a case pending in the apex court said “It was a courtesy call by Mr Holbrooke and we believe in the person of Chief Justice Iftikhar Mohammad Chaudhry and we believe that no one can derail him from the judicious path.” Immediately after the meeting, the chief justice went to the presidency to attend the oath-taking ceremony of newly appointed Federal Shariat Court Chief Justice Agha Mohammad Rafique. There he had a one-to-one meeting with President Asif Zardari. It was for the first time since his restoration that the chief justice visited the presidency and met President Zardari. Justice Iftikhar, it may be mentioned, did not accept earlier invitations from President Zardari. The last time the chief justice met Mr Zardari was at the Zardari House just before he moved to the presidency after becoming president. After becoming president, Mr Zardari publicly resisted the restoration of Justice Iftikhar Chaudhry, till the success of the long march by lawyers in March this year. One case pending before the Supreme Court and that directly affects President Zardari relates to the controversial National Reconciliation Ordinance (NRO) through which former President General Pervez Musharraf allowed the quashing of corruption charges against PPP leaders, including President Zardari. Under the new judicial policy reforms spearheaded by the chief justice, judges of the superior court are required to strictly follow the judicial code of conduct which, among other things, require them to stay away from public functions and not to assume executive offices to temporarily fill vacancies created by the president and governors going abroad. After his first restoration on July 20, 2007, Justice Chaudhry had stopped meeting the president or the prime minister and attending functions hosted by them. ISLAMABAD: The Establishment Division on Monday issued an ambiguous notification explaining the package and remunerations of the newly-appointed chairman-cum-managing director of the state-owned Pakistan Television Corporation (PTV). The letter of the Establishment Division bearing No 1/64/2008-E-6, dated June 30, 2008, says that besides the fixed remuneration of the new chairman PTV, any other “financial benefits” are negotiable between Dr Shahid Masood and “competent authority” at some later stage. The Establishment Division letter read: “Dr Shahid Masood, chairman PTV, who also has the additional charge of managing director, has agreed to receive the same remuneration package which was given to former MD PTV Yousuf Baig Mirza (annexure-III).” The contract of Dr Shahid Masood will be for a period of five years which could be terminated by either side on a six-month notice. The attached document (annexure-III) issued by the Establishment Division on May 25, 2007, said that MD PTV Yousuf Baig Mirza would get Rs 700,000 per month as salary. His house rent would be Rs 150,000 and utility allowances Rs 25,000. The salary would be raised by Rs 50,000 per annum. Free mobile phone, two residence telephones and one fax would be allowed. Business class tickets would be given for the national and international travels. Recreational allowance would be given according to the situation. The notification issued by the Establishment Division on Monday said Dr Shahid Masood would be paid Rs 50,000 extra to that of the package of the previous MD as he (Dr Shahid) would also hold the office of the PTV chairman. Information minister Sherry Rehman has also approved the Establishment Division notification. However, senior PTV officials see the point of “extra financial benefits to be negotiated later” with concern. The officials maintained that it would be totally against the rules of the corporation and illegal to offer somebody any percentage of the income from any programme aired on the PTV. Dr Shahid Masood was appointed as the PTV chairman through the Establishment Division letter No 1/64/2008-E-6, dated May 31, 2008, and was given the additional charge of the MD through the letter No 1/64/2008-E-6, dated June 21, 2008. Dr Shahid, who hosts the Geo News programme “Meray Mutabiq,” which is  recorded in Dubai, recently resigned as the chairman/MD PTV and as special assistant to the prime minister. Dr Shahid said that he told the minister that during his stay in a government department and later in government the use of this secret fund was confirmed. “However, it is very unfortunate that the secret fund of the information ministry, which was first used to bribe journalists to get support for government policies, is now being used to tarnish the image of some leading and independent journalists for the first time in the country’s history.” Dr Shahid said that he made it clear to the federal minister that government’s policy to tarnish the image of independent journalists by bribing other journalists through secret funds of the information ministry is going to fail and it will ultimately tarnish the image of politicians, democracy and the country. Now read that Mr. Mazhar Abbas, Senior Journalist and a Former Secretary General of Pakistan Federal Union of Journalists, instead of raising voice against Retrenchment of Working Journalists, is supporting a "Fraud" like Dr. Shahid Masood.

As a mark of protest against the move to ban Dr Shahid Masood’s programme Meray Mutabiq, I withdraw my name from the list of journalists invited to accompany Prime Minister Yousuf Raza Gilani on his official visit to Germany and the UK from November 30 to December 4. It does not mean that I agree with Dr Masood’s views, but it is the most undemocratic way and use of dictatorial tactics to silence someone’s voice that has hurt me. I hope the prime minister will order an investigation into the matter and allow Dr Masood to express his views on air. I thank you, Mr Gilani, for inviting me, but after this action my conscience does not allow me to undertake that journey. Dr Masood’s language and views, at times, violate the generally accepted norms of journalism, but the answer is not to gag the press like General (r) Pervez Musharraf did. He too had approached the UAE government in November 2007 to dislodge Geo and ARY from Dubai. Shahid Masood has always been an emotional person. I know him since he was in Sindh Medical College. He used to bring press releases of the Peoples Doctors Forum, PPP’s medical wing, while I was working in an evening newspaper in Karachi. I met him first during a hunger strike by young medical doctors outside Karachi Press Club. He was a great admirer of Zulfikar Ali Bhutto and Benazir Bhutto. Later, I came to know that he went to London and for sometime also worked at the Pakistan Peoples Party Secretariat. During his stay in London, he started writing for an Urdu evening newspaper in Karachi before joining ARY. I may be mistaken, but he too was a ‘jiyala’.

When he joined the channel, the electronic media was in its infancy but his programme “Views on News” started getting a large viewership. The Iraq war gave him the real boost. Dr Masood’s language skills and oratory made him the most popular anchor in the early years of the electronic media in Pakistan. At the same time many started believing that his views had tilted from left to centre, and afterwards from centre to right. During this period he hardly ever cared about the established journalistic norms, but within years he stole the show and became the head of that news channel. Later, he joined Geo and did a successful stint there. Also Geo TV never ‘owned’ his programme, meaning that he was free to speak his mind and the channel saved itself from any possible legal battle. I never liked his joining the state-controlled media organisation and he suffered a credibility loss when he became its managing director – a post he should have never accepted. He remained close to President Asif Ali Zardari for sometime and would not have left the job had Sherry Rehman not been the information minister. Through Meray Mutabiq-II, he made a comeback and to his luck President Zardari’s poor decision of not restoring the deposed judges gave a real boost to his programme’s ratings. The naive move of President Zardari’s camp to use the influence of the UAE authorities will only help Dr Shahid Masood, and the government will be the ultimate loser. As far as life threats to Dr Shahid Masood are concerned I think he should return to Pakistan and resume his programme from here. There are journalists in Pakistan who have bravely faced life threats. My only question, however, is that why recently Dr Masood and Shaheen Sehbai went to meet Asif Zardari as reported by Hamid Mir. All I want to say to Dr Masood is that “Life and death are in the hands of God. Let’s face it, Doctor sahib.” REFERENCE: Media under attack — again Mazhar Abbas Ex-secretary general, PFUJ Wednesday, November 25, 2009 http://www.thenews.com.pk/TodaysPrintDetail.aspx?ID=210260&Cat=11&dt=11/25/2009

Posted by red kazim August 25, 2008:

Few people know that the journalistic career of Dr Shahid Masood began at the Karachi-based, pro-MQM Quami Akhbar. In those days Dr Shahid Masood used to practice at Jinnah Hospital. He would regularly visit the office of Qaumi Akhbar situated in a street adjacent to I I Chundrigar Road and urge the editors to place his single column nuggets, which he filed as a health reporter from Jinnah Hospital, prominently in the newspaper. When Dr Shahid Masood was about to move to London (as a medical practitioner) he pestered the editor, Ilyas Shakir, for a letter stating that he was the ‘London bureau chief’ of Qaumi Akhbar. Ilyas Shakir avoided him for quite long apprehending that the doctor wanted to get a visa on the basis of his association with a newspaper. He bothered the news editor, Mr Khusnood, tirelessly who finally issued him an official letter. Dr Shahid Masood’s break in the media came when famous singer Nazia Hasan died in London. He came to Pakistan with the body of Ms Hasan and interviewed the mother of the deceased. Qaumi Akhbar was the only newspaper of Pakistan which covered the story comprehensively and people noticed Dr Shahid Masood for the first time as a journalist. Then came the Valima reception of Altaf Hussain for which the ‘bhai’ sent special invitations to Ilyas Shakir and reporter Sabir Ali. Since it was a personal invite from Altaf bhai, the two had to attend the reception. The ‘bureau chief’ was then asked by Ilyas Shakir to make arrangements for their stay in London. Now the ‘bureau chief’ pleaded his editor to take him along to the Valima ceremony of the MQM chief. That was probably the first big political gathering Dr Shahid ever attended. Ilyas Shakir then planned to interview Benazir Bhutto who was also in London at that time. Once again the ‘bureau chief’ was accompanying Ilyas Shakir and Sabir Ali. When the three reached Benazir Bhutto’s residence, Dr Shahid Masood was stopped at the entrance by Wajid Shamsul Hasan (who has now been appointed Pakistan high commissioner to the UK) on the pretext that he was not a journalist. Sabir Ali argued in favour of letting Dr Masood in, saying that he was Qaumi Akhbar’s London bureau chief. Finally he was allowed to enter the premises by Benazir Bhutto herself. After the conclusion of the interview, Dr Shahid Masood convinced Ms Bhutto to hold a copy of Qaumi Akhbar while he photographed her. Ms Bhutto obliged and in the next day’s issue of Qaumi Akhbar, the caption of the front-page picture read at the end: photo by Dr Shahid Masood. Later, staffers at Qaumi Akhbar heard that the pest they always tried to keep away from had joined a television channel. Most people envied while some sent him congratulatory messages. To Dr Shahid Masood’s credit, he always met his ‘ex-colleagues’ respectfully even after his eventful stint at Geo. I don’t know whether one should call it a success story or not. Successful Dr Masood is but at what cost? Sane people know Dr Shahid Masood as a religious fanatic who always likes to play to the gallery. Many people call him Dr Qayamat Masood because of the set of CDs he released suggesting that the doomsday was just round the corner. Not only is he ideologically an extreme rightist, his ‘facts’ are more often than not wrong and concocted. His level of general knowledge can be judged by an entry posted by London-based Ayesha Ijaz Khan, who is also a The News occasional contributor, on her website [Read the text at the end] There’s no denying the fact that what he achieved came as a result of his untiring efforts to make inroads into the mainstream press but the outlandish manner in which he lied in his recent Jang column on the resignation of the president speaks volumes of his professional integrity and honesty.

Regarding Doctor Shahid Masood and a Few Ramblings on Pakistani Media By: Ayesha Ijaz Khan

http://www.ayeshaijazkhan.com/docs/Regarding%20Doctor%20Shahid%20Masood%20and%20a%20Few%20Ramblings%20on%20Pakistani%20Media.pdf
I had the opportunity to meet Dr. Shahid Masood in October 2001, shortly after the 9/11 attacks on The World Trade Centre, and coincidentally, just as ARY had started its London operations. PJ Mir already had his own show and Shahid Masood, it appeared to me, was vying for one. The topic almost routinely under discussion in those inaugural weeks was understandably 9/11. I was asked to contribute as a guest panellist. Since I was a US-trained lawyer, I would be commenting on the legal ramifications of handing Osama over to US authorities. It seems like a pointless conversation now, but way back in the autumn of 2001, Pakistan was trying its level best to use its influence with and impress upon the Taliban the wisdom in handing Osama over and sparing the entire population of Afghanistan, northern areas of Pakistan and eventually the people of Iraq the misery of US wrath. The panel discussion had four guests. Myself, Sherry Rehman (who had not at that point announced her political ambitions although the underlying signs were unambiguous), Dr. Shahid Masood and a fourth gentleman whose name I unfortunately do not remember so let’s just call him Mr. X. Clearly, Mr. X and I were the nobodies on the panel; Sherry and Dr. Shahid the stars. Who could have predicted then that seven years on Sherry would be our Information Minister and Dr. Shahid her PTV Chairman! The show ran unfocused. Electronic media was just starting out and there was much confusion.

Dr. Shahid was not initially meant to be a guest on the panel as he was “in house” but I soon realized that he filled in whenever a guest cancelled at the last minute. I am not sure whose place he was taking that day, but it soon became clear that the good doctor was ready and willing to talk about anything under the sun. So he was “an expert” on anthrax that October day. As the show progressed, Mr. X and I got little air time for it was survival of the loudest. I, somewhat soft-spoken, was cut off in mid-sentence by Sherry, hoping that PJ would intervene and let me have my full say, but no such luck. Sherry carried on unabated till she found her match in Dr. Shahid. PJ posed the anthrax question, which Dr. Shahid dismissed instantly and carried on talking about what he wanted to talk about, the conspiracy against Muslims.

Mr. X, forgive me for not remembering his name, described himself as a British Muslim and in his pre and post-program conversations seemed more distressed about the Turkish hijab-clad women who were denied admission into university than he was up to speed with Pakistan’s potential role in the war on terror. Mid-way through the program, PJ decided that none of his guests were up to the mark and so he called Lord Nazir and proceeded to talk about Kashmir. In 2001, it was not fashionable to seek legal opinions on television shows so I had to wait till after the show to say what I wanted to say. Mr. X had left as soon as the show ended, annoyed, I think. But Dr. Shahid and Sherry lingered on, as did I, waiting for my ride to make it to the inconveniently located Acton studio. It was then that I discovered that Dr. Shahid was not a Ph.D. as I thought he may have been, but a medical doctor. Later, I discovered that all the doctors in our media are medical doctors and not Ph.D.s as they may want us to believe, whether it is Aamir Liaqat or Shaista Wahidi or of course Shahid Masood.

Why would one want to retain the doctor title when one is not treating patients but a working journalist is beyond me, but I suppose its all part of leaving the right impression, or perhaps better said in Urdu, aks dalna. Sherry had left the studio and I was still waiting for my ride. As I waited, Dr. Shahid and I continued our conversation. Dr. Shahid, I realized quickly from speaking to him, had an extremely right-wing bent of mind. The conversation drifted to Partition, and then Jinnah, to which I heard the most bizarre remark from Dr. Shahid. “Jinnah was a Parsi,” he said. Not that I think there is anything wrong with the Zoroastrian faith, but Dr. Shahid was clearly misinformed and I felt I must set him straight. “Jinnah was a Muslim. He married a Parsi woman, but he was Muslim,” I told him matter-of-factly. “No, Jinnah was a Parsi, I think,” Dr. Shahid still doubted my knowledge, and possibly his own.

“Jinnah was born in an Isamili household,” I told him, thinking perhaps that Dr. Shahid may be confusing one minority group for another, odd as it sounds, “but, as an adult, chose to espouse mainstream Islam.” Dr. Shahid appeared confused at my statement and did not respond but looked on disbelievingly. Shortly after that, I left the studio but found it very difficult to fathom that Jinnah, whose name appears in the greatest Muslim leaders of all time, who created a homeland for millions of Muslims, would be mistaken as a non-Muslim by anyone, leave alone a Pakistani. I had met Pakistanis before who belittled Jinnah’s contribution or doubted his wisdom but never before had I met a Pakistani who actually thought that he was not Muslim. Dr. Shahid sure was special. Short as our interaction was, I never forgot Dr. Shahid’s words and was hence never able to take him seriously. When he got his own show on ARY, I found it little different from Bill O’Reilly’s The O’Reilly Factor on FOX News. He was good at only one thing—sensationalizing issues, most often in the context of Islam versus the West or religious Muslims versus secular Muslims. Certainly there are issues in both those areas, but Dr. Shahid’s shows, barring occasional exceptions, lacked cogent analysis or appropriate cross-questioning, and played only to peoples’ emotions. I was therefore quite surprised when GEO took him on in a senior capacity. But I suppose sensationalism works and ratings attest to it.

In any case, when after a relatively short stint at GEO, Dr. Shahid has (literally) arrived at PTV, I am not in the least bit surprised that Dr. Shahid took the job but do wonder if the government knows what they have gotten themselves into. Previous PTV chairpersons were at least well-read individuals who knew Pakistan’s history empirically. Of course PTV has always towed the government line but many PTV-groomed journalists have cleverly and intelligently pushed limits to get closer to the truth. I am afraid that Dr. Shahid is not motivated by this journalistic ethos and his very opinionated (meray mutabiq) and almost jingoistic style is bound to clash with the government’s sooner or later, and for all the wrong reasons. PTV has trained some of Pakistan’s best journalists, people like Talat Hussain of Aaj TV, and so many others. In spite of the fact that PTV’s approach was biased and skewed, it still had some visionary leadership that promoted learning and was meritorious enough to throw up talent that was later poached by the private channels. But with Dr. Shahid, objectivity and competence may no longer matter at all as it will be my way (meray muttabiq) or the highway. Looking at it another way, in the past, for those Pakistanis interested in making their mark through electronic media there was no option but to go the PTV route.

Therefore, by and large, those who opted for PTV were not doing so out of any loyalty to the establishment, but because that was the only outlet for their career aspirations. But today, with a mushrooming of private channels, choosing to go the PTV route, at least in as senior a capacity as Dr. Shahid’s, raises serious red flags with respect to his intentions and credibility. In the run-up to his PTV offer, Dr. Shahid did a series on army generals who had held important portfolios but were now keen to speak out against the regime. The idea was a good one, for anyone who believes in transparency must acknowledge that the ways of the military and their post-retirement affiliations often go un-scrutinized. Yet, Dr. Shahid it appears was not interested in seeking the truth but only concerned with the spin, ensuring that he got the guests on his show only because he failed to cross-question them about their own potentially dubious roles in the past. By only showing one side of these critical matters that deserve the utmost scrutiny and objectivity, Dr. Shahid sent the right message to the establishment: I am danger man, court me or fear me.

His approach was structured to achieve the maximum personal gain for himself, not for his viewers. And in that he has been highly successful. His salary, variously quoted at Rs. 700,000 to Rs. 1,000,000 a month may be well deserved if the journalist in question is exceptionally good and working at a private network, but for PTV to pay that kind of money on taxpayers’ expense at a time when poverty worldwide and specifically in Pakistan is reaching new heights is in extremely poor taste. There is little doubt in my mind that this money, which rightfully belongs to the citizens of Pakistan, is being used to fund a man known for his ability to spin whose job it will be to work against the interests of the very people who are forced to fund him. The silver lining to all this is that it may not matter as much because the private media has come a long way. With competent journalists like Talat Hussain, Kashif Abassi, Nusrat Javed and Mushtaq Minhas around, perhaps the damage that Dr. Shahid can inflict may yet be contained.

LAHORE: Noted TV show host Dr Shahid Masood is surrounded by yet another controversy after the surfacing of allegations regarding his role in forcing Dr Shazia Khalid out of the country. Shazia had alleged that an army officer had raped her in a hospital while she was serving in Balochistan in 2005. The controversy is associated with an email circulated with the name of noted defence analyst Dr Ayesha Siddiqa. The email said Dr Shahid Masood and another person, Mohsin Baig, harassed Dr Shazia, warning her that she and her family would be assassinated if they did not leave the country immediately and if the proceedings of her case were not halted in Pakistan. Dr Shazia was quoted as saying that Dr Shahid and Mohsin Baig made her rush out of the country. Daily Times tried contacting Dr Shahid a number of times for comments, but failed to get through. British refusal: Also, documents obtained from reliable sources in the British Home Office revealed that Masood was denied asylum in the United Kingdom for fraudulent practices.

According to the documents, he travelled to the UK on April 26, 2000, with his family. Masood sought asylum in Britain on May 3, 2000, but his request was denied by the British authorities who stated, “On June 9, 2000, a decision was made to give directions for his removal from the United Kingdom as mentioned in Section 16(1) of the Immigration Act 1971 and to refuse to grant asylum under paragraph 336 of HC 395.” Paragraph 336 of HC 395 authorises British officials concerned to remove any individual who enters the UK illegally. While giving the reasons for the rejection, the authorities wrote, “He claimed to have entered the United Kingdom on April 26, 2000, using a Pakistani passport of which he was not the rightful owner, accompanied by his daughter and his sister and her two children.” Dr Shahid attached a statement of evidence form SEF3 dated May 16, 2000, asylum interview record SEF4 dated June 5, 2000, and other documents supporting his application. Former PTV chief Dr Shahid Masood. — File - ISLAMABAD: The Pakistan Television Corporation has served legal notice on its former chief Dr Shahid Masood for recovery of Rs5.1 million which he had to pay as per his contract before leaving the organisation. Acting Secretary Information and Broadcasting Mansoor Sohail informed the Public Accounts Committee (PAC) on Tuesday that on May 27 the PTVC had sent the legal notice to the former PTV managing director, who also held the additional charge of its chairmanship for some time. The issue came before the PAC when it was scrutinising the ministry’s audit report for the year 2008-09. The cabinet secretariat vide its notification dated June 21, 2008, appointed Dr Shahid Masood as managing director of PTVC with the additional charge of chairmanship. He assumed the charge on the same date. As per appointment letter dated June 27, 2008, his contract period was five years and in case of early termination of the contract a notice of six months was required from either side or gross salary in lieu thereof. The gross salary of the officer was fixed at Rs850,000 per month.

Dr Masood tendered resignation which was accepted by the prime minister with effect from November 3, 2008. The officer did not serve the notice of six months and, therefore, was liable to pay the gross salary amounting to Rs5.1 million in lieu of the notice period. The irregularity was reported to the management on April 2, 2009, and to the ministry on June 1, 2009. PAC Chairman Chaudhry Nisar Ali said when it came to public money no favour should be done to anybody; therefore, the committee backed PTVC’s decision to serve legal notice on Dr Masood. Commenting on the overall working of the information ministry, the PAC chairman said the ministry was keeping its various operations secret which over the years had cast shadow over its affairs. Accepting that the ministry during PML-N’s two terms in power also remained involved in such activities, Mr Nisar called for a serious re-examining of its working. “Until this day, I am unable to understand why the ministry keeps a secret fund,” he said, warning that next time the PAC would like to know each and every penny spent by the ministry.

PTV FOUNDATION: The PAC directed the secretary information, who is also chairman of the PTV, to wind up its foundation whose affairs over the years had gone from bad to worse. Mr Sohail informed the committee that since taking over the charge of the ministry, he had a couple of meetings with the foundation’s board of directors and found it was not a viable option. In response, the PAC chairman said the committee also recommended the same and was willing to extend help to the PTV administration. The PTV board of directors in its meeting held on August 28, 2001, had approved incorporation of the PTV foundation. As per its charter, the foundation was established to carry on the business of advertising, publishing, film making, drama production to establish, operate studios, theatres and other institutions for the promotion of science, art and culture. So far the foundation has consumed Rs30 million loaned money but failed to start even a single project. It is very strange that during any self-created Crisis by Musharraf {e.g. Dr. Shazia Rape/Baluchistan insurgency}, Dr Shahid Masood ‘found’ himself in the centre of it e.g. nobody had that access to Dr. Shazia, Akber Bugti, Attaullah Mengal and Bugti’s grandson Brahamdagh Bugti like Dr Shahid Masood. You might have noticed that when the Parliamentary Team wanted to go to meet Bugti in Dera Bugti, Baluchistan the Pakistan Armed Forces refused clearance but isn’t it strange that Dr. Shahid ‘successfully’ conducted detailed interviews of Bugtis and not only that he recited letters from Dr. Shazia and even if that was not enough he travelled with Dr. Shazia and her husband from Islamabad to London or Dubai. Not a single noted journalist in Pakistan was successful enough to meet with Dr. Shazia while she was in impregnable security in Karachi. But years of blind following of everything we are told, we have become so pathetic that nobody questions as to why there is always Dr Shahd Masood in the middle of conspiracy created by General Musharraf?

Dierty role of Dr Shahid Masood: Q. How did you end up in the UK?

Dr Shahid Masood and Mohsin Baig came from Islamabad to see us in Karachi. They told us they had met with the high authorities there and that we had no choice but to leave Pakistan as our lives were in danger.

They asked us where we wanted to go. We argued that we did not wish to leave, but they insisted our lives were in serious danger and we could not stay in Pakistan. We said Canada was the logical choice. I have a sister-in-law and a brother-in-law and family friends there, but I had never been out of Pakistan before. So they brought us the forms for Canadian immigration which they said they would submit on our behalf. Not much time had passed since the incident so I was still in shock. Dr Shazia Khalid is the victim of the much-publicised Sui rape case that precipitated a bloody confrontation between the Bugti tribesmen and the Pakistan Army in January 2005. The people of Sui town were almost unanimous in their belief that Shazia was raped by Captain Imaad, an officer in the contingent of the army’s Defence Security Guards unit posted at the gas installations of the Pakistan Petroleum Limited (PPL) in Sui. However, General Pervez Musharraf denied the claim, insisting that Imaad was innocent. This gave rise to speculations that Shazia may have been a pawn in a conspiracy by antisocial elements to malign the Pakistan Army. Even so, the most glaring feature of the episode were the attempts by the PPL management and the security agencies to thwart the investigation. No headway was made in the case until the evidence was destroyed, leading to suspicions that the authorities were sacrificing transparency in order to protect the image of the army. REFERENCE: “How can they conduct an investigation when they have destroyed the evidence?” By Dr. Shazia Khalid http://www.dawn.com/herald/sep05.htm

KARACHI, Feb 3: The role of the Pakistan Petroleum Limited was disappointing in the alleged rape case in Sui, the husband of Dr Shazia Khalid said in an interview with Dawn here on Thursday. Khalid Aman, a petroleum engineer working for a Chinese petroleum company in Libya, accused PPL officials of putting pressure on her wife to keep silent on the alleged incident. She was advised to call it a simple robbery incident. He said that even the brother of the doctor was not informed about the incident on the day it took place and told about it only after Dr Shazia was taken to Karachi from Sui and admitted to a psychiatric hospital three days later. Mr Aman said that the PPL management had also advised the brother not to pursue the rape case and just have a robbery case registered. Mr Aman said: "We need justice and want the man responsible to be arrested and punished in accordance with law."

About his wife being declared a 'kari', Mr Aman said: "We belong to Khuhra Town, taluka Gambat, district Khairpur. My wife's family migrated from there to Karachi some 40 years back. My grandfather lives there and he has been putting pressure to declare Dr Shazia as a 'kari' and that I should part ways with her. I am with my wife but she was very disturbed after his statements appeared in a section of press and we now feel insecure." Mr Aman denied that a jirga was held at his native town and said there were just some statements from his grandfather that were published in a section of the press. Recalling the night between Jan 2 and 3, Mr Aman said his wife was on call and had left her room at around 7.30pm on Jan 2, taken a round of the ward, and came back to her room after half an hour. She offered her prayers, watched TV, and went to bed by 10pm. He quoted Dr Shazia as saying: "I was fast asleep when I felt someone pulling my hair. I woke up and got frightened. Somebody grabbed my neck and did not allow me even to move.

I managed to pick up the receiver of the phone on the bedside table, but he snatched it from my hand, hit my head with it, and tied my wrists with the telephone wire. He also made a noose round my neck with the telephone wire and tightened it so that I had a problem in breathing. "I resisted but he overpowered me. I then begged him to leave me for the sake of Allah. I asked him as to what my fault was and why was he doing this to me. He ordered me to keep quiet otherwise a man was standing outside with kerosene and he had a matchbox. He said if I raised an alarm, he would set me on fire. I could not see him as it was dark and he had blindfolded me with my dupatta. He beat me brutally, then assaulted me and wrapped me in a blanket." Mr Aman said that after an hour, the intruder again assaulted his wife. The doctor begged him again to leave her alone. The man replied: 'It is now 3 o'clock and I will leave in the morning.' He ordered her to keep silent. He asked for cash and jewellery from her, and she told him that the cash and jewellery were in the cupboard.

She heard the sound of the cupboard being opened. She again asked him to leave her room but he did not say anything. After a while, she heard the sound of a match being struck. She got afraid of being killed and started reciting the kalima and other Quranic verses. She again begged the man to spare her and said: "You have destroyed my life, now why are you setting me on fire?" Mr Aman said that according to his wife, the man did not reply and she heard some sounds from the bathroom. Then the TV was switched on and she heard channels being changed. The man watched TV till the Fajr call to prayer. She heard the outer steel gate being opened and closed. She remained in bed for 15 to 20 minutes and then tried to compose herself.

She removed the covering from her eyes first with her tied hands and later she managed to cut the telephone wire with a pair of scissors. She unlocked the door as her keys had not been touched. She went straight to the nursing hostel and knocked on the door of a nurse, Sakina. Sakina's husband opened the door and found the lady doctor badly injured. Sakina then informed the administration of the PPL and the DCMO, Dr Mohammad Ali, Dr Irshad, Dr Saima Siddiqui, nurse Firdous and Salimullah came to see her in Sakina's room. She asked them to call her brother and his wife and she would tell them everything. She was told that they could not be called to the Sui gas field. The chief medical officer, Usman Wadha, advised her not to report anything as the defence security guards (DSG) and police would investigate, and she would have to appear in court and it would lead to a lot of hue and cry.

She was later given an injection and she became drowsy. She was told not to see anyone. She was kept in Sakina's room and not in the hospital and even her injuries were not treated. On the night of Jan 4, Dr Irshad and his wife took Dr Shazia to Kandhkot, where they stayed overnight and in the morning of Jan 5, she was shifted to a psychiatric hospital in Karachi, her husband said. Later, her brother was informed, and on Jan 11, Dr Aman said he came to Pakistan from Libya when an examination was conducted. He said Dr Shazia had joined the PPL Sui gas field on June 23, 2003. During her interview, she was asked about her husband, and she had told them that her husband was a petroleum engineer. "I was called for an interview and asked if I would join PPL if I agreed to be posted at Sui. I expressed my happiness over this, but I was not appointed", Dr Aman said. "The company on one way or the other refused all the time whenever I applied for a job and finally I got a job with a Chinese company on June 23, 2004. I was first sent for training to Sudan for two months and then to Libya." 11 - Sultan Ali Lakhani & family Pakistan Ranking: 9 (tied at 9) Worth: £400m ($800) Industry: Businessman

The Lakhanis are currently having a hard time at the hands of NAB. Sultan Lakhani and his three brothers run this prestigious group and the chain of McDonald’s restaurants in Pakistan. NAB has alleged the Lakhanis of having created phoney companies through worthless directors and raised massive loans from various banks and financial institutions. Sultan is currently abroad after having served a jail term with younger sibling Amin, though the latter was released much earlier. NAB had reportedly demanded Rs 7 billion from Lakhanis, but later agreed they pay only Rs 1.5 billion over a 10-year period. Lakhanis, like their arch-rivals Hashwanis, are the most well-known of all Ismaeli tycoons. Their stakes range from media, tobacco, paper, chemicals and surgical equipment to cotton, packaging, insurance, detergents and other house-hold items, many of which are joint ventures with leading international conglomerates. Though Lakhanis are in turbulent waters currently, the success that greeted them during the last 25 years especially has been tremendous. They have rifts with large business empires despite being known fur their genteel nature. Whether it is any government in Sindh or at the Federal level, Lakhanis have had trusted friends everywhere, though the present era has proved a painful exception. NAB in tight corner as businessmen refuse to pay dues By Kamran Khan - Two important business families of the provincial metropolis who had earlier agreed to pay about Rs1.8 billion to the National Accountability Bureau (NAB) and various banks - an offer that won them an immunity against allegations of financial impropriety and release of their key directors from prisons - have reneged on their promises. The defiant businessmen, senior NAB officials concede, currently constitute the single most important challenge to their drive against white-collar crime in the country. Senior NAB officials have confirmed that Sultanally Lakhani and his three brothers, who partly run and operate the Lackson Group of Companies, and the Mcdonald’s food restaurants in Pakistan, after two initial payments of Rs100 million each, have stopped further payments for an agreed amount of Rs1.5 billion.

The NAB had alleged that the Lakhani brothers created phoney companies through worthless directors and raised massive loans from various banks and financial institution. Similarly, Irfan Iqbal Puri, Karachi’s leading supplier of petroleum products from the Gulf countries, has refused to match the agreed amount of Rs300 million after an initial payment of Rs230 million to the NAB. Puri, the NAB had alleged, compromised the quality and quantity of petroleum products in supplies to the Pakistan State Oil and caused huge financial loss to the national exchequer. Sultanally Lakhani, who was jailed for about nine months, and Irfan Puri, who had spent almost an equal amount of time in the NAB and jail custody, have since left the country and have taken up residence in the United States and the United Kingdom. Their attorneys have challenged the signed deals with the NAB claiming that the deals were signed under duress. Circles close to both the persons said that if the "businessmen are harassed in this country you can not stop negative impacts". "We are initiating fresh probe and action against the Lakhanis and Irfan Puri," said a senior NAB official. "The NAB will make sure that they stand by their agreements. We can’t allow people to hoodwink the NAB." A present official of the NAB said that in the past the Bureau had brought historical achievements and brought back large amount of looted money. A big and highly reputed entrepreneur, who knows much about Lakhani’s case, while talking to The News categorically said that it was sheer injustice to those businessman who were law-abiding and doing their business honestly and making some achievements by working hard day and night. He said that a businessman obtained loans of billions of rupees, invested it in his business by some other name, earned a lot of profit, multiplied his wealth, brought new products in the market but declined to return the loan, and when he was caught he was given ten years more to pay back the loan in instalments. What are the laws of this country that when this person again defaulted no one is making it point that till the time he was caught, how much he had expanded his business and how many products he had introduced using these loans, he said. He said that it would not be surprising that he would again be given the facility of repayment in instalments for further many years and these episodes would go on. When asked about remedy, he said that it would be fair that the amount due on such defaulters be secured by confiscating their business units of equivalent value plus interest and selling these in the market. He added that it was injustice with other businessmen and the country to give any concession to such habitual defaulters who were continuously expanding their business and bringing new products in the market and not paying back heavy loans by bringing up the plea that they were in loss in the company for which the loan was taken. "It’s a fraud with the nation," he said.

On the other hand, various legal experts are wondering if the NAB had foolproof cases against the accused businessmen, why did the NAB top brass left big legal holes in their deals with the businessmen who somehow managed that the NAB make no official mention of the specific charges against them and the entire evidence collected in the course of investigation be "dismembered". Sultan Lakhani and his brother Amin Lakhani, who is also Honorary Consul-General of Singapore, were arrested on May 8, 2000 by the NAB wing of the ISI. Amin was released after a few days, but Sultan spent another nine months in various NAB detention centres and Adyala prison before his lawyer and the present Attorney-General of Pakistan, Makhdoom Ali Khan, reached an agreement with the then NAB chairman. NAB officials privately concede that in case of Sultanally Lakhani and other key directors of the Lackson Group of Companies, the then NAB leadership had not applied the legally tenable practise of plea bargain and instead had decided to supervise a memorandum of understanding (MOU) between the Lakhani brothers and various financial institutions. They further said they were looking that how such a deal had been made. Was there a helping hand or was it done innocently?

Sliding down from its initial demand of Rs7 billion, the NAB agreed with Makhdom Ali Khan advocate of the Lakhani brothers that they pay an amount of Rs1.5 billion to the lenders in 10 years. The NAB agreed that in the MOU that the Lakhani brothers would not accept any guilt in the document and instead the MOU would reflect them as buyers of assets of nine companies in exchange for the payment of liabilities. The NAB had found, in its investigation, that all these companies were actually front for the Lakhani brothers, who consistently denied the charge. Furthermore, the NAB agreed to withdraw its reference against Sultan Lakhani and various co-accused, including the senior executives of the Industrial Development Bank of Pakistan who had extended the loans without proper securities and background checks. The NAB investigators were also asked to stop probe against nine other companies of the same group. The investigators were also told to return the collected evidence to the respective financial institutions. The accused persons who benefited from the NAB deal included Sultan Ali Lakhani, Iqbal Ali Lakhani, Zulfiqar Ali Lakhani, Amin Muhammad Lakhani, Sahibzada Naushad Ahmed, M Muneer Adenwalla, Hassan Ali Merchant, Tasleemuddin Batlay, Aziz Ebrahim (Lakson Group), Anjum Naveed (General Manager M/s Project Development Services), Muhammad Sirajul Hassan (former chief officer at Industrial Development Bank of Pakistan’s regional office in Karachi), Khalid Mehmood Nagra, Syed Mehboob Hussain (office in-charge of the IDBP) and Rehan A Siddiqi (Manager Documentation Department of IDBP, Karachi. NAB officials said that after much pressing the Lakhani brothers had only paid Rs200 million and were now clearly avoiding the payment of remaining Rs1.3 billion. Irfan Iqbal Puri, who used to be a key middleman between the country’s top buyers of petroleum products and the Middle Eastern suppliers, made the single largest payment of Rs235 million to the NAB following his three-month-long interrogation by the NAB investigators, who apparently confronted him with the evidence allegedly showing kickbacks and commissions received from the Middle Eastern suppliers, who allegedly compromised quality and quantity of petroleum products sold to Pakistan.

At the time of his release Puri, NAB officials said, pledged to pay a total sum of Rs300 million, but subsequently he refused to make the final instalment of Rs65 million and instead confronted the NAB with a lawsuit claiming the return of Rs235 million that he had already paid to the NAB. In Puri’s case the NAB downplayed its agreement with him to an extent that no official announcement was made about the plea bargain deal. At the same time, the NAB withheld its evidence and findings against Puri from any public and legal scrutiny, a measure that has now become the strongest argument in the Puri’s case against the NAB. NAB officials said that the plea bargain deals are meant to recover the looted money in exchange for some grace to the accused persons who get the benefit of not going through the public trial and exposure of their misdeeds in public.

But the process is attracting some criticism, as it allows the senior NAB officials to exercise their discretion in settling the amount for the plea bargain. In Irfan Puri, Usman farooqi and Admiral Mansurul Haq cases the money recovered by the NAB may match their ill-gotten wealth, but in some cases some key suspects won their freedom at a cheap cost. For instance Huzoor Buksh Khalwar, a former Karachi Metropolitan director, who was arrested after a NAB investigation found that he had allegedly amassed wealth to the tune of hundreds of millions of rupees, was set free after a brief (according to the NAB standards) three months’ confinement and a nominal payment of Rs16 million. Khalwar was one of the beneficiaries of a Rs600 million octroi fraud unearthed in the KMC in 1998. NAB officials privately acknowledged that the plea bargain deal with Khalwar could not be counted as one the best deals the NAB has struck with the country’s most corrupt bureaucrats.
