Religious scholar Tahir Ashrafi discussed the complicated religious side of Zaid Hamid. He said that Zaid Hamid was a follower of Yousaf Kazzab, who was once convicted under blasphemy charges. He also cited a book written by Yousaf Kazzab in which he mentioned Zaid Hamid as his companion. Ashrafi said that he has proofs that Zaid Hamid called Yousaf Kazzab (God forbid) Abu Bakar Siddique. He said that after Tousaf Kazzab saga this man disappeared and then again appeared as Zaid Hamid instead of his previous name Zaid Zaman. He claimed that he invited Zaid Hamid many times for a debate on his beliefs, but every time Zaid Hamid never turned up. The views of Mufti Ghulam Sarwar Qadri and Mufti Muhammad Naeem about Zaid Hamid were also aired. Both declared him a liar and Gustakhe Rasool (blasphemer). Salafi or Ahl-e-Hadith Clerics are also not far behind, read any of their book on Salat (Namaz) and in particular read the prerequisite they suggest for a Prayer Leader (Imam) and you would know that they dont even consider Non-Ahl-e-Hadith Prayer Leaders (read Deobandi and Barelvis) fit to lead  prayers rather the Ahl-e-Hadith Clerics and their edicts encourage their followers to desist offering prayers behind a Deobandi and Barelvi Imam and some Ultra Orthodox Ahl-e-Hadith compare Deobandis and Barelivs (basically both are the followers of Hanafi School of thought and follow Imam Abu Hanifa) with Ahmadis (Read Qadianis or Qadiyanis).

Brief History of Tehreek-e-Nafaz-e-Shariat-e-Mohammadi TNSM : To fully comprehend the genesis of TNSM, the politics and economics of the Malakand region (which is TNSM’s primary base) deserve some attention. In northwest Pakistan, three semi-autonomous states—Dir, Swat and Chitral—were amalgamated to form the Malakand Division of the North-West Frontier Province (NWFP) in 1970. The laws of Pakistan were extended to the area, sweeping aside old legal systems such as Sharia law in Swat. A legal battle erupted in 1975, however, when a dispute arose between the government and timber merchants about forest royalties in the area. A new judicial order was soon introduced to resolve the problems. This change, however, was incorporated after violent street protests were orchestrated by powerful landowners who had a monopoly on forestlands and wanted to pursue their vested interests. Getting the attention of the state through violence and armed conflict became an unhealthy precedent. Failure of the Pakistani state to tackle these issues in a timely manner created political confusion and religious groups found an opening for their agendas. Sufi Mohammad, an activist of Jamaat-e-Islami (JI), followed the situation closely. After returning from the successful Afghan jihad in the late 1980s, he was more convinced of his religious ideals. His exuberance, according to Pakistani journalist Amir Rana, led him to create TNSM on May 10, 1989. The very name of the organization framed its manifesto and agenda in unmistakable terms. His networking and experience in Afghanistan meant that on top of his battleground experience, he had no dearth of resources or religious motivation. Khan argued that such operations were radicalizing Pakistani youth, not just among the poor but also among the educated, middle classes. Dialogue, policing, and intelligence gathering should be the cornerstone of anti-militancy efforts in the tribal areas instead of the use of military force, Khan contended. Noting that he was recently in Swat, he went on to accuse the Pakistan Army of extrajudicial killings, summary executions, and "sexual humiliation" of residents in some villages. Khan urged the USG to seek "alternative points of views" about what is happening in the tribal areas of Pakistan, and he recommended speaking with General Orakzai, former NWFP Govenor, for starters. Khan charged that the GOP is "blinded by dollars," and consequently lacks an accurate view of what is happening on the ground. He further claimed that the GOP "whips up the threat of the Taliban" in order to get more money from the U.S. He claimed last year's Swat operation, which he termed a "debacle," was one such exaggeration that was "stage managed" in order to gain U.S. funds; there was no imminent threat of militants marching on Islamabad, he said. Khan also claimed that the Lal Masjid operation was similarly stage managed by Musharraf. He called for an end to Pakistan's "insane military action" in the tribal areas, adding that the Army has failed to secure any significant areas of South Waziristan despite GOP statements to the contrary. Mufti Muhammad Taqi Usmani Deobandi Fatwa against Asma Jahangir's Funeral and Taqi Usmani's Haram (Unlawful/Forbidden) Islamic Banking




ISLAMABAD, June 11: Maulana Taqi Usmani, who remained ad hoc judge of the Shariat Appellate Bench of the Supreme Court for two decades, was removed from the bench because of his financial interest in holding that all interest-based banking was un-Islamic. A federal government official told Dawn that Maulana Taqi Usmani, a renowned figure in the field of Shariah, particularly in Islamic finance, held advisory positions in over a dozen financial institutions practising Islamic banking and finance. The fact that he had financial interest in holding that “all interest-based banking is un-Islamic,” disqualified him from sitting on the bench. The decree was issued in a meeting at the Jamia Farooqia in Shah Faisal Colony chaired by Maulana Salimullah Jan, President of Tanzeematul Madaris and Wafaqul Madaris, and attended by reputed religious scholars from all over the country. The meeting also discussed in detail the status of Islamic television channels in accordance with the Shariah and described their research and experiences in the light of questions and problems received at their respective centres. Some scholars also presented their research papers in this regard. On the occasion, Maulana Salimullah Jan said that the religious scholars were contacting banks that had been claiming to practice Islamic banking and did research on the prevailing banking practices in the light of the Holy Quran and Sunnah.
He said they also held meetings with modern economic experts. He said after detailed consideration, the scholars unanimously declared the Islamic banking and television channels as illegitimate. The scholar also said the kinds of pictures of a living being so far introduced were liable to be dealt with in accordance with the religious commandments. He said the launching of any type of television channel or participation in any television programme declaring it was needed for preaching had also been declared illegitimate. He said the scholars appealed to the Muslims to avoid television like other deeds forbidden by the Shariah.  Like Chaudhry Sir Muhammad Zafarullah Khan, Maulana Mawdudi also didn't participate in Jinnah's Funeral prayers and this is not the end, Mawdudi didn't even offer the Funeral Prayers of his own benefactor Allama Iqbal (Reference: Allama Iqbal, Quaid-e-Azam, Perwez, Mawdudi and Tehreek-e-Pakistan by Chauhdry Habib Ahmed, page 736, Published in 1981 Faisalabad , Punjab Pakistan) and according to Khaled Ahmed "Given the prestige of Miss Jinnah, she was allowed to dispose of all the property of her brother (as a Sunni she would have title to only one-half) and continued to do so till her death. After her death her sister Shirin Bai arrived in Karachi from Bombay, converted from Ismailism to Twelver Shiism, and laid claim to Jinnah’s property. It is at this point that the rest of Jinnah’s clan, still following the Ismaili faith, decided to challenge the authenticity of Jinnah’s Shia faith. The High Court, which had earlier accepted Miss Jinnah’s petition, now balked at the prospect of declaring the Father of the Nation a Shia. Needless to say, the case is still pending in Karachi. But Miss Jinnah’s conduct showed that she was an observing Shia and took her brother’s conversion to Twelver Shiism seriously. Why had Jinnah converted? It develops that he did it on his secular principle of freedom of religion. According to court’s witness, Syed Sharifuddin Pirzada, Jinnah broke from the Ismaili faith in 1901 after his two sisters, Rehmat Bai and Maryam Bai, were married into Sunni Muslim families. It appears that this happened because the Ismaili community objected to these marriages. It also appears that the conversion to Isna-Ashari (Twelver) Shiism happened in Jinnah’s immediate family, and not in the families of his two paternal uncles, Walji and Nathoo. 

The court proceedings bear evidence of the last rites observed by Miss Jinnah immediately after her brother’s death. Witness Syed Anisul Hasnain, a Shia scholar, deposed that he had arranged the ghusl (last bath) of Jinnah on the instructions of Miss Jinnah. He led his namaz-e janaza (funeral prayer) in a room of the GovernorGeneral’s House at which such Shia luminaries as Yusuf Haroon, Hashim Raza and Aftab Hatim Alavi were present, while Liaquat Ali Khan, a Sunni, waited outside the room. After the Shia ritual, the body was handed over to the state, and Maulana Shabbir Ahmad Usmani, a breakaway alim of the Deobandi school of thought who supported Jinnah’s Pakistan Movement but had recently apostatised the Shias, led his janaza (funeral) according to the Sunni ritual at the ground where a grand mausoleum was later constructed. Other witnesses confirmed that after the demise of Miss Fatima Jinnah, clam and panja (two Shia symbols) were discovered at Mohatta Palace, her residence. Witnesses appearing at the Sindh High Court in 1968 to affirm Jinnah’s sect were Mr I.H. Ispahani, a family friend of Jinnah and his honorary secretary in 1936, and Mr Matloobul Hassan Syed, the Quaid’s private secretary from 1940 to 1944. Mr Ispahani revealed that Jinnah had himself told him in 1936 that he and his family had converted to Shiism after his return from England in 1894. He said that Jinnah had married Ruttie Bai, the daughter of a Parsi businessman according to the Shia ritual during which she was represented by a Shia scholar of Bombay, and Jinnah was represented by his Shia friend, Raja Sahib of Mahmudabad. (Raja Sahib was a close friend of Jinnah but differed completely from him in his belief. He was a devout follower of the Twelver Shia faith and ultimately chose to migrate from an independent India to Najaf in Iraq. His friendship with Jinnah has puzzled many. Apparently, the only bond they had was of the Shia faith.) He, however, conceded that Jinnah was opposed in the Bombay elections by a Shia Conference candidate. Ispahani was present when Miss Fatima Jinnah died in Karachi in 1967. He himself arranged the ghusl and janaza for her at Mohatta Palace according to the Shia ritual before handing over the body to the state. Her Sunni namaz-e janaza was held later at the Polo Ground, after which she was buried next to her brother at a spot chosen by Ispahani inside the mausoleum. Ritualistic Shia talgin (last advice to the deceased) was done after her body was lowered into the grave. (Jinnah had arranged for talgin for Ruttie Bai too when she died in 1929). Asma’s tirade against Army - Viewpoint BY Ahmad Noorani Saturday, May 28, 2011  ISLAMABAD: Supreme Court Bar Association (SCBA) president Asma Jahangir has launched an unprovoked but scathing attack against the Pakistan Army and has ridiculed the unanimous resolution recently adopted by the joint session of parliament. In a private television talk show aired Thursday night, Asma Jehangir spoke her venom against the Army and went to the extent of dubbing the army officers “duffers”. Crossing all limits of decency and constructive criticism, she even made serious allegations of corruption and supporting of terrorist groups without providing any evidence. Asma, known for her erratic responses, has also been using humiliating language against the parliament and the judiciary in recent times. In one interview she called parliamentarians ‘Ullo kay Phathay.’ Her outbursts against the present independent judiciary is already known to every one. After the apex court’s historic judgment on the NRO, which made the presidency unhappy, Asma used the expression of “17 jarvi bachiyaan bhaithi hain” for the honourable judges of the 17-member bench. Although the constitution expects from the people to respect state institutions like judiciary and defence, the President of SCBA has shocked many by using extremely objectionable language. Asma who is extremely controversial in Pakistan is respected in many foreign countries including in India and the United States. In her latest interview after the terrorist attack on India-specific strategic assets, she launched a scathing attack on the Pakistan army. Some of the her translated (in English) quotes are reproduced here; “The army men are duffers, duffers. They are politically duffers. If you will follow their policy, as you have (in the past), the country will never progress. I don’t care what USA or anyone else thinks. I only care that people of our country should save themselves from this Army. Pakistan Army is responsible for the present situation.” Ignoring the sacrifices of the army to curb terrorism, she instead said, “They have spread terrorism in every nook and corner of the country. The army supports terrorism and encourages it...I don’t allege all the army men. I am not alleging ordinary army jawans. But the army generals, who play golf all the time, gossip and look for the best pieces of land for themselves. Now see what has happened in Karachi; there was a marriage hall. Could you image marriage halls in such a sensitive location? The army has made us (citizens) slaves. Now the time has come to request them with all humility to go back to the barracks and let our children live here. We don’t want bloodshed here. If you really need some crown on your head please go, fight a war and show us that you can win a war. You did the Kargil misadventure, you kill light infantry soldiers.” She added, “You are using innocent children as human shields . You are not able to fight, you cannot run the country, and you cannot make policy. You are a Qabza Group. You are a Qabza Group of this country. We should now say this plainly. Ask me the examples and I can give you several examples of their duffer-ness. See, I want a proper protest procession to be held on the Mall Road (Lahore), named ‘Haath Bandh Jaloos’. This protest procession should say, ‘Fauji Bhaio, Thanks you very much. Please go back to your homes. Sit in the barracks. You have taken so many plots. Now enough is enough. Ooh the Group of corrupts; please leave us alone.” Asma concluded, “Now I say that either the Army will remain supreme or Pakistan. If both will remain supreme, the country may not move forward.” Asma also attacked the parliamentary resolution and termed it as mere toilet paper. In the same interview, Asma also said she was the first one to condemn Musharraf’s martial law in 1999. However, in the post-coup interview with BBC that is available on youtube, Asma criticized the out-thrown civilian democratic government of Nawaz Shairf and just added one soft sentence that what Mushrraf had done by launching a military coup was not allowed by the constitution. Most of her interview justified the coup by condemning the ousted democratic government of Nawaz Sharif. In yet another interview with The News she termed parliamentarians are fools by using the Urdu words ‘Ullo kay Pathay’. Asma has also been unpredictable in her statements towards the independent judiciary. She had opposed the historic July 31, 2009 judgment against the PCO judges and the November 3 Emergency of General Musharraf. She launched an aggressive attack on the independent judiciary after a 17-member bench of the Supreme Court headed by the Chief Justice Iftikhar Muhammad Chaudhry termed the notorious legislation of National Reconciliation Ordinance (NRO) as illegal, unconstitutional and declared it void abi nitio. Referring to the 17-member bench, Asma had said it seemed that seventeen girls were sitting on the bench; “Satra Jurvi Bachiyaan Bhaithi hain.” While referring to use of article 62-f as the basis for striking down NRO by the Supreme Court, Asma said, “It was a ‘shararat’ (naughtiness) of the judges.” Asma has repeatedly questioned how all the seventeen judges reached the same reasoning while rejecting this law. She did this more than ten times in about six TV programs in the month of December 2009. Exact quote in Urdu was, “Thora bohat Ikhtilaf hota hay - Kaisay Yeh ho gia keh 17 kay 17 judgoon ki reasoning aik hi ho gi.” While claiming that the judiciary led by Chief Justice Iftikhar Muhammad Chaudhry remained silent on the issue of missing persons during Musharraf’s regime, Asma said, “Why did this judiciary remain silent when during the regime of Pervez Musharraf people were being picked up, went missing and were being sent to Guantanamo Bay? Why did this judiciary not speak then and why is it speaking now?” This however, is a fact that beside the media, the judiciary was the only institution which was continuously taking up the issue of missing persons and even summoned officials of the security agencies for the recovery of these persons. While criticising the Supreme Court on NRO judgement’s operational part, Asma during the same programme, said, “Prosecutor will be the court, appeal will be heard by court, monitoring cell is the court, watching will be done by court, court will transfer the people and court will appoint its choice people.” At one point during this program after the NRO judgement, Asma even said, “We have not struggled for this judiciary. (In post Nov 3rd 2007 scenario) We have struggled for an independent judiciary. We have not struggled for such a judiciary.” Again while referring article 62-f Asma said about the Supreme Court judges, “They will be prosecutors, they will examine our eyes.” While referring to the NRO judgement Asma even said, “Please don’t take this judgment so simply.” Again while mentioning article 62-f in the NRO judgment Asma predicted that if in future some candidate was not liked by the Islamabadites and if the 62-f is invoked against him, then these 17 (judges) will see whether the person is sagacious or not and all the 17 (judges) will reach on unanimous verdict that person is sagacious. The treasonous memo! by By Shaheen Sehbai & Mohammad Malick November 18, 2011 ISLAMABAD/DUBAI: From a smoking gun to a smouldering fuse, the mysterious memo earned many sobriquets even before its precise contents were known to anyone but a handful of highly secretive power players involved in its drafting and communication. The (in)famous, rather possibly game-changing, Mike Mullen memo, ironically contains six mutinous articles and is now being revealed after Admiral Mike Mullen also confirmed its existence and 'remembered' having received it at the height of the OBL crisis. After days of huddles between the troika and other major power players of the country resulted in a resignation offer by President Zardari's closest foreign and domestic policy adviser and Ambassador to the US, Husain Haqqani, the memo has acquired the importance of a political nuclear bomb. The memo was sent to Mike Mullen through mutually trusted contacts by US businessman Mansoor Ijaz, who claimed doing so at the behest of an unnamed senior Pakistani diplomat, who has now been identified as none other than Mr. Husain Haqani. The memo is said to have been approved by the President of Pakistan. Chief of the Army Staff General Ashfaq Parvez Kayani reportedly endorsed and seemed convinced with the evidence that Mansoor Ijaz has provided to the army and took this up in his latest one-on-one meeting with the president. Sources say without offering many options, the president was 'asked' by Gen. Kayani to immediately summon Haqqani for further enquiries. The President, who earlier through his spokesman had simply shrugged off the whole affair while rubbishing Mansoor's claims, readily obliged and Haqqani was summoned to Islamabad. So far however, the ambassador is still staying put in Washington on the officially offered explanation that he is finishing up prescheduled diplomatic commitments. Besides the Memo, the electronic correspondence between the diplomat and Mansoor Ijaz has also become available in full and is a graphic account of dates, time lines, words, and even emoticons, which are normally used by youthful SMS users. Part of this conversation was recently released by Mansoor Ijaz to the media in his almost 3,700 word long statement. All communications between Haqqani and Mansoor have now been transcribed from the cell phones and made available to The News. The Memo has reached The News from more than one source, both within Pakistan and from abroad, and is nothing short of being offensively repulsive, offering an alarming insight into a power-corrupt mindset willing to compromise national interest for petty personal power gains. It is, arguably, a document crafted by soul-less conspirators who clearly have no shame and dignity, no national pride or respect. The originator, writer, approver and the ultimate beneficiary of the Memo all look like vicious anti-state collaborators and traitors hiding under the garb of national leaders and proving themselves to be decision-makers occupying positions they never deserved and should never have been allowed to occupy in the first instance. All that has come in bits and pieces in the media so far are simply peanuts as compared to the 929 words of the Confidential Memo, which has been obtained and confirmed to be authentic by The News. Couched as a "Briefing for Admiral Mike Mullen," each word has a deep meaning and each sentence carries an offer, a plan, an incentive to demolish national security apparatus of Pakistan, play havoc with its nuclear assets, allow American boots on Pakistani soil and help and abet the US in accusing and proving the Pakistani armed forces and intelligence agencies guilty of "complicity" in the Osama bin Laden affair, his secret stay in Pakistan and his mission. To top it all and make such an investigation into a foolproof nutcracker, the memo also invites US authorities to hand pick the investigators panel. Aping Camp-Justice style justice, the memo also assures its recipient that the investigation process, "will result in immediate termination of active service officers". 



In other words, byebye to a recalcitrant Kayani, adios to a hardnosed Pasha? The memo brazenly accuses the Pakistan Army leadership of "brinkmanship aimed at bringing down the civilian apparatus in Pakistan" and calls the time it was written in May 2011 as "a 1971 moment in Pakistan's history" when the armed forces had been defeated in East Pakistan and civilians led by ZA Bhutto had gained the upper hand over the military. And what do the drafters of this treasonous memo have in mind for changing the security paradigm of Pakistan? In lieu of prolonging their own stay in power, the authors of the memo promised the US administration to replace the, "National security adviser and other national security officials with trusted advisers that include ex-military and civilian leaders favourably viewed by Washington". Talk of being his master's voice. The Memo talks of creating a "new national security team" which promises to give "carte blanche" or a blank cheque to the Americans to carry out Osama-type military raids inside Pakistan and any operation on Pakistani soil. Could there be a greater violation of national sovereignty? One wonders. Clearly the authors of the memo did not give two hoots about at least two unanimous resolutions of the national parliament, which categorically forbade any violation of Pakistan's sovereignty by a third country and any action by it against Pakistani citizens inside Pakistan. Not only this but the memo also promises that the US would be given the "green signal" to not only track down people on Pakistani soil but also to kill them if so needed. The memo stands in clear defiance of the binding resolutions adopted by the Constitutionally elected parliament. In a criminally dangerous development, the memo presents as an equivocal fact that the top al-Qaeda leadership is based inside Pakistan when the authors promise to hand over the likes of Ayman Al Zawahiri, Mulla Omar etc. This angle alone would have qualified Pakistan to be declared a rogue terrorist state but try telling that to a duo with vaulting ambitions who appear to have no qualms of destroying the state in order to perpetuate their stay in office and continue with loot and plunder. As an icing on the cake, the authors of the memo also promised to bring Pakistan's nuclear assets under a "more verifiable, transparent regime.. For those in the know, this translates into retooling the entire setup and providing unrestricted access to Pakistan's nuclear assets to United States, something that has long figured high on the US wish list. This offered concession also fits in neatly with the framework softly being pushed through the slower and circuitous Cooperative Threat Reduction regime (CTR) That the move to place our nuclear assets at the mercy of the US and its 'friends' has direct security consequences for Pakistan vis-‡-vis India, among other serious concerns, is clearly no priority for the authors. And understandably so because their only concern was to stay in power no matter how. Let the country pay the price of their avarice. What political repercussions this memo will have on the power politics of Pakistan is too early to predict but what has been established is that the military establishment is not happy at all with what was going on and the Opposition will jump on the government with a relentless campaign to bring the culprits to book. Will the President stick to his guns and refuse to abandon his man in Washington? Or will he move with ruthless efficiency and speed to sever any possible incriminating link? Will the expected sacking of the envoy signal the end of the crisis or mark the beginning of the next and possibly fateful phase? The political landscape is waiting for some more aftershocks, it appears. What is certain however is that the heat from the smouldering fuse is being felt by the keg. Excuse me, madam From whom we seek justice BY Ansar Abbasi Tuesday, November 09, 2010  Since her election as president of the Supreme Court Bar Association (SCBA), Asma Jahangir is repeatedly targeting the Jang Group and Geo. In her criticism, she has not only resorted to personal attacks, but has also pursued a posture that can never be expected from a person who claims to be the torchbearer of human rights, democracy and freedom of media. I never expected from her the attitude she displayed last week during a TV talk show, hosted by senior journalist and anchorperson Nasim Zehra. Zehra herself was amazed by Asma Jehangir’s passion to remain focused on the Jang Group and Geo, although the media group was not the topic of the show. In my presence, she taunted the Jang Group, Geo and me and accused us of practising yellow journalism. She interrupted me time and again all throughout the show. Such interruptions led to the show turning into a fish market, at least twice. I was amazed to observe Asma Jehangir emerging as the great defender of co-chairperson of the PPP and President Asif Ali Zardari. She told me that I am suffering from Zardari-phobia but displayed the kind of responses that left her so-called independence badly exposed. She reacted almost every time when I talked of President Zardari despite the fact that the PPP’s Senator Maula Bux Chandio was one of the participants in the show. What even surprised Ms Zehra was the strange interruption of Ms Jehangir when I named three politicians, including Asif Ali Zardari, Nawaz Sharif and Altaf Hussain, to discuss the powers given under 18th amendment to party leaders, she cut me and remarked that perhaps I was suffering with Zardari-phobia. At this stage the astounded anchorperson had to explain to Asma Jehangir that Ansar Abbasi is talking of different political leaders and not that of Asif Ali Zardari alone. Her strange reaction has further my earlier doubts with regard to the alleged understanding between her and the Presidential camp. 


Her conduct forced me to ponder if she possesses the patience and restraint that is expected from a person holding the coveted office of the SCBA president. I thought of her predecessors — Aitzaz Ahsan, Ali Ahmad Kurd and Qazi Anwar — who, despite the criticism of media, have always been decent and gentle and never lost their cool and composure. In the backdrop of a coordinated campaign, launched by the government and Zardari-PPP against the Jang Group and Geo, Asma Jehangir appeared like joining hands with the government to defame us. During the talk show, she maintained that Jang, The News and Geo had been publishing and broadcasting lies. She accused the Jang Group of mudslinging against her. “They talked about me being an Ahmadi,” she said and asked me as to who had told me that she was Ahmadi (Qadiani, who are declared non-Muslim). Though during the show she was not ready to listen to me but now may I ask her as to when did I say that she is a Qadiani or Ahmadi? Leave me; will she now explain to us as to when did Jang or The News write that she is a Qadiani? How the Jang Group, Geo or Ansar Abbasi could be blamed when such utterances were made during the elections of the SCBA. To set the record straight, let me explain that in his report on the lawyers’ politics, published on the polling day, Mr Tariq Butt wrote in the middle of his write up, “Among the lawyers who would be casting their votes in the SCBA election, there has also been talk of the ‘Qadiani’ factor against Asma Jehangir, which might play an important role.” Although Tariq Butt is a senior journalist and important member of our investigation team, he never told me what he was writing. Obviously like any other independent journalist he also did not write on my directive or desire. Above all Tariq Butt never described her as Qadiani, but had briefly referred to the talk of the town that was under way in the entire legal fraternity. He was very cautious while referring to that factor. Although Asma Jehangir had targeted the entire Jang Group, a scan of recent newspapers show that a lot of material has published in her favour also. In his recent column, it was the leading columnist of Jang Group Mr Hamid Mir, who dispelled the impression about Jehangir being a Qadiani. The column penned in her favour explains that some family members of her in-laws are followers of the Lahori Group of the Ahmadis, but her husband is not Qadiani. Apart from Hamid Mir, there is a lot of material written by others in favour of Asma Jehangir in Jang and The News. The writers included Munnoo Bhai, Ayaz Amir, Ghazi Salahuddin, Shakil Sheikh, Babar Sattar and Shafqat Mahmood. 


The Jang Group, termed by Asma Jehangir as liar, had also published an editorial in her favour after her victory in the elections. Was anyone prevented to write in her favour? Was any word written in her favour deleted from the write up of any columnist or writer of the Group? If not then where is the so-called campaign that she believed was launched by the Jang Group against her? I wonder what was the root cause of her rage, but one point needs mention. And that is, a day prior to her election, she and some senior journalists, supporting her, had tried to bring pressure on the Jang Group to black out the story of Ahmad Noorani wherein the budding journalist had submitted the exact contents of Asma Jehangir’s anti-judiciary statements made by her after the Supreme Court ruling on NRO. The matter is yet under probe within the department, but it’s anybody’s guess as to who had informed her and her supporters in the media that such a story was filed by Noorani. The Jang Group may be held guilty of not to succumbing to the pressure to block publication of that story. She maintains that Jang Group speaks and writes lies. Besides the reflection in other newspapers, some of our correspondents also wrote before the SCBA elections that Asma Jehangir enjoyed the support of the government and the PPP. We admit the guilt of having published the statement of Sardar Latif Khosa, head of People’s Lawyers’ Forum and a confidante of President Asif Ali Zardari, claiming that everyone, including PPP lawyers, the government and Babar Awan, would support her in the election of the Supreme Court Bar. Prior to the elections, we published two stories that to my reckoning had irked her. One of them had appeared 3-4 months before the elections and the other 8-9 months before. The first story had no relevance to her elections. It was her reaction to the decision of the parliamentary committee on 18th Constitutional Amendment not to touch any of the Islamic provisions of the Constitution. In her statement, Asma Jehangir had termed the parliamentarians fools (Uloo kay Pathay). Although the next day she had denied having given the statement, proof of the interview is in possession of the concerned correspondent of The News. The second story stated that she would be the candidate of the Zardari and PPP camp in the Supreme Court Bar Association elections. The said story contained the version of both Asma Jehangir and her chief supporter Justice Tariq Mahmood. Later, the statement of Sardar Latif Khosa also proved that what the Jang and The News had carried a couple of months earlier were based on truth. In case of a campaign against her, much would have been written and published a few weeks prior to elections. But that did not happen although Tariq Mahmood had been saying that Jang Group desired results according to its will. I was also accused of stating that I would not let Asma Jehangir win these elections. Those who know me would bear witness that neither I have neither such mentality nor I talk in such a tone. No doubt Asma Jehangir had served the cause of human rights, but it is also true that I have no personal grudge against her. We, however, do have differences on ideological ground. I have firm belief that Islam is a complete code of life and take pride in the Islamic foundations of our Constitution. She thinks contrary and at times even cross the limits. Despite our differences on beliefs and faith, I think it is vital that we should not consider ourselves something so special and someone beyond human beings. Those thinking of themselves as heavenly creatures could not be exempted from criticism just because they are in the habit of sitting in Ivory Tower. “The Supreme Court’s website is not a gossip column,” argued Advocate Asma Jahangir representing Fareeha Idrees and Ramiza Nizami who were shown on the list as members of former prime minister’s entourage in one of his foreign trips, but they never went abroad. President of the Pakistan Federal Union of Journalists Parvez Shaukat, Shakil Turabi of Sana news agency, Moniza Jehangir and Rauf Klasra had also approached the court. “My grouse is that without verification the court ordered to place the list ‘A’ on its official website to defame people as if they are proclaimed offenders,” lamented Ms Asma. “What constitutional violation a journalist had committed even if he had gone abroad with the prime minister to perform his professional duty,” she asked, adding that the court had given legitimacy to a flawed list by putting it on its website, but it never placed names of 7,500 condemned prisoners on the website. Ms Asma argued that instead of approaching the apex court the petitioners should have filed defamation cases at a proper forum to clear their names. “You cannot put apple and oranges in the same basket and place it before the public,” she regretted. “We should not suffocate this court with self-righteousness.” The counsel argued that the court should clarify its order as no-one should be subjected to a smear campaign. The apex court never sent its registrar before the Public Accounts Committee or placed its accounts on the website, she said. 2012 : ISLAMABAD, July 19: Television anchors Hamid Mir and Absar Alam filed on Thursday a joint petition with the Supreme Court seeking an inquiry into the list of journalists and anchors who were allegedly granted favours by owners and administration of Bahria Town Ltd. They have asked the court to direct the Bahria Town and its former chairman Malik Riaz to appear along with a proof of all the persons, including journalists, military officials and bureaucrats and any other individual whom they have tried directly or indirectly to buy favours from. The context in which the petition has been filed is very clear. Soon after real estate tycoon Malik Riaz claimed that he had paid huge sums of money to Arsalan Iftikhar, the son of Supreme Court Chief Justice Iftikhar Muhammad Chaudhry, for possible relief in certain court cases, a leaked conversation between Mr Riaz and two anchorpersons during intervals of a talk show had provoked public anger against the media. The following day a list apparently on the letterhead of the Bahria Town was circulated on social media, containing names of the anchors and journalists allegedly paid hefty amounts by the Bahria Town besides luxury cars, plots, houses and sponsored visits to foreign countries. The petition seeks directions to the Federal Board of Revenue to produce asset and income statements of all media persons under scrutiny and question. It also seeks directions to the Federal Investigation Agency to inquire as to who spread the list of media persons on social media and through short messaging service (SMS). The scope of the petition is wide ranging as it not only challenges the legality of establishment and maintenance of secret fund by the information ministry and seeks the court to summon complete record of the money doled out to various elements along with the purpose, but also pleads for asking the DG of Anti-Corruption of Punjab police to reveal reasons of hushing up a scam involving misuse of Rs640 million government funds. It also questions the legal status of code of conduct for the electronic media and calls for disclosure of assets and political affiliation of TV channel owners. The petition says it was essential that rags to riches story of Malik Riaz be made public as to how an ordinary man over the course of less than two decades became one of the richest man in the country. It questions the dubious nature of land acquisition by Malik Riaz and the Bahria Town and calls for exposing certain criminal element aiding and abetting Malik Riaz as his muscle by their active role in forcibly taking over possession of land from real owners. The petitioners have asked the court to either adjudicate and inquire into the issues itself or to constitute a commission for the purpose. 2009: Rampant corruption real problem: Malik Riaz RAWALPINDI: There is no economic problem in Pakistan but the rampant corruption, and if there is no corruption and left alone by the US and Britain, the country could achieve self-reliance within four years. Malik Riaz Hussain, head of Bahria Town, stated this while speaking as chief guest at a forum on problems faced by the Pakistani expatriates in property affairs, particularly in purchase of plots and after that. The event was organised by Daily Jang and Geo News, London, and panellists included Lord Nazir Ahmed, Zubair Gul, Mohsin Akhter and Ahmed Shahzad while Iftikhar Qaiser hosted the forum. “In this regard, we had also suggested some steps through we could have repaid the country’s debt,” Malik Riaz said. “In fact, every big figure in Pakistan is part of land mafia as no poor can grab land of another, therefore, there is a need to lay hands on big fish. All those sitting in the government are part of the mafia, otherwise a law can be passed within 24 hours,” he said. Malik Riaz said that all areas have their own desperados who do not allow setting up of schools in the respective areas so that people could not get education. He said that he did not get education from college or university and has learnt everything from experiences of his life. He said that an under-construction university affiliated with Middlesex University of Britain would start functioning in Pakistan. “After the October 8, 2005 earthquake in Pakistan, the government had no machinery to remove debris and without any request from the government, we shifted our machinery to the quake-hit areas. We have left no room for a fraud in Bahria Town project and any other scheme in which it is a partner. We are always alert about the mafia. Whenever I announce a new scheme, the pocket plots are purchased there in a single night. Then I pay several times more to acquire such plots so that every person can get a plot,” Malik Riaz said. “Under a law of the Punjab government, if anybody purchase 80 per cent land anywhere, he can get the remaining 20 per cent land vacated after payment to the owners,” he added. The Bahria Town chief said that according to his estimates, currently Pakistan needs 700,000 new houses annually whereas the government is building only 250,000 houses. He said that neither he is a political person nor has any intention to join politics. He said he has allocated 75 per cent of his assets for welfare activities while the remaining 25 per cent is meant for his family. “There is nothing to worry about and expatriate Pakistanis should make investment in their homeland without any fear. Only there is a need for purchasing property and making investment in a planned manner,” he said. Malik Riaz said that Bahria Town is the largest housing project in Asia with annual turnover of $1 billion. He said that 20,000 people are employed in the Bahria Town project and thus it is source of income for 100,000 people. He said that Henry Ford, the owner of the American car manufacturer, Ford, impressed him immensely for being a semi-educated person like himself. Quoting Henry Ford that he desired always to be remembered as a philanthropist, Malik Riaz said it is his wish that instead of a real estate tycoon he is remembered as a welfare tycoon. A large number of Pakistani expatriates in Britain attended the forum held in a big hall of the House of Lords. There was so much rush of people that around 150 people stood for two hours while another 150 people could not attend the forum because the management of the hall had stopped them outside the hall. Shaheen Sehbai (Present Group Editor The News International of Jang Group/Geo TV) on January 05, 2000: The integrity check should simultaneously be launched by the peers of the profession at whatever forum they think would be appropriate. Perhaps this first hurdle may be the only big hurdle and may never be crossed. The peers, naturally those who come out unscathed and "clean", should sit down to formulate lists of those who have been publicly demonstrating a lack of intellectual, moral and professional integrity. Big names like Minhaj Barna, Mushahid Hussain, Maleeha Lodhi, Wajid Shamsul Hassan, Nazir Naji, Ataul Haq Qasmi, Ayaz Amir, Hussain Haqqani, Irshad Ahmed Haqqani, Najam Sethi, Nasim Zehra, Jamiluddin Aali and many others who sought or accepted political, diplomatic or government jobs, or joined political parties as activists, should be asked to explain why they did not quit journalism to do so and why they continued to use the profession to get, keep or regain lucrative jobs or positions of power. How do they retain, or claim to retain, their objectivity and credibility, once they have demonstrated their political ambitions. In the least they should have apologised to the profession. Some of them have been going in and out of journalism so frequently as if the profession was a revolving door only to be used when they needed a push to restore their lost position of political, economic or administrative influence and power. Some others, like the once-revered Minhaj Barna, who led the trade union movement of journalists and whose "Barna Group" of Pakistan Federal Union of Journalists still exists, accepted so petty, temporary and at times demeaning jobs that the entire profession could only hang its head in shame. Scenes when stalwarts of the profession like him were seen waiting outside offices of petty bureaucrats in Islamabad’s corridors of power, to get an extension of their foreign assignment were, to say the least, despicable, bringing no merit to Pakistani journalism. I would never forget a supposedly well known name in today's op-ed pages who, in order to "please" a lady ambassador in Washington, turned himself into her private photographer and started taking her pictures with all those present at a grand farewell dinner thrown at her official residence. For three hours this newspaper columnist behaved like a personal privately hired professional. He even carried his "act of sycophancy" to the next day at the airport where people went to see her off, clicking rolls and rolls of pictures with the ambassador sitting, standing, waving and smiling at every Tom, Dick, Harry and Larry. Even junior embassy staffers started making jokes about this senior journalist and his "buttering skills". To his ultimate disgrace, he was never obliged by the slick ambassador, despite his publicly self-demeaning conduct. But later these very skills worked well with the successor political government and he landed a cushy government job in Islamabad. The moment the government was ousted, his columns started attacking his previous employers. Still he retains his claim to be an "impartial and objective" analyst and writer and does not include himself in the long list of trapeze artists that crowd the media circus in Pakistan. Nayyar Zaidi (Also contributed for The News/Jang) January 27, 2000 : This article is in response to Mr Shaheen Sehbai's Who will bell the bad, fat cats?. The author would like to clarify that it is not a personal attack, but an attempt to question the ideas and personal allegations expressed in the above article. In the words of the author, What proof did Mr Sehbai offer that the 12 people mentioned in the article had become millionaire(s) overnight and that the wealth they allegedly earned was unlawful?  "Who will bell the bad, fat cats?" This is a model piece of journalism i.e. it "reflects superficial thought and research, a popular slant and hurried composition...as distinguished from scholarly writing."(Webster's Encyclopedic Unabridged Dictionary of the English Language). We all live in the proverbial glass house. Of course, anyone may decide if and when to cast the first stone. You have recklessly exercised that option. It is one thing to "measure" someone by a "yardstick". However, it is downright cruel to flog people publicly with what you may misguidedly characterize as a "yardstick". You refer to Minhaj Barna as "the once-revered...who led the trade union movement of journalists... (but) accepted so petty, temporary and at times demeaning jobs that the entire profession could only hang its head in shame...." Barna Saheb is still revered! What is a "petty" and "demeaning" job? Did he put an honest day's work in whatever job he held? Was he qualified for the job, no matter how petty and demeaning? It is better to do a demeaning job than to demean the job one does.

The "entire profession" of journalism ought to have hung its head in shame not because Barna Saheb allegedly sought and accepted "demeaning jobs" but because he had to do so. He did so much for this "entire  profession" and yet none of its self proclaimed vigilantes came to his rescue in his old age and in his time of need. What do you want? Journalists of "integrity" should murder their families and then commit suicide in their twilight years simply to please hypocrites among their ranks? Without responsibilities, we are all capable of being very bold. It is the welfare of those whom we love that makes us stoop--sometime to our own disliking. There is no such thing as objective and/or independent journalism. Let me give you an insight into the proper use of analogies because an analogy contains the genetic map, so to speak, showing you exactly the nature of the beast.

Media is called a watchdog, correct? The analogy of a watchdog tells us that it is definitely "owned" to protect certain specific interests. A watchdog is always on a leash. The owners must ensure that the dog doesn't relieve itself on the property of others just because it perceives itself as an "independent dog"! The watchdog is supposed to bark only at strangers and outsiders. If it barks at the owners or at fellow dogs, it becomes an irritation--not to be tolerated indefinitely. The day it bites or attempts to bite, it is put to sleep. For the time being, I am leaving your subtleties alone. But tell me, since when has someone trying "to please a lady...in Washington" has required observers to send a reference to the Journalistic Accountability Bureau (JAB)?

You are from Peshawar. Be understanding of the fundamental human right that "Har Bandey Nu'n Dil Peshauri Karan Da Hukk Hai" (Sorry folks, this cannot be translated). As for taking photographs at a farewell dinner or at the airport, let me say that "parting is such sweet sorrow" that I don't blame anyone for preserving it on the film for pure academic pleasure later on. You accuse "stalwarts of the profession" of "waiting outside the offices of petty bureaucrats" to "get an extension of their foreign assignment". Every journalist is not fortunate enough to have an unabashed practitioner of nepotism as an uncle at a major newspaper. Please understand that God Almighty did not allow us to choose our parents. The same goes about uncles! So, don't rub it in! The Pakistani "journalists" living or stationed here (in the West)have no right to judge their distant peers who live and practice journalism in a totally different environment. The only exception would be those who come out in public moaning and groaning about being victimized. We do not need an Altaf Hussain of journalism in United States! If you wish to hold peers accountable, a proper way is to evaluate their work and products. This can be done by taking specific stories and columns and measuring them with the "yardstick"of journalistic and linguistic principles. This may be done in a "media watch" type of column. Using your own approach, of suspecting the motives (the hidden agendas), please consider this (and correct me, if I am wrong): The DAWN-USA.com is a business for profit web-site owned by you and/or your immediate family. You have advertisers who sponsor on the basis of "traffic" to the web-site. Your advertising rate also depends on the number of people who visit.

Please answer these questions, if you have any respect whatsoever for your own "credibility", if any, and "integrity", if any:


1) Are you losing your main source of income (DAWN Correspondent) in near future and, therefore, need to boost your income from other sources (like your web-site business)?


2) Have your web-site revenues fallen to a point where advertisers may withdraw unless you boost the traffic?


3) Or, you already have or plan to ask the advertisers to increase their rates because of the purported or anticipated increased traffic to your web site (as a result of this reckless attack on the professional integrity of your peers and others)?


It is this last possibility that disturbed me enough to oppose your approach. You may continue this disconcerting approach simply to maintain traffic to your web-site. By wilfully using a "popular slant" (see para three) you may be trying to increase your income at the expense of other peoples' reputations. This sort of attack is not protected by First Amendment, to the best of my belief. Please consult your lawyers (if it is Maggio & Kattar, please show it to them for your own sake, please). I give unsolicited advice only when I believe that irreparable harm could be caused to someone, if I (temporarily or forever) held both my peace and piece! The added controversy that may follow my response, may help you in the short-run, increasing "traffic" to your web-site. Perhaps, you used the term yardstick only as a figure of speech. It is one nasty instrument in real life. It is 36 inches long, it is very stiff and, if applied ruthlessly, it causes unbearable pain. This is why the prudent amongst us do not ask for it!
