Qazi Hussain Ahmed quotes Blasphemous Mawdudi.

ISLAMABAD: The Supreme Court has converted the letters of Justice (R) Wajihuddin Ahmed, Qazi Hussain Ahmed and Muhammad Hussain Mehnati against obscenity and vulgarity on the media into a petition and issued notices to chairmen PTA and Pemra and has fixed it for hearing on July 27, 2012. The petition is marked 104/2012 and the case will be heard in the open court on Friday. The SC order issued on Wednesday titled “Regarding control of obscene and other objectionable material carried in the media” reads: “Take notice that three separate letters were received from Justice (R) Wajihuddin Ahmad, Qazi Hussain Ahmad, ex-Ameer Jamaat-e-Islami Pakistan and Muhammad Hussain Mehnati, Ameer Jamat-e-Islami Karachi on the subject cited above and on placing all these letters before the honourable Chief Justice of Pakistan. His lordship was pleased to call reports from chairman PTA and Chairman Pemra. After perusal of the said reports, the honourable Chief Justice of Pakistan was pleased to pass the following order; ‘Treat this matter as petition under article 184(3). Put up in court. Notice to attorney general, chairman Pemra and to petitioners be issued for 27.07.2012.’ “Take further notice that the matter has been registered as the Constitutional petition No 104/2012 and is fixed for hearing on 27.07.2012 in Court House Islamabad.”The major issues regarding obscenity highlighted in the petition involve airing of illegal Indian channels through cable network, obscene and vulgar dramas on Pakistani channels, immoral advertisements on TV channels, illegal CD channels distributed by cable networks in connivance with Pemra, and in particular the entertainment segments in the news bulletins on Pakistani news channels.

Following complaints from the two respected public figures, the Human Rights Cell of the apex court, following CJ’s direction, had sought views from chairman Pemra and chairman PTA, both of whom have given routine bureaucratic responses without any concrete assurance that the menace would be effectively checked and controlled. Chairman Pemra in his response to the Supreme Court wrote: “The local market is flooded with smuggled and pirated CDs, DVDs, decoders, dishes and cards, which are proliferating obscenity through broadcast media and distribution service. On its part, Pemra took action against distribution and sale of illegal decoders and seized the equipment of Zee TV package. This action was challenged in the Lahore High Court (LHC) and the court was pleased to suspend the seizure. Consequent to which Pemra had to return the equipment. Nevertheless, Pemra has not stopped its efforts in this regard. It may kindly be appreciated that Pemra cannot fully eradicate this menace and it will only be possible with coordinated efforts of all other relevant agencies as well.” It is important to mention here that whenever the Supreme Court takes up the issue of obscenity and vulgarity some objectionable Indian TV channels are closed for a few days but they stage a comeback. Even on Wednesday when the Supreme Court issued this latest order and fixed the case for Friday, sources told The News that Indian TV channels were closed in some big cities. Sources say a huge amount of money is involved in allowing illegal CD channels, distribution of illegal Indian TV channels and in many other similar illegal acts. Jamaat e Islami By Sheikh Tauseef Ur Rehman

A BRIEF HISTORY OF THE MAUDUDI CALAMITY Translation of an editorial by Maulana Yoosuf Banauri in the Rajab 1396 Issue of the 'Bayyinaat' : - In order to master any subject, it is incumbent that one remain in the company and benefit from the master of that subject. It is an accepted fact that for any simple or artistic occupation a teacher or even a guide is necessary. Without these even an intelligent and genius cannot reach the desired stage, be it in the fields or engineering, medicine, or any other subject for that matter. For every occupation or trade it is necessary and incumbent that one should at least learn the basics from a teacher. In this manner when it is necessary to seek knowledge and guidance in materialistic fields, how can it be possible to attain the Uloom of Nubawwat - Teachings of the Ambiyaa Alaihis salaam. - and the intricacies of the Shari'ah without the guidance of tutor? The sciences of this nature are beyond the grasp of human intelligence. They have reached the Ummat through the Wahi (revelations of the Al-mighty, and continues through heavenly training, rearing, divine commands, instructions and guidance. Then in these Divine Sciences the attention and considerations of the tutor and guide; and the practical participation in his company has a more important bearing than words. The attaining of correct thinking, understanding and practical Tarbiyah (rearing) is more important than only attaining knowledge. On that ground, the longer the companionship of a master, the more benefit and experience one will reap. The more perfect the tutor, the more benefit and excellence will be attained. As the purpose of the Uloome Nubuwwat is the guidance of the creation of Allah, in its understanding, there is a strong probability, through the enmity of the accursed Shay- taan, to be led astray. The Shaytaan does not interfere where one strives to attain perfection in material aspects. The Shaytaan sits in comfort. He does not need to interfere, nor is it necessary for him to show his enmity. However, where the hereafter and religion are concerned, the Shaytaan becomes restless in creating mischief. He uses his strength in every possible manner, where success and Hidaayah may be turned into ruin and to cause deviation from the straight path. The greatest asset of the accursed Iblis is 'Talbis', that is to mix the truth with falsehood in such a manner, that where a thing outwardly appears to be beneficial, in reality it becomes a source of wrong doing and detriment. Then too bearing in mind that the tricks of the human Nafs supercedes this. it is human nature to be arrogant, haughty, deceptive, showoff and have love for rank and high status. These are such diseases that it is difficult to eradicate them even after lengthy training and discipline.

For this reason it is incumbent to remain in the companionship of a master for quite some time, in order to save oneself from the effects of the Shaytaan.

If Allah's grace and mercy are present, then surely one reforms, other-wise, the human just wanders around in the desert of knowledge and intellectualism. After studying the Educational History of the world, this point becomes very clear that all the mischief and chaos that were created, were all at the hands of intellectuals and geniuses. During the period of Ilm (knowledge) a greater portion of fitnah (mischief) appeared by the way of ilm. Even among the Ulamaa E Haq, many geniuses due to their sharp intelligence and eccentricity became victims of their wrong thoughts and ideas. This fact became evident that by completely relying on their own acuteness and flowing intellect, they became entangled in llmi Kibr (educational arrogance), and self-conceited of their own views. They were not fortunate enough to undergo a beneficial amount of spiritual training. As a result, this led them to great lengths. In our times there exist many such examples. Since they possess llmi acumen and, as many a time they say or write excellently, they become a cause for additional fitnah. Those individuals who were not fortunate enough to attain a deep knowledge or a spiritual training, easily become their adherents and quickly begin supporting and endorsing their new ideologies. The Shaytaan is always busy in his occupation. A personality that may be of use to guide and direct the Ummah, becomes a means of deviation and ruin for the Ummah. There are examples of these in every era. Imaam Ghazali Rahmatullahi alaih has written in his 'Maqaasidul Falaasifah' that after observing the correctness in the elementary and mathematical sciences of the Greeks, the people began to accept all their teachings as correct. They accepted the teachings of the Greeks even in the subjects of Theology and natural philosophy, which led them astray. These words of Imaam Ghazali are very surprising and true. The Shaytaan finds in these Situations an ideal opportunity to lead people astray. Well, when the very learned, geniuses and capable people can become entangled in such fitnahs, then those personalities who possess very little llmi capabilities and have a tremendous ability to write, and are quick witted and intelligent, but void of a spiritual training under an accomplished master they very quickly become engulfed in self-conceitedness and begin to degrade the Ummah. All the scholarly researches of the Ummat are despised; all the great deeds of the salaf-us-saaliheen are made a joke of and a laughing stock; and by criticising every personality from beginning till the end, falls in a deep and dangerous pit, becoming a means of leading all humanity into destruction. Among such people today is a famous personality by the name of Janab Abdul A'laa Maududi Saheb, Maududi was born on Rajab 3, 1321 AH (September 25, 1903 AD) in Aurangabad, who was acute and quick witted since childhood, but was troubled by economic difficulties. In the beginning he was employed by the 'Medina periodical at Bijnor. Thereafter, he was attached to the "Muslim', a magazine of the Jamiat Ulama e Hind. After a few years he was employed by the 'Al-Jamiat', Delhi, a journal of the Jamiat Ulama e Hind, Which was then probably published every third day. His articles captioned 'Tarikh ke Jawaahir Paaro' appeared with great lustre. In this manner Maududi Saheb was trained as a writer by Maulana Ahmed Saeed Saheb. After the death of his father Maududi Saheb was unable to complete his studies, but had to leave studies during the early Arabic primary stages, nor was he fortunate enough to attain a secular education. He later studied English and attained some competence in it. He greatly benefited from the books, magazines and writings of reputable authors of those days. His writing ability increased by the day. Unfortunately he was unable to benefit from any religious institution, neither became a graduate of modern education, nor did he gain the company of an experienced and proficient Aalim of the Deen. He has admitted this in an article published during the era of United India in reply to some questions posed to him by Maulana Abdulhaq Madani Muradabadi. He was unfortunate to experience the company of Niyaaz Fatehpuri, an atheist and infidel.

By this association and friendship many incorrect tendencies and inclinations were adopted. In 1933 he began publishing the 'Tarjumanal-Quran' from Hyderabad, Deccan, wherein he published splendid articles. Some llmi and literary things began to appear using the best style and methods. At that time the political situation in the country was very shaky. The movement to free India was in its decisive stages. The best intellectuals of the country were involved in the freedom of struggle of India from the British Maududi Saheb adopted a different stand from the rest and engendered the cry of 'Iqaamate Deen' and 'Hukumate Ilaahiyyah'. He strongly and forcefully criticised all the factions invloved in seeking the freedom of India. His simple and innocent panegyrists thought that Maududi Saheb was the last straw for the valuable Deen. As a result very quickly praises began to be showered upon him from the pens of Maulana Sayyid Sulayman Nadwi, Maulana Manaazir Ahsan Gilani and Maulana Abdulmaajid Darybadi. Evidently at that time Maududi Saheb was only a name of an individual. As yet he had no missionary aim, nor an association or movement. Due to his forceful writings and statements, some among the Ahle Haq began having great hopes in him. By virtue of his preparedness and through the encouragement of Chaudary Muhammad Niyaaz, the foundation of 'Darul Islam' was laid in Pathankot. The Muslim League and Congress began to be degraded.

Such articles were written by him, as well as a book on the political turmoil of the time appeared whereby he began receiving praises from his followers. The political causes stimulated its acceptance. A meeting was held in Lahore, and the foundation of his Imaarat was formally laid. A speech prepared by him was read out, wherein the duties of a present-day Ameer were outlined. Among the participants were also such famous personalities as Janab Maulana Manzoor No'mani, Maulana Abulhassen Ali Nadwi, Maulana Amin Ahsan Islaahi and Maulana Mas'ud Aalam Nadwi. Maududi Saheb was elected the Chief Ameer and the above mentioned four personalities were elected deputy Ameers. The Jamaa'at e Islami formally came into existence. It's constitution and charter were published. The public looked forward to it and from every side hopes began to be attached. Six months had not passed by when Maulana (Manzoor) No'mani Saheb and Maulana Ali Mia Saheb (Abulhassen Ali Nadwi) resigned. They have observed his llmi deficiencies and lack of sincerity. They were unable to continue their relationship. These gentlemen kept silent and did not inform the Ummah openly and clearly about their reason for disassociating themselves. I was at that time teaching at Jamia Alma Dabhel. I inquired from these two personalities about their reason for quitting. They said many things but no satisfactory clarification was delivered. I understood the view of Marhum Maulana Mas'ud Alam and Maulana Amin Ahsan Islaahi were quite similar as far as beliefs and conduct were concerned. Hence they remained for some time as Maududi Sahebs right hand men. Maulana Mas'ud Aalam assisted through the medium of Arabic literary writings and magnificently translated into Arabic the writings of Maududi Saheb. He also trained a few pupils in this field. Maulana Islaahi through his special style and way assisted the Maududi Movement. As a result many good writers and assistants joined the movement. A few excellent books were written on communism and a few other subjects i.e. interest alcohol purdah. etc. A few good books were also written for the modern youth. Some worthy articles were published in the 'Tafheemaat and Tanqeehaat'. Ways and means were adopted to impress the Arabs especially the Sheikhs of Saudi Arabia.

Successful strategies were adopted. All those writings that were contributed by Maududi Saheb's associates were published in such a manner as if all these writers were indebted to him. As a result the personality of Maududi Saheb gained fame. He reaped fame from the writings of his associates. He is incapable of composing in Arabic or English. The names of translators do not appear on his books that are translated into other languages. It is not mentioned that this book is translated by Mas'ud Aalam or Aasim Haddaad. People get the notion that this literary intellectual of the Urdu language is also an Imaam of the Arabic language. A short period had passed where Maulana Gilani Saheb and Sayyid Sulayman Nadwi Saheb became aware and foresaw its detrimental effect; that these writings were a means of creating a new fitnah. He (Maulana Gilani) ceased to address him by the titles conferred on him such as 'Mutakallim e Islam' etc. Maulana Gilani Saheb wrote critical articles under the headings of 'Khaarijiyyate Jadidah' Maulana Daryabadi's 'Sidqe Jadid'. Maulana Sayyid Husayn Ahmed Madani Saheb was perhaps the first among the Ulama who pinpointed this fitnah in his Correspondence. Gradually other Ulama began to air their views. Maulana Muhammad Zakariyya Saheb studied all the available printed Maududi literature and wrote a valuable booklet on this subject. It is regretted that this booklet has not been printed yet. In this connection an Ustaaz of Madrasah Mazaahirul Uloom Saharanpur Maulana Zakariyya Quddusi Saheb became inclined towards Maududi Saheb. Taking this into view and trying to correct him Shaykhul Hadith Saheb wrote a letter to him explaining all Maududi Saheb's errors and incorrect interpretations of the Deen.

This letter has been published in a booklet form titled 'Fitnah Maudu diyyat' (It is now reprinted under the title 'Jama'at Islamiyyah ek lamhah fikriyyah').

I admired many things about Maududi Saheb and detested many. For along time I did not wish to degrade him. I felt that from his innovated style of presentation the modern generation could benefit. Although at times such compositions appeared from him that it was not possible to endure it but taking into consideration the Deeni well-being I tolerated it and kept silent. I did not foresee that this Fitnah would spread world-wide and have a detrimental effect on the Arab world; that every day from his master pen a new bud would keep on blossoming and indecent words would be used regarding the Sahabah Kiraam Ridhwanulla-hi Alayhim and the Ambiyaa Alayhimus Salaam. Later on such things appeared daily in the 'Tafhimul Quraan'.

Now it has become known without doubt that his writings and publications are the greatest Fitnah of the present time notwithstanding a few beneficial treatises that have appeared It is the case of "and the sin of them is greater than their usefulness". (Surah Baqarah 219).

Now that stage has been reached where to keep silent seems to be a great crime. It is regretted that for forty years an offensive silence was kept. Now the time has dawned where without fear of rebuttal and censure all his writings from A to Z should be thoroughly studied with a view to fulfill the demands for the preservation of the Deen with Haq and justice. Jang Group, Misuse of Blasphemy Law & Fatwa of Apostasy against Muslims.

LONDON: British Home Secretary Theresa May has said Britain will continue to lobby the Pakistani government for making amendments in the country’s controversial blasphemy laws to prevent more innocent people falling on its wrong side. In a wide ranging interview with The News/Geo TV, the home secretary said she had met the assassinated Punjab governor on a number of occasions and found him to be a moderate and liberal-minded person, who still had a great contribution to make for Pakistan’s progress and she was “appalled” at his murder after the governor campaigned for the release of Aasia Bibi, the Christian woman who is alleged to have committed blasphemy, which she sternly denies. “I was very pleased to meet Salmaan Taseer in October in Lahore and we had a good discussion. His murder should make us all think very carefully on these issues. From our point of view, we have been on a number of occasions — and continue to lobby the government to amend the blasphemy laws so that they cannot be abused,” she said, adding that the proposals made within Pakistan are the sort of amendments required. “The final decision is for the people of Pakistan to make but there is a need for the government to amend the laws so that they are not abused.” REFERENCE: UK calls on Pakistan to amend blasphemy laws By Murtaza Ali Shah Friday, January 14, 2011http://www.thenews.com.pk/TodaysPrintDetail.aspx?ID=3294&Cat=13&dt=1/14/2011

Irfan Shah calls Dr. Tahir-ul-Qadiri a Dalla & Issue Fatwa of KUFR against "Ahl-e-Hadith and Deobandis"

ISLAMABAD: Prime Minister Syed Yousuf Raza Gilani on Thursday told the western diplomats that there was no problem in the blasphemy law but the real issue was the misuse of the law, which the government will not allow. “It is true that some fringe groups had tried to make political capital from the debate about the blasphemy laws. The real issue is the misuse of the law, for that matter any law by anyone and that we cannot allow such aberration to happen,” he said during an interaction with the envoys of western countries at a luncheon meeting at the Prime Minister’s House. The prime minister observed that the tragic assassination of Governor Salmaan Taseer had underscored the imperative need for the Pakistani society to marginalise and eliminate extremist tendencies. In his opening remarks, the prime minister said concerns shown regarding the rights of minorities and rising tendencies in Pakistan had been exaggerated and were not entirely in consonance with Pakistan’s overall national ethos. “First, yes we are Muslims and are proud of being Muslims. Islam is a religion of peace and preaches tolerance. Radicalism and extremism is alien to Islam that emphasizes the middle way”. He said that Pakistani people are moderate, peaceful and progressive in outlook. “The overwhelming majority does not subscribe to the distorted views of some demagogues,” he added. The prime minister mentioned that the Constitution of Pakistan guarantees fundamental rights to all citizens irrespective of caste and creed and practical steps have been taken to empower minorities politically. He said that an instituted mechanism to promote human rights already exists in Pakistan. THE REAL FACE OF PAKISTANI MULLAHS

This is not about blasphemy or the honour of the Holy Prophet. This is now all about politics, about the forces of the clergy, routed in the last elections, discovering a cause on whose bandwagon they have mounted with a vengeance.

The blasphemy issue ignited by Aasia Bibi’s conviction was virtually over in November, the government making it plain that it had not the slightest intention of amending the blasphemy law, and no government figure of any consequence stepping forward to support Salmaan Taseer on the stand he had taken. There the matter should have rested if Pakistan’s clerical armies were not masters of manipulation and cold-blooded calculation. They whipped up a storm in December, when the issue was no longer an issue, and fanned such an atmosphere of intolerance and hatred that it would have been strange if nothing terrible had happened.

There’s a danger of moaning too much. But what with the lionising of Salmaan Taseer’s killer and hailing him as a ghazi and defender of the faith, the impression is hard to shake off that what we are witnessing are the last burial rites of what remains of sanity in a Republic not particularly famous for any striking monuments to reason. No cleric worth the name has refrained from adding fuel to the fires thus lit across the country. But if a prize has to be given to anyone, the honours will go to Pakistan’s path-breaking contributor to political gymnastics, Maulana Fazlur Rehman, and the Amir of the Jamaat-e-Islami, Professor Munawar Hasan (professor of what?...one is tempted to ask).

The Professor is a study in contrasts: soft-spoken, even beguilingly so, and possessing a keen sense of humour but, at the same time, a master of virulence and of confusion spread in the name of the faith. The 2008 elections had laid the Jamaat low. It had made the mistake of boycotting those elections and its performance in bye-elections since then has furnished further proof of its dwindling political relevance. The Jamaat’s exploitation of the blasphemy issue is an attempt to engineer a political comeback, although there’s no altering the fact that its vote-getting ability comes nowhere near its high nuisance value.

But the issue has to be faced squarely. The clerics are on the march not because they are strong but because those on the other side of the divide – the non-clerical forces – are weak, directionless and devoid of vision...without any strategy and plan of battle. Zardari’s vision is to stay in power and further enrich his person and his family. End of story. The common belief is he has enough but, by all accounts, we are dealing with insatiable appetites. Prime Minister Yousuf Raza Gilani’s vision is to enrich his family. If a tenth of the stories doing the rounds are to be even tentatively believed, they are doing pretty well for themselves. Names close to the army high command are also the subject of lurid rumours. But the problem is greater than a few names. Pakistan’s governing class as a whole has earned the distinction of being rotten and corrupt. Everyone rightly-placed is on the take. Those not so fortunate are less emblems of virtue than martyrs to opportunities absent or lost.

A leadership thus tainted, compromised by ineptitude and greed, can neither initiate reform nor reverse the tide of obscurantism now washing against the walls of the Republic. Lest we forget, the armies of the faithful – with their fearsome beards and shaven moustaches, shalwars pulled up over ankles – have never been in power in Pakistan (the MMA’s stint as Musharraf’s co-travellers in the Frontier not really counting in this equation). What Pakistan is today, the depths it has plumbed, the failures courted, the follies assiduously pursued, have been the handiwork of its English-speaking elite classes – who wouldn’t be caught dead calling themselves secular but who, for all practical purposes, represent a secularist point of view. The mullahs have not been responsible for our various alliances with the United States; our entry into Cento and Seato; our militarist adventures vis-à-vis India; and the honing of ‘jihad’ as an instrument of strategic fallacies. This last piece of brilliance came from the army as commanded by Gen Ziaul Haq. Religious elements became willing accessories in this game but were not its inventors.

If the first Constituent Assembly lavished attention on a piece of rhetoric of no practical benefit to anyone, the Objectives Resolution, instead of writing a constitution which was its chief duty, the fault lay not so much with the clerical fathers as with the Muslim League leadership. The phrase ‘ideology of Pakistan’ was an invention of Gen Yahya Khan’s information minister, Maj Gen Nawabzada Sher Ali Khan. The central tenet of our security doctrine which sees India as an implacable foe out to undo Pakistan was woven in no madrassah or mosque but in General Headquarters, and a mindset which has been a distinguishing feature of the Punjabi elite. Our fractured education system is a gift, paradoxically, of our English-speaking classes which have never felt the slightest need for framing a common education policy – the same books and curriculum, the same medium of education – for the entire country. The army, a secular institution to begin with, has ruled Pakistan. The mainstream parties have been in power. Pakistan’s failures are their failures. The religious parties have been the hyenas and jackals of the hunt, yelping from the sides and helping themselves to the morsels that came their way. Lords of the hunt, lions of the pack, have been Pakistan’s generals and politicians, assisted ably at all times by a powerful and equally short-sighted mandarin class. If the misuse of religion, the exploitation of religion for less-than-holy ends, the yoking of religion to unworthy causes – such as our never-ending adventures in Afghanistan – has poisoned the national atmosphere and narrowed the space for reasoned debate, the principal responsibility for that too lies with those who have held the reins of power in their hands. Why could they not have reversed the course of events, especially when it lay in their power to do so? True, Gen Zia’s rule amounted to a visitation from the outer reaches of purgatory. We say he distorted Pakistan, which of course he did. But it is 22 years since his departure, time enough to have healed the wounds he caused and dismantle his legacy. But if the many temples to hypocrisy he erected survive, who is to blame? The Pakistan of today is Zia’s Pakistan not Jinnah’s. But if we have been unable to go back to our founding principles the fault lies not with the zealous armies of the bearded but Pakistan’s secular rulers, in mufti and khaki.

Deobandis and Alahazrat - Syed Irfan Shah

It is not the mullahs who frighten the ruling classes. These classes are afraid of their own shadows. And they have lost the ability, if they ever had it in the first place, to think for themselves. They live on imported ideas and the power of their own fantasies. It is not a question of the English-speaking classes – our so-called civil society with its small candle-light vigils, usually in some upscale market – standing up to the clerical armies. This is to get the whole picture wrong. It is a question of the Pakistani state – its various institutions, its defence establishment and the creeds and fallacies held dear as articles of faith by this establishment – getting its direction right and then creating a new consensus enabling it to retreat from the paths of folly. If the Pakistani establishment continues to see India as the enemy, keeps pouring money into an arms race it cannot afford, is afflicted by delusions of grandeur relative to Afghanistan, and remains unmindful of the economic disaster into which the country is fast slipping, we will never get a grip on the challenges we face. The raging cleric, frothing at the mouth, is thus not the problem. He is merely a symptom of something larger. Pakistan’s problem is the delusional general and the incompetent politician and as long as this is not fixed, the holy armies of bigotry will remain on the march. Blasphemy law applies to all prophets By Ansar Abbasi Wednesday, January 12, 2011
ISLAMABAD: Though never amended in the books of statute as such by successive governments, Section 295-C of the Pakistan Penal Code regarding blasphemy applies to all the prophets. Generally ignored in the ongoing discussions in the media, it is the Federal Shariat Court which in 1991 had ruled that this particular section would apply to all the prophets and that the offence of blasphemy would only entail the punishment of death. Ismail Qureshi, senior advocate of the Supreme Court, religious scholar and the man who fought a long legal battle to get death sentence for blasphemers in the Pakistani statute, told The News that the Federal Shariat Court’s decision got finality after the then government had withdrawn its appeal from the Supreme Court. In talk shows and discussions even some prominent lawyers were heard saying that the Section 295-C is flawed as it does not cover all the prophets. Qureshi explained that after the FSC’s judgment, the Section 295-C would be read in the light of the Shariat Court’s decision. Former Chief Justice of Pakistan Justice (retd) Saeeduzzaman Siddiqi, when approached, endorsed Qureshi’s viewpoint and said that after a superior court’s ruling gets finality, it becomes law no matter whether the concerned law is amended by the government or not. The FSC decision made two key changes in Section 295-C. First, the change is regarding doing away of the punishment of life imprisonment whereas second change covered all the Prophets of Islam. According to Qureshi, the Nawaz Sharif government had initially filed an appeal against the FSC decision but later withdrew when he came to know about the nature of the court’s decision.

In the PPC, the Section 295-C continues to read what it was originally drafted in mid 1980s. It reads as: “295-C. Use of derogatory remarks, etc., in respect of the Holy Prophet: Whoever by words, either spoken or written, or by visible representation or by any imputation, innuendo, or insinuation, directly or indirectly, defiles the sacred name of the Holy Prophet Muhammad (peace be upon him) shall be punished with death, or imprisonment for life, and shall also be liable to fine.” However, later the FSC in 1991 Muhammad Ismail Quershi vs Pakistan through Secretary Law and Parliamentary Affairs (PLD 1991 Federal Shariat Court 10) has penned downed that blasphemy of any prophet should be made punishable with death penalty and judges had also quoted verses of the Holy Quran regarding the respect of holy Prophets.  The selected portions of the FSC judgment are: “It is also to be noted that Allah Almighty creates no distinction or inequality in the status of the Prophets though. He did bestow on some of them more gifts than others.”
While quoting different verses of the Holy Quran, the judgment said, “Practically, all the jurisconsults and scholars agreed that in view of the above verses and the equal status of all the Prophets as such, the penalty of death as determined above shall apply, in case any one utters contemptuous remarks or offers insult, in any way, to any one of them.” The FSC concluded, “In view of the above discussion we are of the view that the alternate punishment of life imprisonment as provided in Section 295-C PPC is repugnant to the injunctions of Islam as given in Holy Quran and Sunnah and therefore, the said words be deleted therefrom.” “68. A clause may further be added to this section so as to make the same acts or things when said about other Prophets, also offence with the same punishment as suggested above.” REFERENCE: http://old.thenews.com.pk/12-01-2011/ethenews/t-3257.htm

JANG GROUP/GEO TV's Exploitation & Tragic Use of Blasphemy Law Against "Deobandi Muslim Imam" of Masjid.

MULTAN, Jan 11: A court has jailed a prayer leader and his 20-year-old son for life on blasphemy charges in the rural heartland of the country, court officials said on Tuesday. The case follows the assassination of Punjab governor Salman Taseer by his bodyguard last week, after he called for reform of the blasphemy law under which a Christian woman was sentenced to death. Mohammad Shafi, 45, and his son Mohammad Aslam, 20, were arrested in April last year for removing a poster outside their grocery shop promoting a religious event in a nearby village. The poster allegedly carried Quranic verses. Judge Mohammad Ayub, heading an anti-terrorism court in Muzaffargarh, handed down a life sentence to the pair on Monday, his assistant Faisal Karim said by telephone. According to the prosecution, the organisers of the event marking the birth anniversary of Prophet Muhammad (PBUH) said the pair had “pulled the poster down, tore it and trampled it under their feet,” Mr Karim said. “The judge sentenced them to life imprisonment on charges of blasphemy and ordered them to pay a fine of Rs200,000 each,” he said. Defence counsel Arif Gurmani vowed to challenge the verdict in the high court because “it has been given in haste” and was the result of inter-sect rivalries, he said. “Both are Muslims. The case is the result of differences between Deobandi and Barelvi sects of Sunni Muslims,” he said. “Shafi is a practising Muslim, he is the imam of a mosque and he had recently returned from a pilgrimage to Saudi Arabia… I am defending them because I am convinced they are not guilty of blasphemy,” he said. Nobody has been executed in Pakistan for blasphemy and those given the death penalty have so far had their sentences overturned or commuted on appeal.—AFP REFERENCE: Court jails imam and son for blasphemy From the Newspaper Yesterday http://www.dawn.com/2011/01/12/court-jails-imam-and-son-for-blasphemy.html

BAHAWALPUR, June 15: A mosque Imam was killed while a religious leader sustained critical injuries in violence caused reportedly by sectarian tension between two Sunni sects in Choonawala Mandi near Hasilpur, about 90km from here, on Thursday. According to reports reaching here, the trouble started when Hafiz Qamar Javed, prayer leader at local Masjid Ahl-e-Hadith, burnt some trash near his mosque. The fire attracted neighbours, including people from the rival sect, who propagated that Javed was burning pages from Quran. Within no time a huge mob turned up at the scene and attacked Javed. When Ahl-e-Hadith’s local leader Master Muhammad Sadiq came to his rescue, he was also beaten up severely. The assailants left the scene when the two fell unconscious. Police rushed to the scene after getting information. In a hurry, a police vehicle hit and injured Muhammad Nadeem (13). The mob then damaged the van and thrashed ASI Muhammad Nawaz, who also sustained injuries. Later, the Hasilpur DSP and tehsil nazim reached Choonawala and managed to disperse the mob. The injured were rushed to the Bahawal Victoria Hospital, Bahawalpur, where Hafiz Qamar Javed succumbed to injuries while Master Muhammad Sadiq was in precarious condition. Following an appeal, Choonawala traders’ president, shopkeepers pulled down their shutters to protest the ‘blasphemous act’. Meanwhile, it was learnt that a case under the Blasphemy Act had been registered against deceased Hafiz Qamar Javed and injured Muhammad Sadiq while no case was registered against the assailants. DPO Arif Nawaz was not available for comments. Pakistan's Road to Disintegration

Interviewee:

In the first few days of this year, Pakistan's coalition government was thrust into crisis after losing a coalition partner, and then a top politician--Punjab Governor Salman Taseer--was assassinated. A leading expert on the country, Stephen P. Cohen, says these incidents are symptoms of the profound problems tugging the country apart. "The fundamentals of the state are either failing or questionable, and this applies to both the idea of Pakistan, the ideology of the state, the purpose of the state, and also to the coherence of the state itself," Cohen says. "I wouldn't predict a comprehensive failure soon, but clearly that's the direction in which Pakistan is moving." On a recent trip, he was struck by the growing sense of insecurity in Pakistan, even within the military, and the growing importance of China.

What's the situation in Pakistan these days, given a key partner's withdrawal from the coalition government, and the assassination of a leading member of the ruling coalition, who opposed the blasphemy law which has support among the country's Muslim population?
These are symptoms of a deeper problem in Pakistan. There is not going to be any good news from Pakistan for some time, if ever, because the fundamentals of the state are either failing or questionable. This applies to both the idea of Pakistan, the ideology of the state, the purpose of the state, and also to the coherence of the state itself. Pakistan has lost a lot of its "stateness," that is the qualities that make a modern government function effectively. So there's failure in Pakistan on all counts. I wouldn't predict a comprehensive failure soon but clearly that's the direction in which Pakistan is moving.
Given Pakistan's possession of nuclear weapons and its strategic location between Afghanistan and India, for the United States this is a looming crisis, isn't it.
Crisis Guide: Pakistan
All U.S. policies toward Pakistan are bad, and some are perhaps worse than others. We don't know whether leveling with Pakistan is going to improve things or make it worse. Ideally, we would own a time machine in which we could roll back history and reverse a lot of decisions we made in the past. Hopefully, we won't make any more fundamentally wrong decisions in the future, but that may not prevent Pakistan from going further down the road to disintegration. Someone in the State Department was quoted in a WikiLeaks document [as saying] that if it weren't for nuclear weapons, Pakistan would be the Congo. I would compare it to Nigeria without oil. It wouldn't be a serious state. But the nuclear weapons and the country's organized terrorist machinery do make it quite serious.
If it is anybody's problem in the future, it is going to be China's problem. I just spent several weeks in Pakistan. One thing I discovered was the country insecurity in a way I had never seen it, even in military cantonments. The other was that China's influence in Pakistan was much greater and deeper than I had imagined it to be. In a sense that's India's problem, but in the long run, it will be China's problem.
Describe China's influence.
China is Pakistan's major military supplier. Of course, they supplied military technology and probably put Pakistanis in touch with the North Koreans for missile technology. The Chinese have one concern in Pakistan and that is the training of Chinese militants and extremists inside of Pakistan. The Chinese have no problem with the Tiananmen Square-type of crowd control. When the Lal Masjid (Red Mosque) was blown up in Islamabad in 2007, it came after some ten Chinese were kidnapped and the Chinese complained publicly. The Pakistanis had ignored our protests about the Mosque for many years. But they moved quickly when the Chinese protested, killing many women and children in the process. That was one of the turning points in President Pervez Musharraf's career, because that turned many militants against him. Before that time, he had either ignored or supported them, but after Lal Masjid, they became his enemy.
How important are the militants or terrorists? Can they control the state?
Militants--whether you call them anti-American, anti-liberal, or anti-secular--seem to have a veto over politics in Pakistan, but they can't govern the state. The parties control the elections but they can prevent others from governing, and they may prevent the military from governing as well.
Some people have been hoping for a military coup, but you don't think that will happen?
We have to do what we can do and prepare for the failure of Pakistan, which could happen in four or five or six years.
I don't think the military wants to be in that position now. I don't think the military chief Ashfaq Kayani has such a game plan. He is as smart and calculating as President Muhammad Zia-ul-Haq [military president from 1977 until his assassination in 1988] was. He is quite different from Musharraf--not an Islamist himself, but he has certainly supported them in the past. I know the Pakistan military cannot govern Pakistan. They've tried it three times in the past and each time failed. This time they would have to deal with more active militants. The liberal forces are in retreat, and I don't see the army supporting the liberal forces in Pakistan.
Talk about the anti-American feeling. How did it develop into such a strong national sentiment?
Historically, the Pakistani elite have created a narrative of U.S.-Pakistan relations which always shows the United States letting Pakistan down. A turning point was the Iranian revolution of 1979, [which] showed a lot of Pakistanis that standing up to the Americans, embarrassing the Americans, humiliating the Americans felt good. Whether they were Sunnis or Shiites in Pakistan, it felt good. It all goes back to everyone in Pakistan concerned about American policy toward Israel and the Middle East. They seem to care more about Israel and Palestine than they do about themselves. The irony of Pakistan is that their major foreign policy obsessions are ones that they can't do anything about, including Israel and Palestine. When the U.S. and NATO forces moved into Iraq and Afghanistan, that was seen as a direct threat to Pakistan. They feared that the Islamist states were being knocked off one after another, beginning with Iraq, and going on to Afghanistan, and winding up with Pakistan. Most of that is imagined, but many Pakistanis believe it is true.
We've had a breakup of the coalition government, which happens all the time around the world, but why was so much gloom and doom expressed in Pakistan?
It's the incapacity of the Pakistani state to educate its own people in a modern fashion; it's the failure of the Pakistani economy to grow at all. If this was an American analogy, you would say Pakistan is a house under water. Except for its territory, which is strategically important, there is not much in Pakistan that is of benefit to anyone. They failed to take advantage of globalization. They use terrorism as an aspect of globalization, which is the negative side of globalization. Go down the list of factors, they are almost all negative. There is not one that is positive. They need outsiders for economic help. The conflict with India drains most of their budget. They can't resolve foreign policy differences with India. They have quarrels with us over Afghanistan, although they are probably right that we don't understand the Afghanis either. The question in my mind is whether these are irreversible so that Pakistan can become a normal state.
Militants--whether you call them anti-American, anti-liberal, or anti-secular--seem to have a veto over politics in Pakistan, but they can't govern the state.
What do you think?
Hope is not a policy, but despair is not a policy either. We have to do what we can do and prepare for the failure of Pakistan, which could happen in four or five or six years.
Talk about the terrorists.
There has been an accommodation with the government. Terrorist attacks are down. There seems to be an agreement by the security forces to accommodate the terrorist groups. I don't see the government regaining its position in the frontiers. The Pakistani Taliban is a designated enemy, but the army cannot move against them. The army is worried about its integrity itself.
Discuss Taseer's assassination.
He was like Sherry Rehman, a close associate of Benazir Bhutto.  Rehman had introduced a private member's bill to repeal the blasphemy law, and [Taseer] backed her, and that apparently led to his guard killing him. The blasphemy law makes the medieval Catholic Church look liberal. Anyone who stands up and criticizes the law has his life in danger. Rehman is prominently mentioned in press coverage. I don't think she will back down. She is a lady of strong principles, like Benazir.
Is the fear of India genuine?
It is genuine, because it goes back to the identity of Pakistan. They can't figure out how to reconcile their strategic necessity of accommodation with India. Of course, India takes a hard line on a lot of issues, not just Kashmir. India has allowed China to acquire Pakistan as a strategic asset. It is now a trilateral game between the Chinese and Indians with the Pakistanis on the Chinese side. http://www.cfr.org/publication/23744/pakistans_road_to_disintegration.html
